Dear David,
Upon review of your submitted materials, I have found the following items will need to

Landscape plan - has been reviewed by Mike Hollibaugh of our office, preliminary
review, indicates the following:
- If this is a cluster, where is the open space? This lack of open space is a serious
design flaw. This plan needs to go back to the drawing board.
- In order to design a more complete buffer, it is recommended that additional
plant material be added to the greenbelt buffer of lots 69 through 73, which back
up to 126th Street.

- The protection/utilization of existing trees on this site appears have been given
little consideration with this proposal. Residential Development Objective #1, in
the 1991 Comprehensive Plan, states that, "wherever possible, natural amenities
such as greenbelts, trees stands, creeks, and drainage courses should be
accessible and visible to the public from public right's-of-way and
roadways...."(p80). Explain how this Objective has been addressed in this
proposal..
- Provide Department with copy of wetland delineation report and approval letters
from Army Corps and IDEM for encroachment or filling of wetlands on this
project site.
p Signage plan - please dimension proposed signage - to confirm compliance with the sign
ordinance - where will the signage be place, at what entrances? Will there internal
directional, phasing or predevelopment signs for this project?

narrow tract owned by American Aggregates, which is already stubbed from the south
from Lake Forest, this will allow for the development of that parcel with a minimum
length cul-de-sac and additional stub to the east and eventually to Hazeldell Road. This
stub could be accomplished with minimum disturbance by moving lots 91, 90 & 89 to the
west and placing the stub across from Windbush Way.

Dear Dave,
Please find enclosed two sets of the Primary Plat for Bayhill & Brookfield at Waterstone
amended per your comment letter dated November 22, 1993. So that you may follow along
more easily, I have numbered each of your remarks (copy attached) and have responded
appropriately.
1. A copy of the Primary Plat was forwarded to Dave Klingensmith of the City Street
Department and to Randy Powell of the City Engineer's Office on November 15,
1993. A copy of each letter is included in the enclosed Application booklet for your
reference.As of this date I have not received from either any comments regarding
the entry or surrounding streets.Also included in the Application booklet is a copy
of a follow up letter to Mr. Klingensmith and Mr. Powell requesting a response.
2. The scale as originally shown on sheet S-1 is correct, 1"=200'.
3. A copy of the covenants and restrictions will be supplied to you by the developer and
will address dusk to dawn lights, maintenance of common areas and fencing.
4. Copies of the Traffic Impact Study, by A & F Engineering is also included in this
package, for your review.
5. A soils map and support material is included within the Application booklet.
6. Included in the Application booklet are support documents required by the
Subdivision Regulations including, a report on utilities, drainage and the
Comprehensive Plan.

7. A copy of the Primary Plat was forwarded to Jim Dougherty of the City Utilities
Office and to Randy Powell of the City Engineer's Office on November 15,
1993. A copy of each letter is included in the enclosed Application booklet for your
reference.As of this date I have not received from either any comments regarding
adequate sewer and water capacity. Also included in the Application booklet is a
copy of a follow up letter to Mr. Dougherty and Mr. Powell requesting a response.
8. Copies of correspondence from TAC members, as of this date, are also included in
the Application booklet.
9. Regarding the Landscape Plan, please note that revised plans have been prepared
by Joanne Samarzija of Salsbery Bros.Landscaping.You will note that with this new
plan the protection & utilization existing trees along the perimeter of the site has
been addressed. With respect to residential development objective #1 in the 1991
Comprehensive Plan please note that all common areas, whether they are ponds,
landscaping, etc.. are accessible either directly or by way of easements to public
right-of-way.
With regard to open space this project,if considered to stand alone,contains roughly
8.0 acres of ponds, common area, etc.. along with 3.3 acres of perimeter landscape
easements totaling 11.3 acres, or 13.8 % of the total project. Our goal however, has
always been to include this project as an extension of the Waterstone Community
as illustrated by our rezone request earlier this year which, you will recall, received
a favorable recommendation from the Plan Commission. So while asserting our
position that this project is an continuation of Waterstone I offer the following data
with regard to open space:

Waterstone 288 ac. 64.8 ac. 22.5 %
Bayhill & Brookfield 81 ac. 11.3 ac. 13.8 %
Total 369 ac. 75.6 ac. 20.5 %
It is our conviction therefore,that the design, proposed open spaces and greenbelts
for Bayhill and Brookfield, together with the existing Waterstone development,
creates abundant expanses of open space.
Regarding the existing wetland area as shown on the National Inventory Map and
located adjacent to 126th Street and West of the proposed 126th entrance, I submit
the subsequent commentary.The dredging and enlarging of this wetland is permitted
under the Nationwide Permit from the Corps of Engineers since 1). it is under one
acre in size, and 2). it is not considered a high quality wetland as identified on the
Inventory Maps.

