The Petitioners proposed plans show 50% of the gross floor area (GFA) on the first floor, and 50% of the GFA on the
second floor. This is very common practice, if not the norm, for commercial buildings of 2-stories. As such, this
arrangement will have no injurious effects on public health, safety, morals, and general welfare of the community.
The Petitioners proposed plans show 50% of the gross floor area (GFA) on the first floor, and 50% of the GFA on the
second floor. This is very common practice, if not the norm, for commercial buildings of 2-stories. As such, this
arrangement will be quite compatible with adjacent properties, and therefore will have no adverse impact on either the
value or the use of any adjacent property.
The Zoning Ordinance mandates a maximum of 40% of the GFA (gross floor area) on the first floor, and a maximum of
35% of the GFA on the second floor. Combined, this is 75% of the GFA.
A previous Variance was granted (17080012 V) which allowed for this building to be a (2)-story structure. It is the
Petitioners contention that section 23B.08.05-B of the Ordinance logically pertains only to buildings of (3) stories and
above, because as a (2) story building, it is mathematically impossible to satisfy the Ordinance, as 100% of the GFA in
this case must be distributed between only (2) floors.
Currently the plans show 50% of the GFA on the first floor, and 50% of the GFA on the second floor.
