Upon review of your submitted materials, I have found the following items will need to be addressed: Su ort ite ublic notice information from the County Auditor's office tatement of Non-opposition to annexation from the developer of the property e atement justifying using the cluster option for this property - pursuant to section 33.11.1 of the cluster ordinance statement from the County Highway Department regarding the impact of the development on the surrounding roadway system and recommended improvements for each adjoining street and entrance point - per section 5.3.5 ✓6ovenants and restrictions for this development per section 5.3.7 - have received a preliminary copy, have following requests; - specific sections on the maintenance and replacement of material in the common areas - non-opposition to annexation section to be added for all lots - restrictions on fencing within the common areas and along roadways ursuant to Carmel\Clay Plan Commission Resolution 021892 a traffic operations anis will need to be prepared and submitted prior to complete review of the project VA statement from Clay Regional Sewer needs to be submitted confirming adequate capacity and conformance with the Master Sewer Plan for the Clay Regional Sewer Di ct - per section 5.3.10 pecial Use approval from the Carmel\Clay Board of Zoning Appeals will need to be obtained prior to the construction of any of the amenity areas (clubhouse, tennis courts, pla eas, driving range, and etc.) Correspondence from the TAC members needs to be submitted upon receipt, as of the date of this letter no correspondence has been received - per section 5.3.3. °Landscape plan - has been reviewed by Mike Hollibaugh of our office, preliminary review, indicates the following: ( What is the scale of the landscape drawings? Please add street names to more easily locate areas of the plans. Also, what type of ground cover is proposed for these areas? - Recommend re-looking at the extensive mounding proposed with this project to assure the design of the mounds blends well with projects topography, and does not create"burial mounds" or future maintenance problems. Strongly recommend shaving down the mounds along Shelbourne in lieu of creating a street scape which is more in character with what currently exists in the general area and especially across the street. - Utilizing different sizes and types of plant materials (i.e. shrubs, small trees) in the common areas and along the roadways, instead of or in association with mounding, can achieve screening and buffering similar to mounds, save money on maintenance and construction costs while providing a more appealing and quality image. - "Ex. Trees to remain where feasible" The protection/utilization of existing trees on this site appears to be a matter of convenience rather than commitment. What criteria has been established and field precautions proposed to give meaning to this statement? -Has consideration been given to planting of evergreen trees at street intersections and drivers vision? A small tree planted today can grow into a safety and/or maintenance problem if the wrong tree is planted in the wrong place. - Provide more full service nodes for all ages, with open space, a small playground, and basketball, and/or tennis court, etc. Research suggests that a good minimum area is around 60,000 square feet in total area, with a width not less than 150'. The existing/proposed common area on sheet S-2, between Autumn Circle and Harbor Ridge Court is a good prototype of what could be established in each "enclave" in the development. ✓Signage plan - please dimension proposed signage area - to confirm compliance with the sign ordinance - will the sign at 96th Street and Shelbourne road entrances, be the only development identification sign? Sign Easements need to be added. Will there inte directional, phasing or predevelopment signs for this project? repare a break down of overall acreage/common area/flood plain/and surrounding developments density be completed and included for the file? (Currently passing blisters have been shown at the entrances, I understand that the entrance off of Shelbourne will align with yours but the current Sub. Regs indicate if Right-of-way is available. Indicate and dimension the 100 yr. floodplain line if any. Specifically this applies to the west and middle street from Annually Downs and stub form the southwest form Greentree Subdivision - A subdivision variance will be required for development as shown - please contact me for options - per sec n 6.3.4. urrently you are proposing a parkway street (Inverness Drive Entrances) - beware that the commission may apply special standards per section 6.3.13 for these types of roads Ole Comprehensive Plan states that " The preservation of existing tree coverage is important", and that, "Areas of major tree cover should primarily remain untouched regardless of intensity of development in which they are located. Additionally, development " should take maximum advantage of the great opportunities offered by the natural conditions and must not be permitted to cause excessive erosion or destruction of major tree cover. C vVhat of 96th Street and Shelbourne Road will be improved with this project and how when will it completed or be guaranteed to be completed? a.