The regular meeting of the Carmel Plan Commission was called to order by
the vice president, Jeff Davis, at 7: 34 P.M. , May 19, 1987 at the City Meet-
ing Hall. The meeting opened with the Pledge of Allegiance.
Roll was called and members present were: Richard Albright (arrived 8: 00) ,
Sandra Long, Max Moore , Sue McMullen, Bob Boone , Paul Ayers, Ila Badger, Jim
Schneider, Minnie Doane , Jim O'Neal and Henrietta Lamb. Vaughn Story was
absent.
Staff members present were: Chuck. Kiphart, Dave Rickard, Gordon Byers
and Rosalind McCart.
There were no additions or corrections to the minutes of the April 21 ,
1987 meeting and Miss Doane moved that they be approved as submitted.
Seconded by Mr. Boone.
Motion carried.
Mrs. Badger announced that on June 9, 1987 at 7: 30 P.M. at the City Meet-
ing Hall the Grading Ordinance Committee will meet and asked the following
people to participate: Dick Albright, Vaughn Story, Paul Ayers , Jim O'Neal
and Bob Boone.
On Wednesday, June 10, 1987 , the 421 Corridor Committee will meet at
7: 30 P.M. at the City Meeting Hall.
Mrs. McMullen informed that the Paul Estridge property rezone on S. Range
Line Rd. was unanimously approved by the City Council.
G. Public Hearings
lg. 7: 30 P.M. , Public Hearing on Docket No. 41-87 P.P. , Primary Plat Appli
cation for Kingswood Subdivision consisting of 221 lots on 102.1 acres
Site is zoned S-2 and is located on the east side of Gray Rd. approx.
2 mile south of 116th St. in Clay Twp.
Filed by Ray Roehling for Kingswood, Inc.
Mr. Roehling was present.
The public hearing opened at 7:40 with Mr. Jim Nelson making the present-
ation.
An aerial map was presented to show location.
The primary plat was shown.
Sidewalks will be located within the subdivision.
Lots will be 12, 000 - 39,000 sq. ft. in size and the price will range from
$170, 000 to $225, 000.
Primary entrances will be on N. Gray Rd.
The south entrance rendering was presented to show entrance treatment.
The improvements to N. Gray Rd. are on file in the Dept. of Community Dev-
elopment.
This is to be a low density residential subdivision.
The public hearing closed at 7:48.
This item was referred to the Subdivision Committee for review on June 2,
1987 at 7: 30 P.M. at the City Meeting Hall.
2g. 7: 30 P.M. , Public Hearing on Docket No. 42-87 P.P. , Primary Plat Appli
cation for Lexington Farms, a proposed cluster subdivision consisting
of 272 lots on 89.7 acres. Site is zoned R-1 and a portion R-3 and is
located between 111th St. and 106th St. immediately west of the rail-
road tracks in Clay Twp.

Charles Davis , president and principal share holder, and Dean Ziegler and
Chris White , Paul I. Cripe, Inc. , were present.
The public hearing opened at 7:50 with Mr. Jim Nelson making the present-
ation.
An aerial photo was presented to show location (formerly the Settles prop-
erty) and surrounding land uses.
This area is to be developed as a residential subdivision of 272 family
homesites.

The Settles home will be retained and the pool house and swimming pool
and will be incorporated in what will become the primary amenity area.
The site and landscape plans were presented.
There will be sidewalks on 106th St. as well as on 111th St. and roadway
improvements will be made at the main entrances and accel-decel lanes will
be installed.
The Development Plan is being presented under the Cluster Option.
The entrance detail for 111th and 106th Streets was shown.
Single family detached homes of tudor, ranch and traditional types will be
represented.
R-1 standards are met.
Jim Steckley, 5829 E. 116th St. , stated he feels this is a step forward
for the area.
Richard Kelly, 11006 Willowmere Dr. , questioned the water facility and if
the sewers can handle this project and what is it going to do to the streets
as they are bad enough now. Mr. Kelly also questioned lot size and the price
range of the homes.
Rosalind McCart, 10925 Beechwood Dr. , stated that she is not opposed to
the project but is concerned about construction beginning in the area before
the sewer project is completed and the roads are repaired.
Skip stone, 106th St. , stated that too many homes are proposed for this
small an area.
Denise Moore , 10845 McPhearson, stated concern for the sewers and the
number of people in the area and asked if there is a utility easement through
the area and if the width is 100 ft.
Dean Ziegler, 8200 Haverstick Rd. , responded in regard to the sewers that
they have approval for the homes and that there will be city water.
Improvements will be make to 106th and 111th Streets.
The price range will be from $70 ,000 to 130,000.
The petitioner plans to start the project the first to mid August of this
year.
The public hearing closed at 8: 35.
This item was referred to the Subdivision Committee for review on June 2,
1987 at the City Meeting Hall.

