Martin, which indicates the approved location of Marie Drive north of east 96th street. The center line of Marie Drive is located 338.72' west of the east property line of Martin property. It is my understanding that the proposed width of Marie Drive was twenty-four feet (24' ) . Please be assured that as soon as the 96th street has been approved for construction an IC-626, change in plans, will be initiated changing the width of Marie Drive from twenty-four feet (24' ) to thirty feet (30' ) back to back of curbs. County Highway Engineer 7610 2, /27 ?B° EASEMENT FOR SURFACE WATER DRAINAGE KNOW ALL MEN BY THESE PRESENTS: That the Grantor, Ford Building Corporation, an Indiana Corporation, in consideration of the sum of One dollar ($1. 00) and other valuable con- siderations in hand paid, hereby grants unto Fred Bauer, Grantee, the right to enter upon and construct, maintain, repair, replace, install a surface water drainage system together with all necessary and convenient connections attached thereto and to operate by means thereof a system for the purpose of surface water drainage in, upon, along the following described land and premises of the Grantor, to-wit: A stip of ground twenty (20) feet in width by parallel lines to be used as a permanent easement for construction and maint - enance of a surface water drainage ditch in part of the Northeast Quarter of Section Seventeen (17), Township Seventeen (17) North, Range Four (4) East in Marion County, Indiana, the South line of said easement being more particularly described as follows: Beginning on the West line of the Northeast Quarter of Section Seventeen (17), Township Seventeen (17) North, Range Four (4) East, Fifty (50) feet South of the Northwest corner thereof; thence easterly parallel with the North line of said Northeast Quarter Section One Thousand (1, 000) feet more or less to the center line of Carmel Creek and the end of this description. Said surface water drainage system may be in the form of an open channel and/or water transmission pipe where necessary in the discretion of the Grantee and shall include surface rights as well as sub-surface rights as may be consistent with the purpose for which this easement is granted. Grantee hereby covenants and agrees that an additional area fifteen (15) feet in depth by parallel lines along the entire northern line of the easement shall be used for purposes of construction, maintenance and repair only and that no easement shall be deemed granted by the use thereof, but This Instrument Recorded aC 4 19:7% JUNE M.HEDGES,RECORDER,HAtOtTON COUNTY,IND. vooK 27G PAGE the Grantee, his successors or assigns shall be deemed licensees for such purposes of construction maintenance and repair only as to such area. Grantee shall promptly restore the area herein described to its original condition not inconsistent with the construction of said surface water drainage system. The Grantor hereby covenants that it is the owner in fee simple of said real estate and is lawfully sezied thereof and have good right to grant arid convey the foregoing easement herein and they guarantee the quiet possession thereof and the Grantors will warrant and defend the Grantee's title to said easement against all lawful claims. As and for additional consideration for granting this easement, Grantee shall install two (2) culverts 36 inches in diameter and 20 feet in length constructed of corrugated steel pipe at locations in the easement area specified by the Grantor. Grantee shall grade and sod around said culvert pipes so that an access is available to the 'property of the Grantor south of the easement area. Grantee, his successor or assigns shall maintain the easement and its appurtenances and shall keep the culverts in safe and operable condition and the swail free of debris and in a free-flow condition. The Grantor hereby further covenants and agrees that the easement herein granted may be assigned and dedicated to the Town of Carmel following the construction of the proposed surface water drainage system and that such dedication shall not affect the covenants herein contained. The Grantor reserves the right to use the area described for any and all purposes which do not conflict or impair the easement herein granted, These presents shall be binding on successors or assigns of the Grantor and upon the Grantee, its successors or assigns.
