FINDINGS OF FACT - SPECIAL USE EXCEPTIONS
1. The Special Use in Flood Plain District, Ordinance Z160, Section 21.6 as

Petitioner as verified by:
2. The Special Use Exception will be consistent with the Character and Permitted
Land Use of the zoning district and Carmel-Cly Comprehensive plancause:,

surrounding buildings or property owners .

the area and there is adequate ingress and egress provided.
6. The Board has reviewed the requirements of Ordinance Z160, Section 21.3 (1-25)
as they relate to this Special Use, and does not find that those criteria
prevent the granting of the Exception:

STATEMENT OF VARIANCE APPLIED FOR
Petitioner is requesting a variance from the Developmental
Standards established by the U.S. Highway 31 Overlay Zone, Sec-
tion 23.01 of Carmel Zoning Ordinance.
Section 23.01-10.2 requires a minimum building height of 14
feet for all uses, with a minimum of 12 feet to the lowest eaves
for a building with a gable, hip or gambrel roof. Petitioner
seeks a variance to build a church with a height of 10 feet.
Section 23.10-10.8 requires that all buildings have a mini-
mum of 15 ,000 sq. ft. of floor area. Petitioner proposes to
build a church with 3 ,802 sq. ft. of floor area.
STATEMENT OF HARDSHIP
Petitioner is a not-for-profit religious organization with a
small but devoted and conscientious congregation. The church
members have spent many months working on a design and layout for
their church. The design is consistent with surrounding build-
ings and promotes the overall aesthetic qualities of the U.S.
Highway 31 Overlay Zone. The only variance is for height and
size, with the height variance being minimal. The congregation
cannot justify monetarily constructing a church with 15,000 sq.
ft. and it would suffer severe hardship if it were required to
construct a larger building.