- imension the right-of-ways for Shelbourne and 96th Street to confirm compliance with the Comp. Plan - Shelbourne 40' half, 96th - 45' half. IC,fie minimum front yard setback for a cluster development is 22' please adjust the front yard setback in the section along Shelbourne Road - 20' is indicated. Where ever the dimension of lot is less than 50' at the right-of-way or on a curved section of street\cul-de-sac - please indicate the building setback line by dimensions along the 1 lines. ✓A parking plan will need to be submitted per Cluster section 7.1.8 Supportive materials - per Cluster ordinance ection 7.1.3 of the cluster ordinance requires the following items to be submitted to complete the file; - number of and location of all parking spaces - means of adequately maintaining all common areas )vlinimum sideyards will need to be maintained between structures during development- I would strongly recommend that you study the placement of the different footprints on lots to void conflicts with the sideyard setback requirements - stated previously, no parking plan has been submitted, the Department would request that full parking plan that meets section 7.1.8 (especially the 4 bedroom criteria) be prepared and submitted. The above comments will need to be addressed and updated plans need to be submitted no later than November 22, 1993, to assure our office adequate time to review your proposed project. Due to the length of the above comments and approaching deadline for placement of Public Notice per ordinance, I have tenantively scheduled you for a preliminary review of the Primary Plat by TAC at the November 24, 1993 TAC meeting, but at this time, will not be issuing a Docket Number for the December 21, 1993 Plan Commission meeting. Basically, I have been contacted by a Carmel resident living in the West Clay Township adjacent to property owned by the Jackson family. It is my understanding that the Jackson family is selling the property to Rick Davis of Davis Homes and Mr. Davis or the Jacksons, either one or both, have filed a request with the Plan Commission with respect to this property. My first question is to determine what has been filed and secondly, I'd like to determine with respect to the filing, what they have requested and ask for a copy of such information. Lastly, I would like to determine if this has been set for public hearing and if so, be provided with the scheduled date and time. In that it is my client's understanding that this has been set for January, I would ask that you respond at your earliest possible opportunity so that I could determine my client's rights, if any, with respect to the matter. The regraded ditch should show a drainage easement of at least 25' from the top of bank per IC 36-9-27-33(e). 4. The outlet for the existing lake #1 needs to be improved. The plane note that the lake will be lowered four feet. What is the proposal for the outlet pipe? Will a new pipe be installed at at lower elevation? This should be addressed on the construction plans. 5. Per the County Surveyors request, please show the finished floor elevations for the existing houses along Greentree Drive. 6. This letter will summarize the items discussed and the decisions reached in regard to the preparation of a Transportation Impact Study for the proposed Davis Development, L.P. residential community to be known as The Greens. This development is located on property generally surrounding Town Lakes Country Club and Golf Course, in southwestern Hamilton County. The Greens will include approximately 336 homesites which is estimated to generate enough peak hour trips to require a full Transportation Impact Study as described in the Carmel Guide for Transportation Impact Studies. It has been estimated that the full build out of this project will occur approximately 7 to 10 years in the future. Therefore a design year of 10 years for future analyses will be used. Also a 2.5% growth factor per year is to be used in the existing traffic volumes for future analyses. Capacity analyses for the AM and PM peak hours will need to be completed for existing and the future design year at the following intersections: 1. 96th Street at Shelbourne Road 2. 96th Street at Township Line Road 3. 106th Street at Township Line Road 4. 106th Street at Shelbourne Road. This project would incorporate larger size cul-de-sacs, to a 46 .5 ' radius, on Wentwerth Court and Sawgrass Court to facilitate turning movements within those particular streets. As you will note on the plans, Berwind Court and Belfry Court are less than 160 ' in length, while Troon Court, Glen Abbe Court, and Turnberry Court are all less than 320 ' in length ( please note that a length of 600 ' is allowed by ordinance ) . In addition, the cul-de-sac terminus of Inverness Boulevard, Seminole Drive, and Cypress Way are less than 130 ' in length. In each case, sidewalks are provided along both sides of the street as well as around the cul-de-sacs themselves, with ramps for handicapped accessibility. We believe these lengths are not excessive and provide for suit- able service to the future residents. Avenel Court is currently shown with normal radius configu- ration and we would ask for your consideration, as this length is approximately 480 ' . The following comments apply: 1. Per your request to me. I have reviewed our files to determine what was requested and\or required from other developers in the area. My research indicates that the department requested in 1991 that Brenwick Development widen and resurface Shelborne Road as part of the construction of the Ashbrooke subdivision; the developer agreed to the widening to 12' along his frontage but, refusing to resurface, successfully appeared before the Board of Commissioners at their July 1, 1991 meeting to obtain their concurrance on not doing the resurfacing. In 1992, a similar request was made to Estrdige Development at the time approvals were sought for Spring Arbor subdivision. Specifically, Estridge was asked to widen Shelborne Road and to construct a new section of roadway outside of their property limits. The widening was completed; however, the extension of Augusta Drive was not completed as the Plan Commission chose not to enforce our recommendation for a connection. With regards to the passing blister recommendation, I am unable to find anything in the files, and I would assume that Carmel DOCD would have the final say. 1B. Even though I fail to see the widening of Shelborne Road on the plan, your letter indicates that you are in agreement to the widening of the northbound lane of Shelborne Road along your property. 2. The rights-of-way shown are as required. 