The Preliminary Plat submitted to us on February 16, 1971 with Suhutz &
Thompson's application for Preliminary approval of proposed subdivision has been
reviewed with the following comments:
All 156 lots meet the minimum lot size requirement of 12,000 sq. ft.
All, except 23 lots meet the minimum lot width requirement of 100 ft.
at the building line. These 23 lots are all located on Cul-de-sacs where
the corresponding width at the property line should be 70' minimum for a
25 ft set-back and 62 ' minimum for a 30 ft set back. These 23 lots have an
average lot area of 22,000 sq. ft. which should allow the building to be
satisfactorily set back.
The 25 ft. building lines shown in the development should be increased
to 30 ft.
The proposed surface drainage facilities shown on the plat should satis-
factorily control the drainage within the development.
The sanitary sewer layout looks satisfactory.
The lots bordering on the lake need further clarification as to their bound-
aries along the lake front.
No size is shown for the 90 ft. long drainage pipe under the road at the
South end of lot no. 38.

as submitted, subject to a Performance Bond of *30,000 for clearing of Blue
Woods Creek and subject to the conditions pointed out by the Town Engineer
in the attached letter.

Re: Blue Woods Creek Storm Drainage
Gentlemen;
In regards to the proposed clearing of the Blue Woods Creek area
I wish to bring to your attention the possibility of requiring
a bond subject to the completion of the above project. This is
strictly a suggestion which I believe would be to the best interest
of the Town of Carmel and Clay Township and is not intended to re-
flect negatively towards the applicant.

BLUE WOODS CREEK STORM DRAINAGE

The Hamilton County Drainage Board and the County Surveyor
accepts the proposed reconstruction plans of the above named
' ditch with the following specifications:
• 1. Ditch right-of-way to be ?5 feet each sidefrom top of
bank.
2. ' Clear one side of all underbrush.
3. Leave all large trees possible on top of bank.
• 4. 2 : 1-Side slopes.
5. Burn and bury all trees, brush, and stumps at least two
feet below finished grade.
6. Bury all rocks in excess ; cubic foot.
• 7. Banks to be seeded (8 lbs. rye grass, 30 lbs. fes-cue,
600 lbs. 15-15-15/ac) .
• 8. Dirt excavated from ditch to be spread and leveled to
one foot depth maximum.
9. ; All road culverts, crossings, bridges and pipes must
meet Hamilton Co. Highway Specifications. •
10. All bench marks and 'descriptions must be shown on plans. .
11. Seeding of ditch banks must be completed immediately
following construction.
12. No angle of less than 120° shall be constructed in the
main channel of the open drain.
Following reconstruction; the County Surveyor must inspect
the completed project and give his appreval. prior to, acceptance by
the Hamilton County Drainage Board. •
After approval by the County Drainage Board the private drain
; .constructed on the Geneva Fisher farm must be. requested by the
< parties involved and ,must meet the specifications of the Hamilton
County Drainage Board.

Encl: the order of the Hamilton County Drainage Board
issued July 6, 1971 is complied with, which is:
that Ken Thompson have the written approvalof
abutting property owners before final plat approval
is granted by the Plan Commission. Furthermore,
Myrneth Anderson asked that we confirm that all
approvals are obtained before final plat approval.
Ralph Morgan, for one, is not going to allow Ken
to clean the Blue Wood ditch (at least his privately
owned portion of it) until Ken shores up the existing
ditch to the nofth along the east line of Woodland
Greens Addition.
So, no apprumal on these bonds until this is settled.

TO PLAN COMMISSION:
SECTION I: Collection by 8", all flows into a 10 inch sewer which flows S. E. into
SECTION II. A manhole should be provided at the North end of the 8" line just North
of lots 30 and 31. I believe this is to be completed in agreement with Keystone
Square Company.
SECTION II: 4 lots are picked up by an 8" collector which flows into the 10
which flows S. E. from Section I. The balance of the lots are11"1ine

connected into the 15 inch Keystone Interceptor at 106th and Blue Woods Creek.
STREETS: Curbs, sidewalks, and street profiles conform to Town of Carmel require-
ments and the Plan Commission Ordinances. There is one street which terminates in
a dead end at the North end of lots 30 and 31 in Section I. The Ordinance requires
a turn-a-round be provided. I believe this is to be completed in agreement with
Keystone Square Co. I believe that the portions of the Sub-Division abutting 106th
Street and abutting Haverstick Rd. should provide for street widening and improve-
ments including curb and gutter sections, storm drainage and sidewalks.
STORM DRAINAGE: The storm drainage is a large and complex picture
several months of difficult negotiations.) I have been unable to extensivelydre Ver
view these plans and feel that documentation from the design engineers coupled with
the approval of the Soil and Conservation people and the County Drainage Board,
(for Blue Woods Creek and the lake), should be given to the Town Engineer. The
basic storm drainage within Sections I and II is well laid out and is typical until

WATER: Proposed to be provided by Indianapolis,Water Co. Now shown on drawings.
A sketch of Fire Hydrants layouts was submitted to Chief Swails. Layout looked '
O.K. to me.
GENERAL: I would recommend final plat approval subject to meeting the following
conditions:
1. Drawings and legal description to be provided for completing turn-a-round at
lots 30 and 31 in the 1st. Section as well as for completion of Sanitary Sewer and Vman hole at this location.

