COUNCIL CHAMBERS/CITY HALL/ONE CIVIC SQUARE MEETING CALLED TO ORDER Council President Sue Finkam; Council Members: Kevin D. Rider, Ronald E. Carter, Anthony Green, Laura Campbell, H. Bruce Kimball, Jeff Worrell and Deputy Clerk Jacob Quinn were present. Council President Finkam called the meeting to order at 6:00 p.m. INVOCATION Rev. Kim King, St. Luke's United Methodist Church, delivered the Invocation. Council President Finkam led the Pledge of Allegiance. RECOGNITION OF CITY EMPLOYEES AND OUTSTANDING CITIZENS There were none. APPROVAL OF MINUTES Councilor Rider moved to approve minutes from the May 1, 2017 Regular Meeting. Councilor Campbell seconded. There was no Council discussion. Council President Finkam called for the vote. Minutes were approved 6-0 (Green absent). RECOGNITION OF PERSONS WHO WISH TO ADDRESS THE COUNCIL There were none. COUNCIL AND MAYORAL COMMENTS/OBSERVATIONS Councilor Worrell noted that multiple elementary schools were named four star schools. He also congratulated new conductor of the Carmel Symphony Orchestra, Janna Hymes. Councilor Carter asked Mayor Brainard about the status of enforcing Ordinance D-2358-17 (Parking Restrictions for Commercial Vehicles on City Paths). President Carter also enquired about the status of meetings for the Audit Committee. Council President Finkam stated that the Audit Committee were working on getting the first meeting scheduled. Councilor President Carter announced that they had over 3,000 people at the Carmel Farmer's Market the previous weekend. Councilor Kimball announced on bikecarmel.com there are many events coming up. ACTION ON MAYORAL VETOES There were none. CLAIMS Councilor Rider moved to approve Payroll in the amount of $1,586,099.80. Councilor Campbell seconded. There was no Council discussion. Council President Finkam called for the vote. Payroll approved 7-0. Councilor Rider moved to approve General Claims in the amount of $3,153,878.22. Councilor Campbell seconded. There was no Council discussion. Council President Finkam called for the vote. Claims were approved 7-0. Councilor Rider moved to approve Retirement in the amount of $93,886.35. Councilor Campbell seconded. There was no Council discussion. Council President Finkam called for the vote. Retirement was approved 7-0. Councilor Rider moved to acknowledge Wire Transfers in the amount of $2,447,826.26. Councilor Campbell seconded. There was no Council discussion. Council President Finkam called for the vote. Wire Transfers were acknowledged 7-0. COMMITTEE REPORTS Councilor Rider announced that the Finance, Utilities and Rules Committee had met and that the committee reports would be given when the items appear on the agenda. Councilor Kimball announced that the Land Use and Special Studies Committee had met and that the committee reports would be given when the items appear on the agenda. OTHER REPORTS There were none. OLD BUSINESS Council President Finkam announced the Second Reading of Ordinance D-2361-17; An Ordinance of the Common Council of the City of Carmel, Indiana, Reestablishing the Tax Rate for the City of Carmel Cumulative Capital Development Fund and Reaffirming Carmel City Code Chapter 2, Article 4, Section 2-91, Accordingly. Councilor Rider announced that this item is returning from the Finance, Utilities and Rules Committee with a positive 3-0 recommendation. Curt Coonrod, C.L. Coonrod & Company, addressed Council. Councilor Green asked Curt Coonrod a series of questions. Councilor Rider moved to approve Ordinance D-2361-17. Councilor Worrell seconded. There was no council discussion. Council President Finkam called for the vote. Ordinance D-2361-17 was approved 7-0. 2 Council President Finkam announced the Fourth Reading of Ordinance Z-622-17; An Ordinance of the Common Council of the City of Carmel, Indiana, Amending a Variety of Procedures for the Carmel Plan Commission and Carmel Board of Zoning Appeals in the Carmel Zoning Ordinance. Councilor Kimball announced that this item is returning from the Land Use and Special Studies Committee with a positive 3- 0 recommendation. John Molitor, Contract Counsel for the Carmel Plan Commission and Board of Zoning Appeals, addressed Council. There was extensive Council discussion. Mike Hollibaugh, Director of Community Services, addressed Council. Mayor James Brainard addressed Council. Councilor Rider moved to amend on line 48 by inserting after 403.5, on the condition that all members