UNOFFICIAL MINUTES
The regularly scheduled meeting of the Carmel/Clay Plan Commission was called to
order by the President at approximately 7:00 PM in the Council Chambers of City Hall,
One Civic Square, Cannel, Indiana on June 16, 1998.
Members present were: Jay Dorman;Madeline Fitzgerald; Dick Klar,Norma Meighen;
Bob Modisett; James T. O'Neal, Sr.; Pat Rice; Rick Sharp; Luci Snyder, Paul Spranger;
Chris White; and Tom Yedlick.
Steve Engelking, Director,Michael Hollibaugh; Terry Jones; and Mark Monroe were in
attendance representing the Department of Community Services.
The minutes of the previous meeting were approved as submitted.
Report on the status of the Residential Open Space Ordinance.
Michael Hollibaugh reported that three developers had completed sketch plans as
requested by the Department that comply with the Residential Open Space Ordinance
Proposal. The sketch plans were received today and the Department requested that
presentation be delayed until such time as the Department has had an opportunity to
review the application of the Residential Open Space Ordinance.
John Molitor, Counsel, reported that he had attempted to contact representatives of the
NAACP; no response has been received as yet. Paul Spranger requested that a letter be
drafted to the NAACP requesting that review be completed within 30 to 60 days.
Michael Hollibaugh commented that a full report on the proposed Ordinance would be
ready for presentation at the July meeting.
Madeline Fitzgerald asked that the Task Force be involved in the review of the proposed
Ordinance and be issued an invitation to attend the formal presentation.
Report on the Village of WestClay, Special Study Chairman.
Rick Sharp reported that the majority of the issues on the Village of West-Clay had been
explored; however, there are still a few open items—one is the status of the development
guidelines listed currently in the ordinance as guidelines only and not requirements.
Another issue is density. Specifically the petitioner has been requested to limit the
maximum density within the body of the Ordinance to that which is shown in their land
use plan. The Committee will meet again on July 7`h and members of the Commission
are encouraged to attend. The Committee is hoping to take a vote to refer this item to the
full Commission at its July meeting.

Rick Sharp also reported that he had met with INDOT today regarding U.S. 421, the
purpose of which was to explore two issues. 1) The current design plan for the
improvements to 421 is for a flush median(painted lines). There were concerns from a
safety standpoint and an aesthetic standpoint. INDOT is amenable to modifying their
design to include a 4 inch high median with brick pavers and some type of landscaping
such as grass or low shrubs, and limiting access. INDOT would like feedback from the
Commission regarding placement of median cuts and comments from the public.
Paul Spranger reported that he as well as members of the Department had met with
representatives of INDOT regarding U.S. 31 as it pertains to the split at U.S. 431. The
purpose of the meeting was to brief INDOT as to current and proposed development
within the Township.
Jay Dorman suggested that the Department invite people in and hold a workshop on how
to get started on these kinds of efforts.
H. Public Hearing:
lh. Commission to consider Docket No. 40-98 O.A., an Ordinance Amendment
application to refine some of the development standards of Section 23C.0 of the
Carmel/Clay Zoning Ordinance regarding the U.S. Highway 421 - Michigan Road
Overlay Zone District.
Filed by the Plan Commission and the Department of Community Services.
Rick Sharp, 1309 Thornbird Lane, Carmel appeared before the Commission to present
the changes in language to the U.S. Highway 421 Overlay Zone Amendment. The
changes were instigated by landowners along 421 who sought clarification of the
language. There was detail requested as to stacking lanes, and the language has been
reviewed and approved by those persons who previously voiced objection.
Members of the public were invited to speak in favor or opposition to the proposed
Ordinance Amendment; none appeared and the public hearing was closed.
Jim O'Neal was complimentary of Rick Sharp and the Committee's efforts.
Jim O'Neal moved for suspension of the rules, seconded by Dick Klar, UNANIMOUSLY
APPROVIED.
Dick Klar moved for the approval of Docket No. 40-98 O.A., an Ordinance Amendment
regarding the U.S. Highway 421 - Michigan Road Overlay Zone District.
APPROVED 12-0.
I. Old Business:
Commission to consider Docket No. 22-98 D.P., an Economic Hardship
Exception for Coots, Henke and Wheeler Real Estate. TABLED

