MEETING MINUTES
MONDAY, DECEMBER 5, 2016 - 6:00 P.M.
COUNCIL CHAMBERS/CITY HALL/ONE CIVIC SQUARE
MEMBERS PRESENT
Council President Ronald E. Carter, Council Members Sue Finkam, Laura D. Campbell, H. Bruce
Kimball, Jeff Worrell, Kevin D. Rider, Carol Schleif. Clerk -Treasurer Christine Pauley, and Deputy Clerk
Jacob Quinn.
Councilor President Carter called the meeting to order at 6:02 p.m.
INVOCATION
Pastor Brian White, Harvest Bible Chapel, pronounced the invocation.
Councilor Campbell led the Pledge of Allegiance.
RECOGNITION OF CITY EMPLOYEES AND OUTSTANDING CITIZENS
Councilor Rider recognized Ashley Ulbricht, Senior Assistant City Attorney, on winning Indy's Best and
Brightest for her category.
APPROVAL OF MINUTES
Councilor Kimball moved to amend minutes from the November 7, 2016 Regular Meeting by striking on
line 89 approved 7-0 and inserting defeated 0-7. Councilor Schleif seconded. There was no Council
discussion. Council President Carter called for the vote. The motion passed 7-0. Councilor Rider moved
to approve as amended. Councilor Finkam seconded. There was no Council discussion. Council President
Carter called for the vote. Minutes As Amended were approved 7-0
RECOGNITION OF PERSONS WHO WISH TO ADDRESS THE COUNCIL
There were none.
COUNCIL, MAYORAL AND CLERK -TREASURER COMMENTS/OBSERVATIONS
Councilor Worrell congratulated staff on a successful holiday celebration in the Carmel Arts and Design
District.
ACTION ON MAYORAL VETOES
There were none.
CLAIMS
Councilor Worrell moved to approve Payroll in the amount of $1,590,117.05. Councilor Schleif
seconded. There was no Council discussion. Council President Carter called for the vote. Payroll was
approved 7-0.
Councilor Worrell moved to approve General Claims in the amount of $2,147,024.70. Councilor Schleif
seconded. Councilor Worrell asked if there were any personal attorney fees in the Claims run. Clerk -
Treasurer Pauley stated that there were not. Council President Carter called for the vote. Claims were
approved 7-0.
COMMITTEE REPORTS
Councilor Finkam announced that the Finance, Utilities and Rules Committee had not met.
Council Rider announced that the Land Use and Special Studies Committee had not met.
OTHER REPORTS
Corrie Meyer gave the monthly report for the Carmel Redevelopment Commission.
OLD BUSINESS
There was none.
PUBLIC HEARINGS
Councilor President Carter announced the First Reading of Ordinance Z-620-16; An Ordinance of the
Common Council of the City of Carmel, Indiana Establishing the Shadow Wood Planned Unit
Development District. Councilor Kimball moved to introduce. Councilor Schleif seconded. Councilor
Kimball introduced the item to Council. Council President Carter opened the public hearing at 6:14 p.m.
Seeing no one who wished to address Council, Council President Carter closed the public hearing at 6:15
p.m. Tim Ochs, Ice Miller, addressed Council regarding the project. Council President Carter referred
Ordinance Z-620-16 to the Land Use and Special Studies Committee.
NEW BUSINESS
Councilor President Carter announced the First Reading of Ordinance D-2336-16; An Ordinance of the
Common Council of the City of Carmel, Indiana, Amending Chapter 9, Article 6, Sections 9-224 and 9-
231(k) of the Carmel City Code. Councilor Schleif moved to introduce. Councilor Kimball seconded.
John Duffy, Director of the Department of Utilities, presented the item to Council. There was brief
Council discussion. Sue Maki, Manager of Environmental Initiatives & Education, addressed Council.
There was extensive Council discussion. Council President Carter passed the gavel to Councilor Finkam
and addressed Council. Council President Carter regained the gavel. Mayor Brainard addressed Council.
John Duffy answered Council questions. There was extensive Council discussion. Councilor Schleif
moved to suspend the rules and act on this tonight. Councilor Finkam seconded. There was no Council
discussion. Council President Carter called for the vote. The motion was approved 7-0. Jon Oberlander,
Assistant City Attorney, addressed Council. Councilor Finkam moved to approve Ordinance D-2336-16.
Councilor Campbell seconded. There was brief Council discussion. Council President Carter called for
the vote. Ordinance D-2336-16 was approved 7-0.
Councilor President Carter announced the First Reading of Ordinance D-2337-16; An Ordinance of the
Common Council of the City of Carmel, Indiana, Adding Section 8-42 to Chapter 8, Article 4 of the
Carmel City Code. Councilor Finkam moved to introduce. Councilor Schleif seconded. Mayor Brainard
presented the item to Council. Councilor Rider moved to suspend the rules and act on this tonight.
Councilor Schleif seconded. There was no Council discussion. Council President Carter called for the
vote. The motion was approved 7-0. Councilor Finkam moved to approve Ordinance D-2337-16.
Councilor Campbell seconded. There was brief Council discussion. Council President Carter called for
the vote. Ordinance D-2337-16 was approved 7-0.