3. I encourage you to appear before the Board of commissioners for variances being sought for the private drives. I will not recommend any approvals until such time. 4. As you are aware, Davis Development has previously addressed all of our concerns generated during our review of the Primary Plat. It is my understanding that now, however, Davis Development is considering revising the subdivision layout in response to the concerns brought forward by surrounding landowners. These concerns, which among others cite aesthetic and lot density considerations, have led to a significant redesign of the subdivision streets. Specifically, the new plan would propose, for the southern drive (Innisbrook Boulevard), a cul-de-sac terminus, rather than a connection to the other streets in Linkside. The effect of this, of course, would be a heavier traffic demand on Shelborne Road, as the residents in the 66t lots served by Innisbrook Boulevard, as well as school buses and delivery vehicles serving these homes, would need to enter Shelborne Road in order to access the remainder of Linkside, as well as Huntersfield, Annally Downs, and Greentree Subdivisions. As a traffic engineer, and a public official responsible for ensuring that the safety and efficiency of our road system meets its future demands, I strongly oppose such a design. Similarly, the new design of the north drive is faulty, as the geometry of the new layout violates the County's minimum offset between intersections. Our office will oppose any request to the County Commissioners for a variance to the County ordinance, when a viable alternative exists. As shown, motorists waiting to turn left out of the subdivision could stack across the intersection, resulting in a very inefficient subdivision entrance. I realize that, the Plan Commission must base its recommendations for a project on numerous considerations; however, I cannot justify giving more importance to an issue at the expense of the safety of our public. Therefore, we ask that if Davis Development has met all other necessary requirements for plat approval, your concurrence be given to the original subdivision layout we have approved. The following comments apply: Adjacent Roadway Improvements 1. Davie will widen the northbound lane of Shelborne Road to 12' , as measured from the centerline, plus a 3• stone shoulder, along the entire front of the Linkside Subdivision. 2. Following suit with what the Hunterefield Project has committed to do, we have asked that Davis resurface Shelborne Road using a typical section consisting of 500 ton/mile wedge and level course, and 2" of binder, plus 3' stone shoulders on both sides from 96th Street to your north property line. The County will then fund a contract to apply a surface coat from 96th Street to 106th Street. 3. Davie will fund improvements to the intersection of 96th Street and Shelborne Road as outlined in Linkeide's Traffic Impact Study and revised per my earlier comments, provided the right-of-way exists or can be acquired by the County. Note that I am currently researching what the existing rights-of-way are; in order not to hold up the Primary Plat approval process, I suggest that, as Davis has committed to completing improvements to the intersection, the plans of the improvements be finalized during the Construction Plan approval phase. Primary Plat Review 1. The three (3) "eyebrows" proposed on Lake Drive, Inverness Boulevard, and Colonial Drive do not conform to our horizontal curve radius requirements and therefore cannot be public roads. Sheet P-2 (the second half of the site) does not show horizontal curve data. It needs to be verified that the following minimum criteria is met: A. Horizontal curve radii must exceed 150'. S. A 50' tangent is required between reverse curves. 3. A 10' exclusive D. & U. easement is required adjacent to the 96th Street right-of-way. Also, the entrance's decel is to consist of a 150' storage lane and 100' taper. 4. The following comments are to be addressed in the Construction Plan: A. Sidewalks are to be 6" thick, if they are to be used as part of driveways. B. The passing blister's "accel" is to tie into the existing decel lane such that weaving does not occur. C. The decal and accel lanes are to provide 24' of clear roadway, as measured from the centerline, not from the section line. D. As you are aware, Davis Development has previously addressed all of our concerns generated during our review of the Primary ?lat. It is my understanding that now, however, Davis Development is considering revising the subdivision layout in response to the concerns brought forward by surrounding landowners. These concerns, which among others cite aesthetic and lot density considerations, have led to a significant redesign of the subdivision streets. Specifically, the new plan would propose, for the scuthern drive (Innisbrook Boulevard) , a cul-de-sac terminus, rather than a connection to the other streets in Linkside. The effect of this, of course, would be a heavier traffic demand on Shelborne Road, as the residents in the 66t lots served by Innisbrook Boulevard, as well as school buses and delivery vehicles serving these homes, would need to enter Shelborne Road in order to access the remainder of :.irkside, as well as Huntersfield, Annally Downs, and Greentree Subdivisions. As a traffic engineer, and a public official responsible for ensuring that the safety and efficiency of our road system meets its future demands, I strongly oppose such a design. Similarly, the new design of the north drive is faulty, as the geometry of the new layout violates the County's minimum offset between intersections. our office will oppose any request to the County Commissioners for a variance to the County ordinance, when a viable alternative exists. As showy., motorists waiting to turn left out of the subdivision could stack across the intersection, resulting in a very inefficient subdivision entrance. I realize that, the Plan Commission must base its recommendations for a project on numerous considerations: however, I cannot justify giving more importance to an issue at the expense of the safety of our public. Therefore, we ask that if Davis Development has net all other necessary requirements for plat approval, your concurrence be given to the original subdivision layout we have approved.
