All, except 23 lots meet the minimum lot width requirement of 100 ft. at the building line. These 23 lots are all located on Cul-de-sacs where the corresponding width at the property line should be 70' minimum for a 25 ft set-back and 62 ' minimum for a 30 ft set back. These 23 lots have an average lot area of 22,000 sq. ft. which should allow the building to be satisfactorily set back. The 25 ft. building lines shown in the development should be increased to 30 ft. The proposed surface drainage facilities shown on the plat should satis- factorily control the drainage within the development. The sanitary sewer layout looks satisfactory. The lots bordering on the lake need further clarification as to their bound- aries along the lake front. Furthermore, Myrneth Anderson asked that we confirm that all approvals are obtained before final plat approval. Ralph Morgan, for one, is not going to allow Ken to clean the Blue Wood ditch (at least his privately owned portion of it) until Ken shores up the existing ditch to the nofth along the east line of Woodland Greens Addition. R. 2, Box 344D Carmel, Indiana 46032 Dear Mr. Anderson: In the interest of conserving some of your time and energies at the Plan Commission meeting, I am sending you this brief accounting of events to date regarding my ap- plication for plat approval of: HIRAM HEIGHTS ADDITION Following your February 15, 1971 approval of the preliminary plat (subject to Mr. Hurlock, Hamilton County Surveyor, approving the storm drainage), Mr. Ken Thompson and I met with the Drainage Commission on March 1, 1971 for one and a half hourse. It is my understanding following this meeting that: (1) They are not opposed to the ditch through Mrs. Fisher's farm; (2) They agree it should relieve Ralph Morgan's objections to Woodland Green; (3) There are no records to support or to deny the proposed new ditch and the water therein will be excessive; (4) They could not approve (or disprove) this proposed new ditch since there is no application, license or any form of permission required to be signed or granted by them in order to construct the ditch; (5) They have no criteria to state or base any specification for "cleaning" Blue Fork Creek nor the distance or extent of "cleaning desired"; (6) The process of official notice, public hearing and eventual cleaning by a general assessment approach consumes some two and a half to three and a half years -- IF and after knowing specifically what has to be done! (7) No approval or denial could be, or was, given. No solution was offered short of from - "cleaning" all of Blue Fork Creek to unknown jurisdictional speci- fications - to - "put in your proposed ditch and see what happens, if any- thing". I came away from this meeting at a total loss to know what to do or where to turn except back to you. -2- My 9.2 acres amounts to but 7.6% of the total acreage which drains to the proposed ditch through Mrs. Fisher's farm. The amount of water created by my 7.6% portion of land as a subdivision in excess of what water has always gone by natural flow into Blue Fork Creek perhaps cannot even be measured, let alone be said to "break the camel's back". Based on these observations of my very small proportionate contribution to the problem coupled with my continued efforts to comply and willingness to pay my pro- portionate share in the eventual solution of the problem, I am respectfully re- questing your favorable consideration of my subdivision plat. 7_ s very truly Donald S. INDIANAPOLIS, INDIANA 46204 TELEPHONE 632.7363 January 29, 1974 Mr. Albert Pickett Building Commissioner City Building Carmel, Indiana 46032 Dear Al: Sometime ago I called you relative to a bond which expires February 7, 1974 posted by Schutz & Thompson with the Plan Commission to assure the completion of work cleaning Blue Woods Creek on the Ralph Morgan property between 116th and 106th east of Haverstick (Chester) . You said at that time that you never released a bond without complete assurance that it had been performed. It has not. Work stopped a year ago, started again last fall (late) then stopped again because of winter. Verbal agreements and "understandings" are clear but the work is not completed. When I called Ken Thompson, he said Virgil Cullison Excavating had been authorized to "do anything Ralph Morgan wanted". I know that Ken was held up because of a Dep't. of Natural Resources order, but that is lifted and when the weather breaks Cullison can complete the work. We merely wanted you alerted to make sure the bonding com- pany is not released and that everyone understands the bond is out- standing to assure completion. We appreciate your interest and help. Pickett, Building Commissioner 40 East Main Street Carmel, Indiana 46032 Dear Al: I have been called by Ralph Morgan about the Blue Woods Creek, the cleaning of which was to be resumed as soon as weather permitted last spring. Please refer to your letter to me dated February 5, 1974. It appears to me that each man involved is building his own dikes and drains primarily because Ken Thompson has not completed the work for which he is bonded. Needless to say we do not want the bond released until Ken completes his commitment. However, this matter could drift on for years without resolution unless something is done. I note from a letter received from Mr. Morgan in June 1974 that Mr. Willison merely widened instead of cleaning the ditch. At one time Ken Thompson advised me to have Ralph Morgan instruct Mr. Willison what he wanted done and it would be done. Shortly thereafter Mr. Willison removed his equipment and never returned. Mr. Robert Clements has filed suit against the Eagle Gravel Co. American Aggregates is installing its own drain tiles and the matter is generally confused. There is no progress. Is it possible that you as Building Commissioner could bring action on the bond to have the work completed in accordance with the instructions of the County Surveyor, the County Drainage Board and Fred Hohl? Mr. Morgan and I both would appreciate some resolution of this quite vexatious problem. It has already caused considerable damage to crops and we are no nearer to solving the problem than we were a year ago.