Councilor Finkam made a motion to amend the agenda and add Resolution CC -12-05-16-04 under Other
Business. Councilor Schleif seconded. There was no Council discussion. Council President Carter called
for the vote. The motion was approved 7-0.

Councilor Worrell made a motion to amend the agenda and add Ordinance D-2338-16 under Other
Business. Councilor Schleif seconded. There was no Council discussion. Council President Carter called
for the vote. The motion was approved 7-0.
Councilor President Carter announced Resolution CC -12-05-16-01; A Resolution of the Common
Council of the City of Carmel, Indiana, Expressing Interest in the Purchase of Certain Properties Valued
at Over $25,000. Councilor Worrell moved to introduce. Councilor Schleif seconded. Corrie Meyer
presented the item to Council. There was extensive Council discussion. Council President Carter referred
Resolution CC -12-05-16-01 to the Land Use and Special Studies Committee.
Councilor President Carter announced Resolution CC -12-05-16-02; A Resolution of the Common
Council of the City of Carmel, Indiana, Approving a Transfer of Funds Between the 2016 Carmel
Common Council Budget and 2016 Carmel Fire Department Budget. Councilor Finkam moved to
introduce. Councilor Schleif seconded. Chief Dave Haboush, Carmel Fire Department, made a
presentation to Council. There was brief Council discussion. Councilor Finkam moved to approve
Resolution CC -12-05-16-02. Councilor Campbell seconded. There was brief Council discussion. Council
President Carter called for the vote. Resolution CC -12-05-16-02 was approved 7-0.
Councilor President Carter announced Resolution CC -12-05-16-03; A Resolution of the Common
Council of the City of Carmel, Indiana, to Petition the Indiana Department of Local Government Finance
to Adjust the Levy Limit of the City for the Year 2017. Councilor Schleif moved to introduce. Councilor
Finkam seconded. Curt Coonrod, Coonrod and Associates, presented the item to Council. There was
extensive Council discussion. Mayor Brainard addressed Council. Councilor Finkam moved to amend
Resolution CC -12-05-16-03 by striking $500,000 on line 41 and inserting $190,000. Councilor Worrell
seconded. There was brief council discussion. Council President Carter called for the vote. The motion
was approved 7-0. Councilor Finkam moved to approve Resolution CC -12-05-16-03 As Amended.
Councilor Worrell seconded. There was brief Council discussion. Council President Carter called for the
vote. Resolution CC -12-05-16-03 As Amended was approved 7-0.
Council President Carter recessed the meeting at 7:40 p.m.
Council President Carter reconvened the meeting at 7:53 p.m.
OTHER BUSINESS
Councilor President Carter announced Resolution CC -12-05-16-04; A Resolution of the Common
Council of the City of Carmel, Indiana, Approving a Transfer of Funds in the 2016 Carmel Community
Relations Department Budget. Councilor Rider moved to introduce. Councilor Schleif seconded.
Councilor Rider moved to approve Resolution CC -12-05-16-04. Councilor Worrell seconded. There was
no council discussion. Council President Carter called for the vote. Resolution CC -12-05-16-04 was
approved 7-0.
Councilor President Carter announced Resolution CC -12-05-16-05; A Resolution of the Common
Council of the City of Carmel, Indiana, Approving a Transfer of Funds Between the 2016 Carmel Police
Department Budget and the 2016 Clerk -Treasurer's Office Budget. Councilor Finkam moved to
introduce. Councilor Worrell seconded. Councilor Finkam presented the item to Council. Linda Harvey,
Chief Deputy Clerk -Treasurer, addressed Council. There was brief Council discussion. Clerk -Treasurer
Pauley answered Council questions. Mayor Brainard addressed Council. Councilor Finkam moved to
approve Resolution CC -12-05-16-05. Councilor Schleif seconded. There was no council discussion.
Council President Carter called for the vote. Resolution CC -12-05-16-05 was approved 7-0.
Councilor Rider moved to reconsider Ordinance D-2337-16 and amend on line 28 and 33 by striking 10
and inserting 8.5. Councilor Worrell seconded. There was brief council discussion. Council President
Carter called for the vote. The motion was approved 7-0. Councilor Finkam moved to approve Ordinance
D-2337-16 As Amended. Councilor Worrell seconded. There was brief Council discussion. Council
President Carter called for the vote. Ordinance D-2337-16 As Amended was approved 7-0.
Doug Haney, Corporation Counsel, addressed whether the city owns contracted work paid with tax
dollars and if work products were permitted to be released to the media.
Councilor President Carter announced the First Reading of Ordinance D-2338-16; An Ordinance of the
Common Council of the City of Carmel, Indiana, Amending Chapter 7, Article 3, Section 7-27 of the
Carmel City Code. Councilor Finkam moved to introduce. Councilor Campbell seconded. Councilor
Schleif presented the item to Council. Mike Hollibaugh, Director of the Department of Community
Services, addressed Council. Council President Carter referred Ordinance D-2338-16 to the Land Use and
Special Studies Committee.
ANNOUNCEMENTS
Councilor Schleif addressed Council and announced her resignation from the Carmel City Council.
