AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF CARMEL, INDIANA,
RECORDING THE COMMITMENTS OF LRG RESTAURANT, LLC MADE PURSUANT TO
OBTAINING A THREE-WAY ALCOHOLIC BEVERAGE PERMIT
Synopsis: This ordinance records the commitments made by LRG Restaurants, LLC that are
required by the City in order to obtain one of the three-way alcoholic beverage permits authorized
by Indiana Code § 7.1-3-20-16.8.
WHEREAS, the City of Carmel ("City") adopted Ordinance D-2288-16, which requires
applicants for a three-way alcoholic beverage permit authorized by Indiana Code § 7.1-3-20-16.8 to
make certain commitments to the City regarding the project as a condition precedent to obtaining said
Permit from the Indiana Alcohol and Tobacco Commission; and
WHEREAS, LRG Restaurant, LLC ("Applicant") is applying for a permit and makes the
required commitments to the City as set forth below ("Commitments"); and
WHEREAS, in addition to the commitments set forth in this ordinance, the Applicant has
submitted an executive summary of the project for the Council's review, which is attached hereto as
Exhibit A and is incorporated herein by this reference; and
WHEREAS, pursuant to Carmel City Code § 6-228(d), the Mayor has reviewed the
Commitments made by the Applicant and recommends that the Council accept them as submitted.
NOW, THEREFORE, the Common Council ordains and states as follows:
Section 1. The foregoing Recitals are fully incorporated herein by this reference.
Section 2. In accordance with Carmel City Code § 6-228, the Carmel Common Council hereby
accepts the following Commitments from LRG Restaurant, LLC regarding its application for a three-
way alcoholic beverage permit ("Permit") issued by the Indiana Alcohol and Tobacco Commission
pursuant to Indiana Code § 7.1-3-20-16.8:

i. These Commitments, and all of the terms and conditions set forth therein, are binding upon
LRG Restaurant, LLC, and each and every lessee and/or proprietor of the permitted premises.

ii. The location of the premises for which the Permit is being sought is within the Carmel Arts
and Design District.
iii. The Permit shall not be transferred from the premises for which it is issued or from the
Permit holder to whom it is issued.
iv. LRG Restaurant, LLC, and each and every lessee and/or proprietor of the permitted premises
agree that the permitted premises shall remain open to the public a minimum of six (6) days
and thirty (30) hours per week, and that table and/or counter wait staff shall be available at all
such times.
V. LRG Restaurant, LLC agrees to send both the Council and the Mayor a copy of any
application to renew the Permit, as well as provide the same with timely notice of any filings,
hearings, or other proceedings regarding or pertaining to such Permit renewal application.
vi. Name and Address of the Permit applicant: LRG Restaurant, LLC, Managing Member,
Anthony Charles Lazzara, 783 Ivy Lane, Carmel, IN 46032.
vii. Business name and address of the premises for which the Permit is requested: Anthony's
Chophouse and Sup, 201 W. Main St., Carmel, IN 46032.
viii. The "theme" or type of establishment that will be operated on the premises for which the
Permit is requested: Fine -dining and upscale casual bar.
ix. The nature and type of dining services that will be provided at the premises for which the
Permit is requested: Full-service, white table -cloth fine dining restaurant and upscale bar.
X. The daily hours of operation of the premises for which the Permit is requested:
3up: Sunday -Thursday 11 a.m. — 10 p.m.
Friday -Saturday 11 a.m. —12 a.m.
Chophouse: Everyday 4 p.m. —11 p.m.
xi. The typical food and beverage selections that will be offered to the public at the premises for
which the Permit is requested: Steak and seafood with upscale bar options. The drinks will
be handcrafted cocktails, imported fine wine, and a small amount of rotating taps.

xii. A description of the Permit applicant's experience in operating facilities similar to that which
will be operated on the premises for which the Permit is requested: Mr. Lazzara has worked
in the food service industry for the past eight years, during which he managed Bub's Burgers
and Ice Cream, bartended at the Ritz Charles, and a served as a salesman at Sullivan's
Steakhouse. Mr. Lazzara is Serve Safe certified and all of his Indiana Alcohol and Tobacco
Commission permits are current.
xiii. Financial statements from the Permit applicant and premises proprietor/lessee for the past
five (5) fiscal years: None available, as this is a start-up company.
xiv. A statement explaining how the premises, if it were granted a Permit, would benefit the City
and the District in which it will be located, including the number of anticipated jobs resulting
from premises operation: This establishment will fill a void for a high-end restaurant at
Monon and Main in the Carmel Arts and Design District. It is anticipated that the
establishment will employ up to 70 full/part time employees.
Section 3. These commitments may only be modified with the approval of the Carmel Common
Council.
Section 4. This Ordinance shall be in full force and effect from and after its passage and signing
by the Mayor.

Most business minds and banking professionals probably all agree that $S% of all restaurants
will not succeed. They base this prognosis on facts founded in the failure of the owner's ability
to separate facts and reality from emotional decisions. Anthony's Chophouse and 3up while
typical in providing food and beverage as its goods sold, has based its business model and
