On or about October 10, 2014, police officers employed by the Plaintiffs, lawfully seized the above property from Defendant Patrick Beach incident to his arrest and service of a valid search warrant at 2946 River Bay Drive North. Indianapolis, Marion County, Indiana. 2. That$3,000.00 in U.S. Currency shall be returned to Defendant Patrick Beach through his attorney Bryan L. Cook. 1 3. The remaining $27.403.00 in U.S. Currency, five firearms and the 2004 Cadillac Escalade shall be awarded and forfeited to the Plaintiffs as costs of law enforcement. 4. In accordance with I.C. 34-24-1-1. et. seq,the Hamilton County/Boone County Drug Task Force. the seizing agency. shall have the 2004 Cadillac Escalade for use as it, in its sole discretion, shall determine appropriate for a period of time not to exceed three (3)years. After the expiration of the three (3)year period. or at such earlier time as the seizing agency shall determine, the vehicle shall be delivered to the Sheriff of Marion County for sale pursuant to I.C. 34-24-1-6. The Sheriff of Marion County shall then deliver the net proceeds from the sale of the vehicle to the Hamilton County/Boone County Drug Task Force- Law Enforcement Aid Fund which will then deliver the proceeds as follows: Eighty per cent(80%)to the Hamilton County/ Boone County Drug Task Force and Twenty per cent (20%) to the MCPO. 5. It is ORDERED that if the vehicle is sold by the Sheriff of Marion County in accordance with I.C. 34-1-39 et seq.. the Indiana Bureau of Motor Vehicles, as provided for by I.C. 9-17-3-5 and 140 IAC 6-1-11. or the corresponding agency of another state, shall issue a valid Certificate of Title to the purchaser of the vehicle upon presentation of the Sheriff's bill of sale. 6. The$27.403.00 in U.S. Currency awarded and forfeited to the Plaintiffs in satisfaction of the costs of law enforcement: Of that amount$21.922.40 (80%) shall be deposited in the Hamilton County/Boone County Drug Task Force- Law Enforcement Aid Fund;the remaining $5,480.60 (20%) shall be deposited in the MCPO portion of the City of Indianapolis Lave Enforcement Fund. 7. Defendant admits that the Plaintiffs were authorized by Indiana Code 34-24-1-1 et seq. to initiate a forfeiture action against the above captioned property. 8. Defendant knowingly waives any claim of double jeopardy, under the provisions of the United States Constitution or the Indiana Constitution with respect to the criminal charges arising out of the defendant's actions on or about October 10. 2014. 9. The remaining property seized, that being the five (5) firearms cited in the above caption are hereby ORDERED destroyed. 9. That this action shall be dismissed with prejudice upon order of the Court.