3g. 7:30 P.M. , Public Hearing on Docket No. 43-87 P.V. , A Plat Vacation
Request for the portion of College Park Subdivision north of I-465.
Petitioner requests the vacation of 259 of the 656 original platted
lots. Site is zoned S-2 and is located on the N. W. corner of I-465
and College Ave . in Clay Twp.

public hearing opened at 8: 37 with Mr. Nelson making the presentation
support of the petitioner' s proposal of plat vacation for development of
an office park.
This is the first time a plat vacation has come before the Carmel Plan
Commission.
Location was shown.
They request to vacate the plat covenants and commitments for the portion
of College Park Subdivision that lies north of I-465.
Zoning remains R-1.

Mr. Nelson related that if this is approved the petitioner plans to come
to the Plan Commission for a rezone for an office park.
The conceptual site development plan was presented.
Mr. Nelson related the purpose of the original platting and explained the
reasons for not developing to date .

The location is in a transitional land use area in the southern entrance
to the Carmel community.
Mr. Boone asked to be removed from consideration of this matter.
Mr. Byers explained what Mr. Nelson and the petitioner have filed accord-
ing to statutory procedure and stated that, in his opinion, Mr. Nelson has
complied with what the legislature placed in the law in that he has filed the
appropriate legal documents describing the real estate. He has tendered to
the Plan Commission a document indicating his reasons to vacate the plat and
the covenants. He has also tendered to us a copy of the covenants and com-
mitments that he wishes to vacate. He has indicated what the interest of the
peitiioner is and he has indicated the contract sellers or certain individual
who are selling to the entity that is the petitioner. He has also tendered
to us a certified list of surrounding property owners certified by the Ham-
ilton County Auditor of individuals who are to be given notice and property
owners that are interested parties pursuant to the vacation proceeding as
described In the statute. Mr. Nelson has put together and tendered proposed
findings of fact to the Plan Commission and they follow the evidence that he
has made tonight. Mr. Byers said this hearing is before the Plan Commission
because the legislature described the Plan Commission as the appropriate body
in a municiple entity to entertain and hold a hearing. Mr. Byers stated that
this matter should then go to committee.
Mr. Kiphart said that this matter should follow the process of going to
the Technical Advisory Committee and to the Subdivision Committee and then
back to the Plan Commission.
Mr. Kiphart explained that there are certain specific areas in the Comp-
rehensive Plan within Carmel and Clay Twp. that the Plan Commission left
open to make a final decision in these areas as to what an appropriate change
in zoning might be and that those recommendations would be based on a concept
that might be presented with a request to rezone and that this particular
area is one of those transition areas.
Mrs. Betty Hawkins, 10240 N. Delaware, President of Northridge Neighbor-
hood Assn. , said they prefer that this land remains residential, but if the
Plan Commission ultimately decides that the land would best be used for an
office complex their prime concern is that the plat remains in tact along
with its covenants and restrictions until the Plan Commission has a firm site
plan from Trammell-Crow as well as traffic studies, a report on sewer capacit
buffer areas etc. Until the Commission is completely convinced that College
Park should be rezoned for business, the residents need the protection that
the plat and covenant now affords them. Mrs. Hawkins said they want a firm
commitment from the petitioner and the county stating that their neighborhood
streets will not be used as access to their development. They want to know
how they will enter and exit their own already established neighborhood and
also a substantial buffer is necessary. Mrs. Hawkins said that for these
reasons they request a continuance of this hearing until such time that this
commission can make a thorough study of all the consequences of rezoning
College Park.
John George , 10109 Broadway, one of the adjacent property owners , said he
felt this would be residential when he bought there 30 yrs. ago. Mr. George
said he respects the fact that perhaps some changes are going to be made but
they want to know what these changes represent. Mr. George said he is con-
cerned about property devaluations and wants the Plan Commission to either
postpone this until they have something more detailed as to dimensions of
buildings before rezoning.
Ron Weise , 10129 N. New Jersey, said he enjoys the natural area there now
and wants the petitioner to consider keeping the area natural.
Jim Ogle , 10225 N. Delaware , stated concern regarding traffic from all
the developments.
Kathy Godfried, corner of 101st and College , stated concern about where
the entrance from College to this addition will be, relating that traffic is
bad now.

