The building will be of grey, split faced concrete block with a 16 inch
red brick stripe around the building.
There will be two (2) signs on the building, one on the south and one on
the west. The signage will be white and internally illuminated.
The mechanical equipment on the roof will be screened.
The petitioner will own the building and the land.
Mrs. Badger moved to suspend the rules and act tonight.

li. Commission to consider Docket No. 84-87 ADLS, Paint approval request
for Speedway Service Station located at 1302 N. Range Line Rd.
Petitioner seeks approval for change in exterior painting of building
from existing brown tones to proposed grey tones. Project is located
in U. S. 31 Overlay Zone. Property is zoned B-3.
Filed by Gene West for Speedway Service Station.
The petitioner was not present and Mrs. Badger moved to table.
Seconded by Mr. Davis.
Motion carried unanimously.
2i. Commission to consider Docket No. 85-87 ADLS, Change in site plan.
Petitioner requests the addition of a 32 space paved and curbed park-
ing iot in Block Three (3) north of building one (1) in Carmel Science
and Technology Park located at the S.E. corner of Guilford Rd. and
Carmel Dr. Site is zoned M-3 and a preliminary and final development
plan has been approved previously by the Plan Commission for this site.
Filed by Carter Jackson.
Mr. Jackson made the presentation for a change in the site plan to allow
for the addition of a paved, 32 space curbed parking lot.
The site plan was shown.
The reason for the request is that they feel they may need this reserve
parking area.
There is a possible set back change and Mr. Kiphart will examine this and
determine if a variance is needed from the BZA.
Mr. Kiphart will report on this question of a variance at the Committee
meeting on October 6, 1987.
This item was referred to the Industrial and Commercial Committee for
review on October 6, 1987 at the City Meeting Hall.
Mr. Albright related that some items in the Rules and Procedure are going
to be reviewed and changed and asked for suggestions and comments from Com-
mission members. There will be a meeting at 7: 30 P.M. , September 29, 1987 at
the City Meeting Hall Lo study these matters.
There being no further business to come before the Commission, the meeting
adjourned.

property before any more projects that will have an effect on this
area are submitted for review. Mr. Sutherland said this is being done.
o Detailed traffic study is being done now with State Highway on 103rd
Street and Meridian St. intersection.
o Marriott will cooperate with Browning Investments and State highway
on needed improvements to 103rd St. and Meridian St, including need
and timing of signal.
o Kent Ward, County Surveyor, needs to review and approve detailed
drainage plans by September 15, 1987.
o Jim Hufford, County Engineer, needs to review and approve 103rd St.

o Need for perimeter drainage easements to be determined by Kent Ward

The regular meeting of the Carmel Plan Commission was called to order by
the vice i:resident, Jeff Davis, at 7: 30 P.M. , August 18, 1987 at the City
Meeting Hall. The meeting opened with the Pledge of Allegiance.
Roll was called and members present were: Jeff Davis, Sue McMullen (arriv-
ed 8:45) , Paul Ayers (arrived 8: 15) , Minnie Doane , Bob Boone , Ila Badger, Jim
O 'Neal, Sr. , Vaughn Story, Henrietta Lamb and Jim Schneider. Absent were:
Richard Albright, Sandra Long and Max Moore.
Staff members in attendance were: Chuck Kiphart, David Cunningham, Gordon
Byers and Rosalind McCart.
There were no additions or corrections to the minutes of the July 27 , 1987
meeting and Mr. Story moved that they be approved as submitted.
Seconded by Mr. O'Neal.
Motion carried.
Mr. Davis, read a letter from Mrs. McCart, secretary of the Plan Commission
and Board of Zoning Appeals, announcing her resignation effective October 1,
1987.
G. Public Hearings
lg. 7: 30 P.M. , Public Hearing on Docket No. 68-87 P.V. , Plat Vacation re-
quest for a portion of College Park Subdivision, located east of Penn-
sylvania St. , west of College , south of I-465 and north of 96th St.
Petitioner requests the vacation of 316 lots of the 656 original
platted lots. Site is zoned S-2 and is located in Clay Twp.
Filed by Phillip Nicely, Attorney for Duke Realty Corp.
The public hearing opened at 7: 35 with Mr. Nicely making the presentation
for plat vacation.
An aerial photo was shown to point out location of the approximately 65
acres involved.
This area was platted in 1922 for single family residential on very small
lots.
The plat as it was originally intended was shown. It has been undeveloped
since 1922.
The interstate 465 now bisects the plat and it is in transitional area F,
Commercial Land Use, in the Carmel-Clay Comprehensive Plan.
All but 8 lots south of I-465 have been purchased by Duke with the idea of
vacating and later to rezone the land according to the Comprehensive Plan.
With the 8 lot exception, all lots were owned by the same person (a trust-
ee) and were acquired within the last six months and were not purchased with
the idea of single family residences on the lots.
Access to those lots was presented and the road plan for access was shown.
The petitioner is not requesting any vacation of the Clara Knotts Drain
that runs through the property.
Frank Marcella, 9507 Washington Blvd. , College Park, said he lives on one
of these lots on the south and related that there are some residences in that
area now.
Audrey Grossman, 9506 Washington Blvd. (on the south) stated that they are
not opposed to the plat vacation but that they are opposed to the rezoning in
the fashion that Mr. Nicely has indicated for that area. Mrs. Grossman said
there is nothing there to preclude residential use here and that this will
have an enormous impact on their property values. Mrs. Grossman stated that
commercial use is not the only possible development here and does not want
residential development precluded.
Mary Ann Glancy, 324 E. 96th St. , stated that no one has built a house
back there because it is low and drainage is bad. Mrs. Glancy said she feels
office buildings there are appropriate and related that much of the land has
been used as a dump by Marion County residents.
Ed Trumpy, 9221 N. Delaware , stated that water is one of their main con-
cerns and wants to see the area there residential. Mr. Trumpy said traffic
is also a concern and he feels commercial development would be out of line
with the neighborhood.

