HomeMy WebLinkAboutFindings of Fact Subdivision Committee 10-04-88 Subdivision Committee Minutes October 4, 1988 Members Present: Dick Albright, Henrietta Lamb, Sandra Long, Alan Potasnik Staff Present: Dave Cunningham Item 1: LAKE FOREST PRIMARY PLAT, (Cluster Option) Docket No. 90-88 P.P. Petitioners Present: Jim Nelson, Mark Boyce, Jack Southerland Petitioner presented the Primary Plat for the Subdivision - This plat includes 158 lots on 70.3 acres of land - (Cluster Option). Petitioner stated all improvements required by Ordinance would he in- stalled with additional improvements to 116th full length accel-decel lanes and passing blisters. In addition, petitioner and American Ag- gregates have agreed to construct at 40' landscaping buffer/berm be- tween their eastern property lines and a commitment that a 60% lot coverage for individual lots would be enforced. Committee questioned the required two points of access on 116th St, surrounding land uses (aggregate mining) in relationship to single family residential, OVERALL SAFETY ASPECTS of this development, and a more current traffic study for the area. Citizens of the area questioned the development in relationship to others in this area in terms of density. Petitioner responded to both committee and citizen's questions in respect to SAFETY, 116th St. , surrounding uses, and density. Motion: To approve this item as presented with the additional left turn lane to be installed pursuant to traffic study. Motion by Sandra Long. Second: Henrietta Lamb Action: Denied 4-0 Reasons: The reasons that the Committee denied this item are listed below: 1. Traffic 2. Public Health, Safety, Welfare 3. Surrounding Land uses. 4. 2 points of access on 116th St. 5. Does not meet purpose and intent of the Ordinance. Item 2: Laurelwood Primary Plat, Docket No. 91-88 P.P. A Primary Plat application for Laurelwood Subdivision. This plat includes 63 lots on 128.48 acres of land located on the south side of 106th st. approximately 1/4 mile east of Ditch Rd. , Clay Township, Hamilton County, IN. Site is zoned S-1, single family residential. Petitioner requests variances per the plat sub- mitted from the following sections of the Carmel Subdivision Regulations. 1. S.0 Sec. 8.9 sidewalks - sidewalks shall be mandatory for all subdivisions. 2. S.0 Sec. 6.3.6 streets to be 30' wide back to back. 3. S.0 Sec. 6.3.2.0-private streets are not to be platted. 4. S.0 Sec. 6.3.2.1 - A. Subdivision of 15 lots or more shall have at least (2) points of access. B. Streets shall be extended to adjacent tracts of land per Plan Commission. Filed by Mr. Robert J. Klein for KEL Investments Inc. Petitioners Present: Robert J. Klein, Bruce Hagen, E. Davis Coots. Petitioner presented the Primary Plat to the Committee consisting of 63 lots on 128.5 acres located at 106th St.j , approximately 1/4 mile east of Ditch Rd. Site is zoned S-1. 1. Drainage has been approved by County Drainage Board, to be a private drainage system - not to be regulated - covenants to reflect this. 2. Petitioner to retain one lot on the west property line to leave an open way of access to the west for 5-6 years. This was committed to by the Developer. 3. Alternative path system to be incorporated in front of the subdivision for public access along 106th St. 4. 106th St. improvements petitioner to install accel-decel per Ordinance - no additional improvements to be done. Plans show full improvements??? 5. Lot 7 and 8 to be combined to meet Ordinance - petitioner committed to do this. Committee questioned the second access point for fire and police protection (refer to Sheriff's letter). Petitioner committed to hold a lot on west property line for future access to the west. Motion: To approve petition as presented including 5 (five) points above being agreed to by Petitioner with covenants. Second: Sandra Long Action: Non decision 2-2. Reasons: Reasons for negative votes. 1. Second access point 2. Problem with number and type of variances. 2 • Item 3: Barretwoods Secondary Plat Petitioners Present: None Item withdrawn by Petitioner. Letter dated September 27, 1988. Item 4: Cluster Housing Ordinance Staff presented the latest revision of the Cluster Ordinance. Com- mittee reviewed and made comments to this proposal. Staff to have further revised copies on file by October 18, 1988. 3
