STATEMENT OF VARIANCE APPLIED FOR
Petitioner is requesting a variance from
o the
DeVelopmeStal
Standards established by the U.S. Highway Overlay
Sec-
tion 23.01 of Carmel Zoning Ordinance.
Section 23.01-10.2 requires a minimum building height of 14
feet for all uses, with a minimum of 12 feet to the lowest eaves

Section 23.10-10.8 requires that all buildings have a mini-
mum of 15 ,000 sq. ft. of floor area. Petitioner proposes to
build a church with 3 ,802 sq. ft. of floor area.
STATEMENT OF HARDSHIP
Petitioner is a not-for-profit religious organization with a
small but devoted and conscientious congregation. The church
members have spent many months working on a design and layout for
their church. The design is consistent with surrounding build-
ings and promotes the overall aesthetic qualities of the U.S.
Highway 31 Overlay Zone. The only variance is for height and
size, with the height variance being minimal. The congregation
cannot justify monetarily constructing a church with 15,000 sq.
ft. and it would suffer severe hardship if it were required to
construct a larger building.
