COLLEGE INDIANAPOLIS, INDIANA 46280 317-846-6611 July 24, 1986 Carmel Board of Zoning Appeals 40 East Main Street Carmel , Indiana 46032 Re : Cedar Point Lot 56 - Requested Variance A variance is requested for lot 56 in Cedar Point from Section 5 . 4. 2 of the Carmel Zoning Ordinance . The Ordinance requires a Front Building Setback Line of 35 .0 Feet within the platted subdivision. The dwelling on lot 56 encroaches upon the 35 . 0 Foot Front Building Setback Line a distance of 4. 2 Feet and therefore does not comply with the Zoning Ordinance . The dis- crepency is due to a surveying error. Since the dwelling is currently under construction and for all practical purposes complete, it would not be feasible to strictly adhere to the requirements of the Carmel Zoning Ordinance . COLLEGE INDIANAPOLIS, INDIANA 46280 317-846-6611 July 24, 1986 Carmel Board of Zoning Appeals 40 East Main Street Carmel, Indiana 46032 Re : Cedar Point Lot 56 - Statement of Hardship Lot 56 of Cedar Point has a minimum Front Building Setback Line of 35 .0 Feet as is throughout the platted subdivision of Cedar Point . The dwelling on Lot 56 is presently under construction and for all practical purposes complete . The south corner of the dwelling encroaches upon the 35 . 0 Foot Building Line a distance of 4. 2 Feet, due to a surveying error . Therefore it would not be feasible to strictly adhere to the requirements of Section 5 .4. 2 of the Carmel Zoning Ordinance .
