HomeMy WebLinkAboutCorrespondence MEMORANDUM TO: Tim Ochs, Ice Miller LLP FROM: Mike Hollibaugh, Director Department of Community Development Jeremy Kashman, Carmel City Engineer DATE: February 1, 2017 RE: Kinzer Avenue extension through Gramercy and Carmel Marketplace This is follow up to your Memorandum (1/20 memo) dated January 20 2017 (received via email on 1/27/17) regarding the above. The purpose of this memo is to clarify the position of the Department of Community Services and City Engineer's office (jointly, the "City") on key points in your proposed resolution for the design and construction of Kinzer Avenue (aka AAA Way) through the Gramercy, Carmel Marketplace and Carmel Drive Commercial properties. The City is appreciative of the efforts of Developer and hopes this memo contributes to the roadmap of how best to accomplish our respective goals for the Developments and the area. 1. Route and Design The City concurs with the route shown on the attached Exhibit A to this memo, subject to minor adjustments at the roundabouts and modifications which may be required when final engineering takes place. City would like clarification via cross-section exhibit(s) of the width for Kinzer Avenue, including right-of-way and improvements at key points along the length of the project. 2. Timing and Phasing The City is in general agreement that Kinzer Avenue cannot be constructed all at once, and is generally comfortable with the phasing, timing and responsibilities for construction of the extension as outlined in 1/20 memo, except as noted below: • It is not clear who will be responsible for funding and constructing Phase Four (1/20 memo Exhibit C-5) infrastructure improvements including the roundabout and east-west street extensions • It is not clear how Phase Four construction complements overall phasing of Kinzer Ave. construction 3. Financing The City believes funding the Marketplace segment of Kinzer Avenue should be a partnership effort between the parties and the City; and that a funding or reimbursement agreement will need to be adopted to cover expenses over amounts budgeted for by the City, including: a. the Carmel Drive improvements, including the roundabout b. east-west (Keystone Way) connectivity c. stormwater management and parking lot improvements on the HNH real estate RE: Kinzer Avenue extension through Gramercy and Carmel Marketplace page 2 3. Financing (continued) The City assumes that rights-of-way for Kinzer Avenue and Carmel Drive improvements will be dedicated to the City at no cost, including right-of-way needed from the HNH real estate. It should be noted the City is prepared to act with more assertive action for right-of-way acquisition should the dedication process for any of the parcels become too slow or ineffective in achieving the agreed upon construction timelines. The City is not convinced full demolition costs for Phase Two and Phase Three buildings are the City's responsibility. The City looks forward to resolving questions and outstanding issues quickly, so design and construction of Kinzer and Carmel Drive improvements can occur in an expedited fashion. The City believes the Keystone Parkway egress and Shoshone/Auman Drive egress should be separate discussion from the Kinzer Avenue project.