The regular meeting of the Carmel Plan Commission was called to order by
the president, Richard Albright, at 7: 32 P.M. September 15, 1987 at the City
Meeting Hall. The meeting opened with the Pledge of Allegiance.
Roll was called and members were present as follows: Richard Albright,
Henrietta Lamb, Max Moore , Jim Schneider, Sue McMullen, Bob Boone , Minnie

Mr. Nelson explained, stating that many concerns of the neighbors have

2h. Commission to consider Docket No. 68-87 P. V. , Plat Vacation request
for a portion of Subdivision, located east of Pennsylvania St. , west
of College , south of I-465 and north of 96th St. Petitioner requests
the vacation of 316 lots of the 656 original platted lots. Site is
zoned S-2 and is located in Clay Twp.

Mr. Boone requested to abstain from voting on this matter.
Mrs. Badger gave the Land Use Committee report (which is a part of the
official minutes and attached to the master copy) . The committee recommended
approval contingent upon the legal opinion obtained by Commission attorney,
Gordon Byers, on the legality of vacation of a plat.
Mr. Byers advised that the law is clear cut, Indiana Code 367311, and the
Commission can vacate this plat if in fact the Commission makes certain
statutory findings. Before the Commission can approve or deny the petition
it must find: 1) that the conditions in the plat have changed so as to defeat
the original purpose of the plat, 2) that it' s in the public interest to
vacate all or part of the plat and 3) that the value of the part of the land
in the plat not owned by the petitioner will not be diminished by vacation.
Commission members must make written findings to support a negative vote.
Plat vacation removes covenants, easements and streets, but does not re-
move the underlying zoning.
Mr. Albright noted for the record all correspondence received from the
public , for or against this petition, and all letters are a part of the
official minutes and attached to the master copy.
Mr. Greg Silver, attorney in remonstrance representing Century Mortgage Co.
of MO. , requested to address the Commission.
Mr. Ayers moved to allow Mr. Silver to speak.

Motion carried.
Mr. Silver made a presentation in opposition stating that it is illegal
under Indiana Law to vacate this plat and that it will leave his client with
8 lots in a vacated plat. Mr. Silver stated that conditions have not changed
in the area to justify vacating and that this land can be used as residential.
Mr. Silver said the petitioner is taking for a private purpose without compen-
sation to a private owner. Mr. Silver said this is unconstitutional and will
be taken to the courts if this plat vacation is approved. Court cases were
cited by Mr. Silver. Mr. Silver asked Mr. Nicely to withdraw his petition.
Mr. Nicely, representing Duke Realty Corp. , made responding remarks. The
plat was shown and Mr. Nicely stated that the request is based on Indiana
Code 367311, based on findings of fact.
Mr. Nicely stated that conditions have changed in the last 65 years in the
area and the land cannot be developed as currently platted. I-465 bisects
this land. It lies in transitional area F of the Comprehensive Plan for
Carmel-Clay which is commercial development.
Mr. Nicely said that it is in the public interest to vacate this plat as,
if it were to be developed as presently platted, it would be an inferior
development and would be inconsistent with the Comprehensive Plan. Mr.
Nicely said it needs to be appropriately developed and the only way to do it
is to vacate the plat.
An appraisal letter from J,. irthitaker of the F.C. Tucker Co. was presented by
Mr. Nicely for the record. This letter related that the value of these lots,

as isolated lots, is zero for residential use now and would only be enhanced
by this development by Duke.
Mr. Nicely requested approval of this petition to vacate the plat around
the 8 parcels.
Mr. Byers informed regarding the findings of fact and voting by Commission
members, stating that if voting NO, the reason must be stated in writing.
Mrs. Badger offered a revised motion as follows: "Because I-465 and U.S.
31 (Meridian St. ) have changed the surrounding land uses and have disturbed
and divided this once quiet platted subdivision; because the present plat
does not meet the standards of the current zoning ordinance; because the land
not owned by Duke will not be diminished in value; because no development has
taken place in 65 years as this land is now platted and because the under-
lying zoning remains in place for protection, this committee feels a vacation
of this plat is appropriate and that attorney, Phil Nicely, has addressed and
proven in a positive manner the three criteria as set forth in the Indiana
State Statutes, and I so move. "
Seconded by Mr. Moore.
Motion carried unanimously in favor of this revised motion.
The Commission is only voting this evening on the Plat Vacation request.
Findings of fact were completed by Commission members.
The vote was 10 FOR, 0 AGAINST and 1 ABSTAINING (Mr. Boone) .
Motion carried to vacate the plat.

Mr. McDermott made the presentation for the roof top antenna location to
be used by Texas Instruments.
The antenna will be 30 ft. from the east parapet wall, 90 ft. from the
north parapet wall and will be 6 ft, 3 in. in height.
The weight of the antenna is 135 lbs. and the antenna will be painted the
same color as the mechanical units.
The antenna will be screened from view except for exposure on the south
east.
Photos were presented showing the antenna location.
This item will need a variance from the Board of Zoning Appeals.

There will be a curbed parking lot with 673 parking spaces.
There will be 100, 000 sq. ft. in the building and 4, 000 sq. ft. in the
tire center (total of 104,000 sq. ft. ) .
Additional landscaping has been added including mounding.
There will be 4 loading spaces on the east end of the building.
