FINDINGS OF FACT - DEVELOPMENT STANDARDS VARIANCE
1. The approval of this variance will not be injurious to the public health, safety, morals and general
welfare of the community because:
The applicant is seeking a variance to allow stacking for the proposed drive thru lane to be along
the north side of the proposed building that will then exit along the west side of the proposed
building. To mitigate this request, the applicant will be installing landscape plantings along the
western perimeter of the site and the subject property is one property removed from US
421/Michigan Road, as an existing gas station is located between the subject property and US
421/Michigan Road. As a result, adequate and proper screening and buffering to the proposed
drive thru lane will exist and approval of this variance will not be injurious to the public health,
safety, morals and general welfare of the community.
2. The use and value of the area adjacent to the property included in the variance will not be affected
in a substantially adverse manner because:
In addition to the rationale included in the response above, the properties and buildings to the
immediate north, south, east and west of the subject property consist of business and retail uses. As
a result, the use and value of the area adjacent to the property included in the variance will not be
affected in a substantially adverse manner.
3. The strict application of the terms of the Zoning Ordinance to the property will result in practical
difficulties in the use of the property because:

difficulty because the applicant will be unable to design an efficient and effective site circulation
plan for the proposed building and use that are permitted by the underlying zoning.
DECISION
IT IS THEREFORE the decision of the Carmel Board of Zoning Appeals that Development Standards Variance
Docket No. 17060008V is granted, subject to any conditions stated in the minutes of this Board, which are
incorporated herein by reference and made a part hereof.

FINDINGS OF FACT - DEVELOPMENT STANDARDS VARIANCE
1. The approval of this variance will not be injurious to the public health, safety, morals and general
welfare of the community because:
The applicant is seeking a variance to allow a minimum of 8 cars in the drive thru stacking lane.
Due to the relatively small size of the proposed building, permitting a minimum of 8 cars in the
drive thru stacking lane should not result in difficulties for site circulation for other cars that may
be circulating or parking on the site or travelling in the general vicinity of the proposed building.
As a result, adequate and proper site circulation will be provided on and around the site and
approval of this variance will not be injurious to the public health, safety, morals and general
welfare of the community.
2. The use and value of the area adjacent to the property included in the variance will not be affected
in a substantially adverse manner because:
