Permission was not granted to Mr. Ken Thombson, who appeared before the Board at that time, to hook the new drain he is proposing to construct , into the Asa Williamson Legal Drain until such time that said drain is set up for reconstruction and the assessment scnedule is established. The legal drain must be made sufficient to carry the added water from the developments. Section of" The Woodlands" and the rezone application for "Pheasant Run". In my opinion, this profile is not complete and not in conjunc- tion with the preliminary report. I cannot give approval until this profile is accompanied by the following: 1. Tom Schellenberger presented a prelim- inary report of his findings after studying the area and the engineer' s report from Clyde Williams Association. Mr. Thomp- son then explained that he hopes to have the cooperation of all owners to clean their own sections of the -ditch and he will clean the balance at no cost to the county. The Board directed him to present plans and specifications signed by all concerned to the surveyor for approval. New Inland Building November 9, 1971 Room 701 120 East Market St. 61-,,,--- -,•,,,,,A4,_.i Indianapolis, Ind. 46204 14/4_r, - , -- 1_ � On October 19, the Carmel--Clay Plan Commission gave Ken Thompson final approval on the Armin Dawson farm which previously had been held up pending a satisfactory agreement on cleaning, of the Blue Woods Creek and Asa Williamson legal drains. -In my opinion, this approval was not warranted as the conditions as outlined by the Hamilton County _..__-__- ---Drainage Board on-July_6,-1971.,_have..-not-_been met..___A._oopy of the ex- cerpts from this meeting is attached. The Blue Woods Creek drain is badly filledandI would have no ob- jection to cooperating completely if Ken Thompson would do some of the things that he has verbally promised that he would do en the Woodland Green subdivision which has caused flooding of our farm for the past two years. Any agreement with Ken Thompson would have to be down in black and white as he has a habit of not doing anything he promises verbally. I spoke with Harry Hurlock about this and he is disturbed that the Plan Commission did not consult the Drainage Board with any regularity. There is a private ditch section between the Moffitt and Williamson ditches about which harry fIurlock said "Ken Thompson will have to buy this from you." Presently I am not of a mind to let Ken do anything with this until he makes restitution for the damages and corrects the situation in Woodland Green. Harry Hurlock is on vacation for two or three weeks and Roy Davis is disturbed by Thompson's actions and tells me to work it out with Turlock. My questions are, who has the legal authority to see that this drainage is handled properly, what chances are there for me to make Ken Thompson fulfill his agreements? Last week on one of the lots where Ken had, in the southeast corner of Woodland Green, they were, hauling in dirt to fill it up and this means that the water will run further on ourlace without P proper construc- tion of this private ditch. 'til -Roberts, the Hamilton County Drainage Board attorney suggests wri e Thompson that you can't approve the plan and advise him that you will hold him liable for excess water. My first choice would be not to get into a legal hassle. What steps would you recommrend2 Ralph F. Morgan im 6 n September 7, 1971 BLUE WOODS CREEK STORM DRAINAGE (W.C. MOFFITT, ASA WILLIAMSON LEGAL DRAINS) Attention: Mr. Schutz & Mr. Thompson The Hamilton County Drainage Board and the County Surveyor accepts the proposed reconstruction plans of the above named ditch with the following specifications: 1. Ditch right-of-way to be 75 feet each side from top of bank. 2. Clear one side of all underbrush. 3. Leave all large trees possible on top of bank, 4. 2 : 1-Side slopes. 5. Burn and bury all trees, brush, and stumps at least two feet below finished grade. 6. Bury all rocks in excess 4 cubic foot. 7. Banks to be seeded (8 lbs. rye grass, 30 lbs. fes-cue, 600 lbs. 15-15-15/ac) . 8. Dirt excavated from ditch to be spread and leveled to one foot depth maximum. 9. All road culverts, crossings, bridges and pipes must meet Hamilton Co. ,Highway Specifications. 10. All bench marks and descriptions must be shown on plans. 11. Seeding of ditch banks must be completed immediately following construction. 12. No angle of less than 120° shall be constructed in the main channel of the open drain. Following reconstruction; the County Surveyor must inspect the completed project and give his approval prior to acceptance by the Hamilton County Drainage Board.
