FINDINGS OF FACT - SPECIAL USE EXCEPTIONS
1. The Special Use in Flood Plain District, Ordinance Z160, Section 21.6 as
amended ( )( (does not) apply and all prerequisites have been met by
Petitioner as verified by:
The land is not in any flood plain.
2. The Special Use Exception will be consistent with the Character and Permitted
Land Use of the zoning district and Carmel-Clay Comprehensive Plan Because:
The stable and riding arena improvements will be constructed
and operated in a manner consistent with an estate type
development.
3. The Special Use is physically suitable for the land in question because:
The size of the tract provides suitable room and buffer
for the stabling of horses.
4. The Special Use will not injuriously or adversely affect the adjacent land
or property values because:
• The special use is consistent and will support an estate

5. The Special Use will not adversely affect vehicular or pedestrian traffic flow,

6. The Board has reviewed the requirements of Ordinance Z160, Section 21.3 (1-25)
as they relate to this Special Use, and does not find that those criteria
prevent the granting of the Exception:

The unavailability of Indianapolis water supports having
a community water supply system.
4. The Special Use will not injuriously or adversely affect the adjacent land
or property values because:
The special use is consistent and will support an estate
type development which will enhance the surrounding area.
5. The Special Use will not adversely affect vehicular or pedestrian traffic flow,
nor the adequante availability of water, sewage, or storm drainage facilities,

or police or fire protection because:
The community water supply system will provide quality
potable water and will provide a source of water tor
sprinklers in homes.
6. Tree Board has reviewed the requirements of Ordinance Z160, Section 21.3 (1-25)
as they relate to this Special Use, and does not find that those criteria
prevent the granting of the Exception:
The proposed improvements are consistent with said criteria

Dear Pat:
I have enclosed a Special Use Application in conenction
with the above-referenced subdivision for the purpose of
requesting from the Carmel Board of Zoning Appeals a Special
Use Permit for a community water supply system and horse
stables together with an indoor riding arena for the horses .
As you are aware, on May 20 , 1986 , the Carmel Plan
Commission approved our Primary Plat for 65 lots on 164 . 5
acres situated on a 1/2 mile by 1/2 mile parcel of land on
the east side of Shelbourne extending from 1/4 mile north of
106th Street to 1/4 mile south of 116th Street. We propose
a luxurious development that, among other things , will include
boulevard and fountain entranceways ; perimeter mounding; an
esplanade down the center of the development; two lakes with
an island in one of the lakes and a peninsula in the second
lake; traditional lighting of the streets and a textured
street pavement consisting of hand-laid, interlocking concrete
pavers . We believe that the subdivision will be the finest
in the State. Additionally, since the subdivision is located
in the middle of Indiana horse country with the horse patrol
facility to our southeast and additional horse facilities
to the west and north of us, both in western Clay Township
and in southeastern Boone County, we think it will be very
attractive for our residents to have an attractive place for

the stabling of horses. As you can see from the enclosed
drawings, what we propose should be both aesthetically and
functionally attractive. All storage of both trailers, hay
and any other paraphernalia will be inside.
With respect to the community water supply system, we
propose a two-inch line that will go in the appropriate
easement areas as shown on the enclosed plat that was approved
by'the Carmel Plan Commission. Before being pumped to the
homes, the water will be treated by the removal of iron,
softening, and/or anything else that is necessary to provide
high-quality water. Additionally, the community water supply
system will enable the homes attached to it to be able to be
sprinklered. The system will be monitored by the Indiana
State Board of Health at such time when more than 100 people
are served by the system, but will not need to be monitored
by the Public Service Commission of Indiana, due to the fact
that it will be paid for by assessments levied on all of the
homeowners. The assessments will also pay for the maintenance
of all common areas .
Both the stables and the community water supply system
will be limited to the residents of Bridlebourne.
