MEETING MINUTES
Date: Wednesday, July 19, 2017

The applicant seeks the following Use Variance & Development Standards Variance approvals for a
Meeting/Party Hall with multiple buildings, on 70 acres of land:
Docket No. 17040002 UV ZO Chptr 5.01.01 Permitted Uses in S-1 Zoning District.
Docket No. 17040003 V ZO Chptr 27.03 No parking lot curbing
Docket No. 17040004 V ZO Chptr 33.05.E No parking lot interior plantings

Docket No. 17040006 V ZO Chptr 2.09 Reduced right-of-way dedication along 116th St.
The site is located at 1143 W. 116th Street. The site is zoned S-1/Residence and partially lies within
the West 116th Street Overlay Zone and the Floodplain Zone. Filed by Timothy Ochs of Ice Miller
LLP, on behalf of The Lucas Living Trust.
Tim Ochs with Ice Miller presented the project. Mr. Ochs said he has been meeting with the
neighbors in the area and has assured them there will be no improvements to the property that will be
used for any special events. He added that petitions like this are often a precursor to new construction
to new construction or increased operations. Mr. Ochs said there is a desire to have the entire site
served by water and sewer.
Brett Ransford – City of Carmel Utilites Department
- Mr. Ransford said the water easement runs on the west side of the property. He added that as
long as it is maintained at all times and there is, for example, no parking on this, the department
would be fine with the design. Mr. Ochs said one commitment will be for events of a certain size,
such as more than 25 people, there would be mandatory valet parking to allow for control of
parking locations.
David Littlejohn – City of Carmel Alternative Transportation
- Comment letter sent. Mr. Littlejohn said the letter contained comments on the right-of-way
dedication, the requirement for a 10-foot multi-use path along both right-of-ways, and bicycle
parking.
Daren Mindham – City of Carmel Urban Forestry
- Mr. Mindham indicated there are variances for the perimeter buffer yard, but he has no further
comments.
Ryan Hartman – Clay Township Regional Waste District
- Mr. Hartman said he does not have comments on the variance, however, the Department has had
discussions regarding connecting to sanitary sewers due to the commercial kitchen being
proposed. Mr. Hartman said once this design is complete, the Department will need to review to
make sure it is in compliance.

Angie Conn – City of Carmel Planning & Zoning
- Ms. Conn said at a recent meeting, someone mentioned there was a recent remodel at this
location. Ms. Conn asked if a building permit was pulled for this construction. Mr. Ochs said
after the meeting, he asked the person who said this to ask their general contractor to provide a
copy of the state release and permit. Mr. Ochs added that he will provide this information when it
is available.
9:20 a.m. Docket No. 17060012 DP/ADLS: World Wide Motors
The applicant seeks site plan and design approval for the expansion of the World Wide Motors car
dealership and service center, which includes the demolition of the previous Smart (Car) Center of
Indianapolis building. The expanded building will be 68,443 sq. ft. on about 6.8 acres. The site is
located at 3900 East 96th Street and is zoned B-3/Business. It is not located within any overlay zone.
Filed by Jim Shinaver and Jon Dobosiewicz of Nelson & Frankenberger, on behalf of the owner, Paul
Pettenaro of World Wide Motors.
Jon Dobosiewicz with Nelson & Frankenberger, Greg and Paul Pettenaro with Worldwide Motors,
and Chad Wilson with Versatile Construction presented the project. Mr. Dobosiewicz said this
project will include demolition of the existing Smart Car building at 4000 E. 96th St.
Brett Ransford – City of Carmel Utilites Department
- Mr. Ransford said prior to the building being demolished, the developers will need to make sure
the water service is disconnected at the main. He added that where the 6-inch tap is connected, the
Department would like to see a fire hydrant installed.
David Littlejohn – City of Carmel Alternative Transportation
- Comment letter sent. Mr. Littlejohn said a multi-use path is required on 96th Street and
Lakeshore Drive. Mr. Dobosiewicz said if there are issues with the alternative plans that were
proposed, the Petitioners may withdraw the request for variance. Mr. Littlejohn said the
Department will work with Engineering to make sure everyone is on the same page. He added that
another option would be to provide a monetary commitment to the City.
Daren Mindham – City of Carmel Urban Forestry
- Mr. Mindham said he does not have specific comments. He added that the Department has noted
comments on the variance for the buffer yard along 96th Street. Mr. Dobosiewicz said he will get
back with Mr. Mindham prior to making the submittal to Plan Commission. Mr. Mindham said if

there will be fire hydrants added, there may need to be adjustments to shade trees as well. Mr.
Dobosiewicz said the Department has also asked him to identify landscaping around yard signs, so
these details will be added.

- This project falls outside CTRWD service territory.
Angie Conn – City of Carmel Planning & Zoning
- Ms. Conn said she will work with the developers on the BZA variances but she added that it
would be after the follow-up meeting between Ms. Keesling and staff in order to narrow down
which variances will be required. Mr. Dobosiewicz said regarding signage, the contractor is ready
to make revisions such as adjustments in the directional signage to meet the ordinance as well as
wall signage and the combination of ground signs.
Jason Stewart – City of Carmel Utilities Department
- Mr. Stewart said for the demolition, if the sewer is capped, someone will need to let him know so
it can be inspected. Mr. Wilson said there is a manhole along Lakeshore Drive with an 8-inch line
and asked how this should be capped. Mr. Stewart said if it is a permanent cap it needs to be in
concrete. Mr. Stewart also said

- Mr. Mishler said this will need a permit for the demolition and one for the new building. Also,
the new building will require a state release.
Rachel Keesling – City of Carmel Planning & Zoning
- Comments sent. Ms. Keesling said a variance will be required for lot coverage, and asked if
there is a way to add green space to the parking lot. Mr. Dobosiewicz said one option would be to
adjust the islands in the front to place the landscaping next to pedestrian access. Ms. Keesling
asked if the building height would have to be 36 feet in order to screen the HVAC units on the
roof. Mr. Wilson said this height was formerly 34 feet, 2 inches, but was raised to 36 feet to shield
the HVAC units. Mr. Dobosiewicz said from an aesthetics standpoint, the developers would prefer
a 36-foot building height rather than a shorter height with screening around each HVAC unit. Ms.
Keesling said the Department would prefer this as well. Ms. Keesling asked for material samples
since these are difficult to differentiate on digital renderings.
Ms. Keesling said she will also need a plan showing where the signage will be located. She added
that the Department likes the design but they will just need to make sure they comply with the
allowed size and dimensions. Mr. Dobosiewicz said the sign designers will need to get the proper
dimensions for the signage so they can design it to the correct standards. Mr. Wilson asked if the
Department would have any objection to using chain link and slats for the gates on the property.
Ms. Keesling said she believes this would be acceptable as long as it blends in with the building.
Mr. Wilson said the material being used will be the same as the material on the building.
Regarding the landscaping screening of the transformer, Mr. Wilson said the side which will be
open for access will be the side closest to the building, which is what the power company has
requested.