2. That the developer be bound to follow any recommendations which might be forth
coming from the Town's Consulting Engineers, the Department of Natural Resources
the Drainage Board or the Town Engineer, relative to the ponding capacity of the
lake, the construction of the dam, and the construction of or modification of any

3. That the State Board of Health approval of the Sanitary Sewers be on file with
the Town before any physical connection of the Sanitary Sewers be made to the Key-

Dear Mr. Anderson:
In the interest of conserving some of your time and energies at the Plan Commission
meeting, I am sending you this brief accounting of events to date regarding my ap-
plication for plat approval of:
HIRAM HEIGHTS ADDITION
Following your February 15, 1971 approval of the preliminary plat (subject to Mr.
Hurlock, Hamilton County Surveyor, approving the storm drainage), Mr. Ken Thompson
and I met with the Drainage Commission on March 1, 1971 for one and a half hourse.
It is my understanding following this meeting that:
(1) They are not opposed to the ditch through Mrs. Fisher's farm;
(2) They agree it should relieve Ralph Morgan's objections to Woodland Green;
(3) There are no records to support or to deny the proposed new ditch and the
water therein will be excessive;
(4) They could not approve (or disprove) this proposed new ditch since there is
no application, license or any form of permission required to be signed or
granted by them in order to construct the ditch;
(5) They have no criteria to state or base any specification for "cleaning"
Blue Fork Creek nor the distance or extent of "cleaning desired";
(6) The process of official notice, public hearing and eventual cleaning by a
general assessment approach consumes some two and a half to three and a half
years -- IF and after knowing specifically what has to be done!
(7) No approval or denial could be, or was, given. No solution was offered short
of from - "cleaning" all of Blue Fork Creek to unknown jurisdictional speci-
fications - to - "put in your proposed ditch and see what happens, if any-
thing".
I came away from this meeting at a total loss to know what to do or where to turn
except back to you.

My 9.2 acres amounts to but 7.6% of the total acreage which drains to the proposed
ditch through Mrs. Fisher's farm. The amount of water created by my 7.6% portion
of land as a subdivision in excess of what water has always gone by natural flow
into Blue Fork Creek perhaps cannot even be measured, let alone be said to "break
the camel's back".
Based on these observations of my very small proportionate contribution to the
problem coupled with my continued efforts to comply and willingness to pay my pro-
portionate share in the eventual solution of the problem, I am respectfully re-
questing your favorable consideration of my subdivision plat.

Sometime ago I called you relative to a bond which expires
February 7, 1974 posted by Schutz & Thompson with the Plan Commission
to assure the completion of work cleaning Blue Woods Creek on the
Ralph Morgan property between 116th and 106th east of Haverstick
(Chester) .
You said at that time that you never released a bond without
complete assurance that it had been performed. It has not. Work
stopped a year ago, started again last fall (late) then stopped again
because of winter. Verbal agreements and "understandings" are clear
but the work is not completed. When I called Ken Thompson, he said
Virgil Cullison Excavating had been authorized to "do anything Ralph
Morgan wanted". I know that Ken was held up because of a Dep't. of
Natural Resources order, but that is lifted and when the weather breaks
Cullison can complete the work.
We merely wanted you alerted to make sure the bonding com-
pany is not released and that everyone understands the bond is out-
standing to assure completion. We appreciate your interest and help.

Dear Al:
I have been called by Ralph Morgan about the Blue Woods Creek,
the cleaning of which was to be resumed as soon as weather permitted last
spring. Please refer to your letter to me dated February 5, 1974.
It appears to me that each man involved is building his own dikes
and drains primarily because Ken Thompson has not completed the work
for which he is bonded. Needless to say we do not want the bond released
until Ken completes his commitment. However, this matter could drift
on for years without resolution unless something is done.
I note from a letter received from Mr. Morgan in June 1974
that Mr. Willison merely widened instead of cleaning the ditch. At one
time Ken Thompson advised me to have Ralph Morgan instruct Mr.
Willison what he wanted done and it would be done. Shortly thereafter
Mr. Willison removed his equipment and never returned.
Mr. Robert Clements has filed suit against the Eagle Gravel
Co. American Aggregates is installing its own drain tiles and the matter
is generally confused. There is no progress. Is it possible that you as
Building Commissioner could bring action on the bond to have the work
completed in accordance with the instructions of the County Surveyor,
the County Drainage Board and Fred Hohl? Mr. Morgan and I both
would appreciate some resolution of this quite vexatious problem. It
has already caused considerable damage to crops and we are no nearer
to solving the problem than we were a year ago. Thanks for your help.
