FINDINGS OF FACT
1. The approval of the requested variances will not be injurious to the public health, safety, morals and general
welfare of the community because:
The approval of the requested variances will not be injurious to the public health, safety, morals and general
welfare of the community because the size and appearance of the proposed ground signs are consistent with
what is permitted pursuant to the Zoning Ordinance for this type of signage. Further, the proposed ground
signs are generally consistent with other ground signs in the vicinity. The proposed ground signs are
necessary to ensure proper identification of the subject building and businesses.
2. The use and value of the area adjacent to the property included in the variance will not be affected in a
substantially adverse manner because:
The use and value of the area adjacent to the real estate that is the subject of the requested variances will not
be affected in a substantially adverse manner because the size and appearance of the proposed ground signs
are consistent with what is permitted pursuant to the Zoning Ordinance for this type of signage and is
generally consistent with other ground signs in the general vicinity.
3. The strict application of the terms of the Zoning Ordinance to the property will result in practical difficulties
in the use of the property because:

The adjacent roadways (Illinois Street and 116 Street) have been widened, thereby adjusting the location of
the right-of-way in relation to the adjacent site improvements resulting in the need for variance approval to
permit the proposed signs in the requested location. Strict application of the Zoning Ordinance results in
practical difficulties in the use of the Applicant’s site because absent locating the proposed ground signs, in
the right-of-way, the Applicant will be unable to provide reasonable and adequate identification to the site for
the general public traveling on the adjacent roadways. The installation of the proposed ground signs will
assist in providing reasonable and adequate identification which will assist in efficient and safe wayfinding
for motorists traveling to the site.
DECISION
IT IS THEREFORE the decision of the Carmel Board of Zoning Appeals – Hearing Office that Development
Standards Variance Docket No. 17100019 V is granted, subject to any conditions stated in the minutes of this
meeting, which are incorporated herein by reference and made a part hereof.