10. The locations of proposed signage has been added to primary plat. The dimensions
of the signs have been included in the Application booklet.
11. The street names were forwarded to Carmel/Clay Communications and they asked
to have two street names revised. The two street names have been revised and
resubmitted to Carmel/Clay Communications for approval. A copy of
correspondence is included in the Application booklet.
12. A street stub has been added to the South property line.
13. A copy of the Primary Plat was forwarded to Randy Powell of the City Engineer's
Office on November 15, 1993. A copy of the letter is included in the enclosed
Application booklet for your reference. As of this date I have not received any
comments regarding the entrance configuration and street design. Also included in
the Application booklet is a copy of a follow up letter to Mr. Powell requesting a
response.
14. The accel decel lanes have been dimensioned for your review.
15. A copy of the Primary Plat was forwarded to Randy Powell of the City Engineer's
Office, Kent Ward of the Surveyor's Office and John South of the Hamilton County
Soil and Water Conservation Office on November 15, 1993. A copy of the letters are
included in the enclosed Application booklet for your reference. As of this date I
have not received any comments from Mr. Powell or Mr. Ward. Also included in
the Application booklet is a copy of a follow up letter to Mr. Powell and Mr. Ward
requesting a response. A comment letter has been received from John South. A copy
of correspondence with Mr. South is included in Application booklet.
16. A non-access easement has been added along the right-of-way of 126th Street.
17. Sections 6.3.15, 6.3.16, 6.3.17 and 6.3.18 of the Subdivision Control Ordinance are
and will be met in the design of this project.
18. Right-of-ways have been dimensioned on the Primary Plat.
19. Perimeter road improvements, if any, are addressed in the Traffic Impact Study by
A & F Engineering
20. A drainage easement has been added to the back of lot 83.
21. Monuments, markers and benchmark have been added to the Primary Plat.

22. A breakdown of overall acreage and common areas is listed under item 9 of this
letter.The surrounding development densities is included in the Application booklet.
23. The area West of lot 89 has been labeled as common area on the Primary Plat.
24. The greenbelt easement does not continue in front of lots 83 thru 88 and has been
removed.
25. You will find several of the items listed in section 7.1.3 of the cluster ordinance
included in the Application booklet and in the covenants & restrictions, including:
- location & style of building units
- general architectural style
- exterior building materials
- treatment of greenbelts and open spaces
- site landscaping and signage
- maintenance of common areas
A parking plan has been added to the primary plat.
26. Public Notice information will be forwarded to you by Mr. Jim Nelson.
27. A $ 1070.00 application fee will be forwarded to you by Waterstone Land Co., LP.
No variances of the Subdivision Regulations are being sought with this application.
Please note that we have changed the Bayhill portion of the project to Bayhill at
Waterstone, Sections 6 & 7 and that the lot numbers for Bayhill now start with 170.

Dear Mr. Sexton:
Carmel Clay Schools appreciates notification of Bayhill and Brookfield at Waterstone primary
plat application. The school corporation has two areas of concern. In the interest of safety, the
installation of sidewalks should be mandated within the subdivision. In addition, any cul-de-sacs
should be a minimum of 93 feet to accommodate the turning radius of an 84 passenger school
bus.
Information regarding the development of new subdivisions is extremely beneficial, as the school
corporation continually reviews long range plans to accommodate the educational needs of this
growing community. Carmel Clay Schools fully intends to provide a quality educational program
for the patrons of Bayhill and Brookfield at Waterstone.

only locate the soii types with abbreviated soil names.
According to the USDA-SCS inventory of potential wetlands and USDI NWS inventory
maps there is tiie potential of a wetland on this site. Maps may be viewed at the
SCS-SWCD office. Private consultants will make an on-site determination.
It appears from the size of this project a Notice of Intent letter is required to
be filed with Indiana Department of 8u2vironmental
Management.