Larry Wessner, 10204 N. New Jersey, expressed concern about the foliage
to the south and asked to know more about the buffer between Northridge and
this development.
Betty Hawkins, 10240 N. Delaware, asked why can't the Plan Commission
vacate the plat and rezone at the same time.
Mr. Albright related that they have not petitioned to rezone at this
time.
Mrs. McMullen stated that all the Plan Commission is doing is vacating
a plat and that the petitioner still has to prove his case for a rezone.
Mr. Nelson clarified that they are before the Commission to vacate the pla
stating that the development plan was shown only to show the high development
quality of the petitioner. Mr. Nelson said he feels it is in the public' s
best interest to vacate the plat and it could be conditioned on the fact that
Trammell-Crow would within 90 days file with the Plan Commission an appli-
cation to rezone and supported by the applicable covenants and containing a
final site development plan.
The difference between Trammell-Crow and Crow-Indianapolis was questioned.
Mr. Gillespie said it is merely a cover for the entire company and the
Crow-Indianapolis is the local company operated by Mr. Gillespie.
Mrs. Betty Hawkins, 10240 N. Delaware , stated concern for covenants for
them until the Plan Commission is satisfied w.th the plat they are presenting
The surrounding property was questioned by Mrs. Badger.
Mr. Schneider, Plan Commission member, said he owns this property and has
no financial interest in this matter before us.
Mr. Byers said he will present to the Plan Commission at the next meeting
regarding what financial interest is , direct or indirect.
Members questioned regarding vacationing plats and covenants.
Mr. Nelson explained.
Mr. Ayers said the committee would like to have a copy of the covenants
that exist.
Mr. Kiphart asked if vacating the plat automatically gets rid of all the
road right-of-ways and all the drainage easements.
Mr. Nelson said yes , but not the legal drains. It gets rid of everything
that is platted.
Mr. Kiphart asked if you are going to be building commercial roads through
Northridge why isn't that also being vacated.
Mr. Nelson related that Northridge was created many years ago by College
Park and in the original deeds from the original grantor of these lots, a
restriction was put in those deeds restricting the use for residential pur ose
only. Mr. Nelson said you can't vacate covenants in a deed. p
Mr. Nelson stated that the Clara Knotts Drain ties into their drainage plar,

Mr. Albright asked Mrs. Lamb to sit in on this committee for the June 2
meeting.
H. Old Business
lh. Commission to consider Docket No. 32-87 P. P. , Primary Plat Application
for Smokey Knoll, Sec. 2, consisting of 88 lots on 42. 66 acres. Site
is zoned R-1 and is located on the N.W. corner of 136th St. and Gray Rd.
in Carmel, IN.
Filed by Richard Fisher for SAFCO Development.
Mr. Stan Neal was present.
Mr. Schneider gave the Subdivision Committee report (which is a part of
the official minutes and attached to the master copy) . The committee recom-
mended approval and Mr. Schneider so moved.
Seconded by Mr. Davis.
Findings of fact were completed by members.
Motion carried unanimously.

2h. Commission to consider Docket No. 35-87 Z , Rezone Application for a
10.52 acre parcel located on the west side of N. Michigan Rd. (S.R.
421 approx. 1000 ft. north of 106th St. in Clay Twp. , Indiana.
Filed by John S. Pearson III.
Mr. Coots was present.
Mrs. Badger gave the Land Use Committee report (which is a part of the
official minutes and attached to the master copy) . The committee recommended
approval and Mrs. Badger so moved.
Seconded by Dr. Long.
Findings of fact were completed by members.
Motion carried unanimously and a favorable recommendation will be sent
to the City Council.
3h. Commission to consider Docket No. 36-87 P.P. , Primary Plat Application
for Smokey Ridge , Sections 2-6, consisting of 115 lots on 68 acres.
Site is zoned R-1 and located on the N.W. corner of 136th St. and
Carey Rd. in Carmel , IN.
Filed by Paul R. Lipps and D. Craig Sharpe.
Mr. Davis Coots was present.
Mr. Ayers gave the Subdivision Committee report (which is a part of the
official minutes and attached to the master copy) . The committee recommended
approval subject to an off site drainage agreement being reached and the PSI
easement now owned by Mrs. Hazel Foster be quick claim deeded over to the
adjacent land owner in order to allow a through street connection with the
adjoining subdivision and Mr. Ayers so moved.
Seconded by Mr. Schneider.
Mr. Kiphart asked for a copy of the quick claim deed recorded in the court
house on the PSI easement to the north and stated that the off site drainage
easement needs to be resolved and asked that the primary plat be approved to-
nightconditional on those two items being submitted to his office and that a
secondary plat not be submitted to the Plan Commission until these two items
are resolved.
Mr. Coots responded stating that they will work with Mr. Kiphart' s office
or the Technical Advisory Committee and Mr. Byers if there is anything else
that needs to be resolved.
Mr. Kiphart said be it easement or agreement they want something binding
on this no matter who owns the property in the future. Mr. Kiphart stated
that just an agreement between two property owners is not strong enough to
assure proper off site drainage for these subdivisions. Mr. Kiphart said
that Mr. Byers and Mr. Andrews did indicate that there was a way to put the
proper terminology in those agreements that would serve the same purpose as
an easement.
Mr. Davis stated that no more conditional approvals are to come to the
Plan Commission for Primary Plat.
Mr. Coots said there will not be a Secondary Plat filed until this matter
is resolved.
Findings of fact were completed by members.
Motion carried unanimously for conditional approval.
4h. Commission to consider Docket No. 37-87 ADLS, Architectural Design,
Lighting and Signage Application for Carmel Medical Center, a 28,174
sq. ft. medical office building. The 2.61 acre site is zoned i-8 and
is located on the east side of Medical Drive directly south of Flanner
Buchanan Funeral Home in Carmel, IN.

