The regular meeting of the Carmel Board of Zoning Appeals was called to
order by the chairman, Warren Saunders , at 7 : 00 P.M. August 25 , 1986 at the
City Meeting Hall. The meeting opened with the Pledge of Allegiance.
Roll was called and members present were as follows: Warren Saunders, Ila
Badger, Jeanne Book (arrived 7 : 07) , and Bill McFadden. Dr. Richard Dowell
was absent.
Staff members in attendance were: Chuck Kiphart, Pat Hollingsworth, Gordon
Byers and Rosalind McCart.
There were no additions or corrections to the minutes of the July 28 , 1986
meeting and Mrs. Badger moved that they be approved as submitted.
Seconded by Mr. McFadden.
Motion carried.
Rev. Saunders announced that Dr. David Allor, Planning Professor at the
Univ. of Cincinnati, will speak at a special meeting of the Carmel Plan Com-
mission at 7 : 30 P.M. , August 26, 1986 at the City Meeting Hall.
I. Old Business
li . Board to consider Docket No . BA 43-79/86 , Renewable Variance Applicatio
for Mastercraft Dental Laboratory, 10809 N. College Ave . in R-3 zoning.
Filed by James Wood.
Mr. Wood was present requesting a one year renewal.
Mrs . Badger asked Mr. Byers if a renewable variance can be established
that the Board can use .
Mr. Byers said he would check into the matter and report back at the next
meeting.
Mrs. Badger moved that BA 43-79/86 , Variance Application for Mastercraft
Dental Laboratory, be granted for a one (1) year period to James Wood at
10809 N. College Ave .
Seconded by Mr. McFadden.
Findings of fact were completed by members.
Motion carried 4 to 0 .
H. Public Hearings
lh. 7 : 00 P.M. , Public Hearing on Docket No. V 28-86, Development Standards
Variance for lot 56, Cedar Point Subdivision in S-1 zoning. Front
building setback line in said subdivision is 35 ft. (Sec. 5.4.2) .
Dwelling under construction by Don Lewis, Colonial Village Craftsmen,
encroaches 4. 2 ft . upon the 35 ft. line due to surveying error.
Petitioner requests reduction in building setback line to 30 ft.
Filed by Fred Parker for Weihe Engineering.
The public hearing opened at 7 : 12 with Allan Weihe , of Weihe Engineering,
making the presentation for a reduction in the building line setback on lot 5E
from 35 ft. to 30 ft. due to an error in surveying.
Don Lewis, the builder, was present.
Staff recommended the granting of this variance request.
The public hearing closed at 7 : 15.
Mrs. Book moved that Docket No. V 28-86, Development Standards Variance fox
lot 56, Cedar Point Subdivision, be granted as requested.
Seconded by Mrs. Badger.
Findings of fact were completed by members.
Motion carried 4 to 0 .
2h. 7: 00 P.M. , Public Hearing on Docket No. 29-86, Special Exception for
Carmel Brethren Church. Proposed building is located on the west side
of Rohrer Rd. about 4 mile north of 136th St . in a B-3 zone . Phases
1 & 2 of the proposed building, 2,802 sq. ft. Does not include phase
3.

Pastor Jim Miller was present. and also Shiela Marshall McQueen from Mr.
Coots' office. ,
The location and surrounding zoning was given. B_
to the north, to the south is the U.S. 31 Corridor and oon southis toeofeU.tS.R31
are B-5 and R-1 pieces of property, and to the east is the B-5 corridor of
the Overlay Zone .
To be considered at this time is a 2,768 sq. ft. , phase I, sanctuary and -
entry way development.
A 1,000 sq. ft. addition to that will be constructed in phase II.
Phase I will begin immediately and, depending on financing, phase II will
be constructed as well.
The balance of the tract will remain undeveloped and used for recreation
associated with the church.
The construction will be of cedar and sandstone .
Signage meets ordinance requirements.
The Technical Advisory Committee has approved the drainage and curb cut.
All utilities will be available on site .
There will be no fencing.
Max McKinzie , 925 Rohrer Rd. , expressed concern for drainage .
Mr. Coots explained the storm water plan.
Phase I and II parking areas will be paved and it will not be curbed until
the expansion of phase III at which time the curbing and roadways around it
would be added.
Mr. Kiphart said if the church ever decided to have day care for children
they would have to come back in to the Plan Commission under a different
special use for approval.
Mr. Fitzgerald, 929 Rohrer Rd. , asked

Jim Barber, church board member, stated that the building is located as
such because of the utilities and also in order to use the remaining area
for youth activities.
Mr. Fitzgerald spoke of concern for drainage .
Mr. McKinzie stated concern for drainage running across his property from
this project.
Mr. McKinzie should contact Mr. Kent Ward, Hamilton County Surveyor, re-
garding this matter and not the Board of Zoning Appeals.
The public hearing closed at 7 : 51.

4h. 7 : 0O P.M. , Public Hearing on Docket No. V 31-86, Developmental St2 d
ards Variance , 3203 E. 96th St. , County Line Self Storage , located in a B-3
zone. Petitioner seeks reduction in required rear setback line (required 15
ft. ) to 0 ft. on north property line for proposed 97 ft. x 24 ft. (482 sq. ft.
building. Petitioner also seeks reduction of parking spaces to 18. Required
are 39. Currently existing - 22. Seeking total of 18.

The public hearing opened at 7: 56 with Mr. Hollingsworth making the
presentation.
There are two developmental standards variances tonight. One , for the
reduction in required rear setback to zero lot line on the north property
line for a proposed building and two , to reduce parking to 18 spaces for all
3 buildings.
Mr. Hollingsworth addressed drainage.
The public hearing closed at 8: 03.
Mr. McFadden moved to approve Docket No. V 31-86 for zero lot line on the
north side and to reduce the parking spaces to 18 in total.
Seconded by Mrs. Badger.
Findings of fact were completed by members.
Motion carried 4 to 0.
5h. 7 : 00 P.M. , Public Hearing on Docket No. S 32-86 , Special Use Application
for Goodyear store to be located on S. Range Line Rd. at the N.E. corner
of Carmel Plaza Shopping Center located in a B-3 zone . Petitioner pro-
poses 111 ' 4" x 52' 0" (5787 sq. ft. ) building to face south.

Huffer.
The public hearing opened at 8: 06 with Mr. Nelson making the presentation.
Robert Turner, architect, and Mr. & Mrs. Huffer were present.
An aerial photo was shown for location and the surrounding area development.
The site development and landscape plan was shown.
The entrance will be off of the north entrance to the Carmel Plaza Shopping
Center.
The trash area will be totally enclosed.
There will be 26 parking spaces.
The perimeter lighting plan was presented for 4 single lamp pole lights
25 ft. in height.
There will be one sign, an identification ground sign, to be 3 ft. high by
10 ft. in length to be located on a 3 ft. high bronze standard at the S.E.
corner of the site . The sign will have a blue background with white letters
and will be internally illuminated.
An artist ' s rendering and the elevation drawings of the facility were
presented.
Helen Mueller, adjoining property owner, questioned the drainage plan.
Mr. Turner explained the plan.
There will be no outside storage .
The public hearing closed at 8: 25.
Mrs. Badger moved that S 32-86, Special Use Application for Goodyear store ,
be approved as presented this evening.
Seconded by Mrs. Book.
Findings of fact were completed by members.
Motion carried 4 to 0.
Mr. Byers reported concerning an alternate appointment for the Board,
stating that an alternate can be selected but only seated when there is an
indirect or direct conflict of interest with the applicant.
There being no further business to come before the Board, Mr. McFadden
moved to adjourn.