of the Council shall be notified not less than three (3) calendar days before a development is docketed for a combined hearing procedure and that each member of the Council shall be entitled to object to the use of the combined hearing procedure for that development. Councilor Carter seconded. There was no Council discussion. Council President Finkam called for the vote. The motion to amend Ordinance Z-622-17 was approved 7- 0. Councilor Rider moved to approve Ordinance Z-622-17 As Amended. Councilor Campbell seconded. There was brief Council discussion. Council President Finkam called for the vote. Ordinance Z-622-17 As Amended was approved 7-0. Council President Finkam announced the Fourth Reading of Ordinance Z-623-17; An Ordinance of the Common Council of the City of Carmel, Indiana, Amending the Sign Regulations in the Carmel Zoning Ordinance. Councilor Kimball announced that this item is returning from the Land Use and Special Studies Committee with a positive 3-0 recommendation. Jon Oberlander, Assistant City Attorney, presented to Council. Rachel Keesling, Department of Community Services, presented to Council. Councilor Kimball moved to approve Ordinance Z-623-17. Councilor Campbell seconded. There was no Council discussion. Council President Finkam called for the vote. Ordinance Z-623-17 was approved 7- 0. Council President Finkam announced the Fourth Reading of Ordinance D-2358-17; An Ordinance of the Common Council of the City of Carmel, Indiana, Adding Section 6-109 to Chapter 6, Article 5, Division IV of the Carmel City Code. Councilor Rider announced that this item is returning from the Finance, Utilities and Rules Committee with. a positive 3-0 recommendation. Councilor Rider moved to approve Ordinance D-2358-17. Councilor Carter seconded. There was no Council discussion. Council President Finkam called for the vote. Ordinance D-2358-17 was approved 7-0. Council President Finkam announced the Second Reading of Ordinance D-2363-17; An Ordinance of the Common Council of the City of Carmel, .Indiana, Amending Chapter 8, Article 5, Section 8-29 of the Carmel City Code; Sponsor. Councilor Rider announced that this item is returning from the Finance, Utilities and Rules Committee with a positive 3-0 recommendation. Councilor Rider moved to approve Ordinance D-2363-17. Councilor Campbell seconded. There was no Council discussion. Council President Finkam called for the vote. Ordinance D-2363-17 was approved 7-0. PUBLIC HEARINGS Council President Finkam announced the Second Reading of Ordinance D-2362-17; An Ordinance of the Common Council of the City of Carmel, Indiana, Authorizing the Vacation A Portion of the Old South Street Public Right of Way; Sponsor: Councilor Kimball. TABLED. Councilor Kimball moved to remove the item from the table. Councilor Campbell seconded. There was no Council discussion. Council President Finkam called for the vote. The motion was approved 7-0. Council President Finkam opened the public hearing at 6:52 p.m. Ronald Smith addressed Council in favor of the ordinance. 3 Jamie Featherstone spoke in opposition to the ordinance. NEW BUSINESS Council President Finkam announced the First Reading of Ordinance D-2364-17; A Bond Ordinance of the City of Carmel, Indiana, for the Purpose of authorizing the Execution and Delivery of its Junior Waterworks Revenue Refunding Bonds of 2017, and Approving Certain Related Matters in Connection Therewith. Councilor Rider moved to introduce the item into business. Councilor Carter seconded. John Duffy, Director of the Department of Utilities, presented the item to Council. Mayor Brainard addressed Council. Councilor Rider moved to suspend the rules and act on the item this evening. Councilor Worrell seconded. There was no Council discussion. Council President Finkam called for the vote. The motion was approved 7-0. Councilor Rider moved to approve Ordinance D-2364-17. Councilor Carter seconded. There was no Council discussion. Council President Finkam called for the vote. Ordinance D-2364-17 was approved 7-0. Council President Finkam announced the First Reading of Ordinance D-2366-17; An Ordinance of the City of Carmel, Indiana, Amending Ordinance D-2234-15 in Connection with the Proscenium Project. Council President Finkam announced the First Reading of Ordinance D-2365-17; An Ordinance of the City of Carmel, Indiana, Adding Chapter 6, Article 5, Division III, Section 6-101 to the Carmel City Code.