5h. Commission to consider Docket No. 38-87 D.P. , Development Plan Appli-
cation for Meridian Park Place, a 29,600 sq. ft. general office build-
ing. The 3.21 acre site is zoned B-2/U.S. 31 Corridor and is located

on the west side of N. Meridian St. (U.S. 31) approx. 2000 ft. north
of Old Meridian St. in Clay Twp. , Indiana.

Mr. Coots was present.
Mr. Boone gave the Industrial and Commercial Committee report and stated
that no action was taken at the committee meeting and that the petitioner
is to have a full report to present to the Plan Commission this evening.
Mr. Kiphart related that all the things discussed at committee meeting
have been resolved and that he now feels they have _a complete file.
Mr. Coots made the presentation regarding the issues at hand.
There will be a 30 ft. buffer installed.
Signage does conform to the ordinance.
There will be no directory sign until there are 7 tenants.
The landscape plan was presented.
Air conditioners and all mechanical equipment will be screened on top of
the building (screened on all 4 sides in the center area of the building) .
There is only one mechanical unit for this building.
All trash will be on the interior.
Mr. Boone moved that Docket No. 38-87 D. P. be approved subject to the
Board of Zoning Appeals Variance approval.
Seconded by Dr. Long.
Motion carried with Mr. Albright voting NO.
6h. Commission to consider Docket No. 40-87 S. P. , Secondary Plat Appli-
cation for Woodgate, Sec. 3, consisting of 38 lots on 22 acres. The
site is zoned R-1 and is located south of 146th St. and north of the
existing Cool Creek North Subdivision in Carmel , IN.
Filed by Robert Langston.
Mr. Stuart Huckleberry was present.
Mrs. McMullen relatedthat she had asked Mr. Langston to be present this
evening and that she is not willing to vote unless he is present.
Mrs. McMullen said she would like this item tabled until Mr. Langston is
present.
Mr. Davis Coots, counsel for Mr. Langston, was present.
Mr. Huckleberry said the plats for Woodgate, Sections I and II have been
recorded and these streets are dedicated right of ways and it would be a
problem to shut off completely a dedicated right of way.
Mr. Huckleberry explained the road routing procedure being used to dis-
courage people from using the southern entrance to Woodgate.
Mrs. McMullen stated that they are not to go through Cool Creek North and
that they still are and that the Plan Commission was promised that this
would not happen.
Mr. Coots spoke regarding this problem and said there is a limit to which
the developer can police what you seek that he control and if we are
goin
permit the opening up of sections of a development, such as Woodgate, whereto
there are completed houses that are sold, these people have the right to the
access to the public thoroughfares that are dedicated.
Discussion followed.
Mr. Kiphart said that all information has been presented and it is in con-
formance with the Primary Plat that was approved and the Carmel Subdivision
Regulations.
Mr. Davis moved approval of Docket No. 40-87 S. P. for Woodgate , Section 3.
Seconded by Mr. Ayers.
Motion carried unanimously.
Mr. John West of Pizza King was present asking that the commission hear
his request for restaurant remodeling this evening.
Mr. Kiphart explained that staff had met with them a month ago and there
was missing information that was needed and that the petitioner did not get
it in in time to be included in the agenda for this evening.

Mr. Kiphart stated that staff needs time to review this information
before it goes to the Plan Commission and to committee.
Mr. Ayers moved to sent this matter to committee.
Seconded by Mr. Davis.
Motion carried with Mrs. Badger voting NO.
Mr. Kiphart announced that staff member, Dave Rickard, is resigning
effective June 12, 1987.
There being no further business to. come before the Commission, the meet-
ing adjourned.