Paul Spranger read into the record a letter dated June 16, 1998 from Steve Henke of
Coots, Henke& Wheeler referring to a letter from Cristine M. Klika of INDOT, a copy
of which is attached. The petitioner has stated that it would not be in his best interest to
present his petition at this time; based upon the State's position and the City's position,
the petitioner is consenting to the tabling of this item until the next regularly scheduled
meeting.
J. New Business:
1j. Commission to consider Docket No. 43-98 ADLS Amend., an amended
Architectural Design, Landscaping, Lighting, and Signage application for Windsor
Court. Petitioner seeks approval to construct a wall sign. The site is located at 11610
Technology Drive within the Meridian Technology Center(northwest of 116th Street and
College Avenue.) The site is zoned B-6/Business.
Filed by Christine Wright of Windsor Court.
Pam Trumbauer and Christine Wright appeared before the Commission requesting
approval for the construction of a wall sign at Windsor Court, a 54 unit assisted living
facility.
The lettering will be 15 inches tall, 3 inches deep, dark bronze acrylic enamel. The sign
will be backlit, similar to the Merchants Bank Building.
Mark Monroe reported that the Board of Zoning Appeals had approved a variance to
allow the additional wall sign on the building; its character is consistent with other wall
signs located in the center and the Department is recommending approval.
Dick Klar moved for the approval of Docket No. 43-98 ADLS Amend., an amended
Architectural Design, Landscaping, Lighting, and Signage application for Windsor
Court. APPROVED 12-0.
2j. Commission to consider Docket No. 44-98 ADLS, an Architectural Design,
Landscaping, Lighting, and Signage application for the Linder Company. Petitioner
seeks approval to construct a 6,500 square foot retail building on 2.5 acres for
Blockbuster Video. The site is zoned B-8/Business.
Filed by Jim Nelson of Nelson and Frankenberger.
Jim Nelson appeared before the Commission representing the Linder Company. Craig
Hessee of the Linder Company was also in attendance.
An aerial photograph of the retail center was displayed showing the specific location of
the proposed Blockbuster Video store at the northeast corner of AAA Way and 116th
Street. The new Blockbuster store will replace the National City Bank Building. Access
to the site will be by a single curb cut from the southern Ring Road, and shared by
Blockbuster and National City Bank.

The improvements include the signalization at the intersection of AAA Way and 116th
Street, and the installation of a sidewalk adjacent to 116th Street. The proposed building
is single story, 6,500 square feet and of an architectural style in keeping with the existing
buildings in Merchants Square. The building materials are red brick, stucco, glass, and
the blue awning accent. The east elevation will contain a wall sign identifying
Blockbuster in three foot, individually mounted, internally illuminated letters, white in
color.
The west elevation will also have a wall sign. This particular parcel has three road
frontages and is therefore entitled to three signs under the Ordinance. Two wall signs and
one ground sign is proposed.
The type of lighting proposed within the parking area will be four pole-mounted fixtures,
the same type that are used within the shopping center. A single ground sign is proposed
at the corner with a brick base identifying Blockbuster Video with the Merchants Square
logo on the top.
The Department reported no outstanding TAC concerns and recommended approval.
Craig Hessee made some comments relative to the proposed signage; the curb cut is
believed to be wide enough to handle the traffic; (the curb cut is being revisited by the
Board of Public Works); the night drop is at the front of the building, and the trash
receptacle will be screened. Jay Dorman asked that the exterior lighting be a level that is
agreeable with the neighboring residents. Paul Spranger asked that the windows be tinted
to decrease the glare from the inside of the building.
The main entrance to the building is on the east side and faces the new National City
Bank Building. The parking is near the entrance. The area to the west of the building
between the building and AAA Way, and the south elevation between the building and
116th Street will be open and landscaped, and will not contain parking.
Rick Sharp moved for the approval of Docket No. 44-98 ADLS,Blockbuster Video.
APPROVED 12-0.
There being no further business to come before the Commission, the meeting was
adjourned at 7:55 PM.

Proposed Comfort Inn Near SR 431
Dear Mr. Sprenger:
Thank you f or the Cannel Clay Plan Commission's May 19 action to deity your decision regarding the
proposed Comfort Inn development just south of the US 31 t SR.431 interchange that would be situated in
the location of the off ramp from northbound US 31 to 146th Street/ 151st Street. The Indiana Department
of Transponattian(Q1DOT)geatly appreciates this action and realizes that this was a one-month delay until

the near Pian Commission meeting.
Per your recittest in your May 20 tester,1NDOT has been in communication with property owner Mr.E.
Davis Coon;of Coots,Henke,and Wheeler Attorneys at Law regarding their 6.3 acre property,of which
approximately 0 acres is intended for the proposed Comfort Inn. FNDOT has started negotianons with the
property owner regarding the entire 6.8 acres. The property owner has expressed interest in selling the
entire 6.8 acres to INDOT. As land acquisition is a complex process andwe are obviously early in the
negotialHion process with the property owner,INDOT hereby respectfully requests the Cannel Clay Plan
Commission to once again delay the rezoning of the approximately 3.0 acres for the proposed Comfort Inn.
Your continued cooperation with the US 31 upgrade and efforts to minimize taxpayer expense for our Land
acquisition needs is much appreciated. Thank you for considering this request.
