HomeMy WebLinkAboutPC Minutes 10-16-1990 CARMEL PLANNING COMMISSION MINUTES -OCTOBER 16, 1990 1 The regular meeting of the Carmel Plan Commission was brought to order by Jeff Davis on October 16 , 1990 at 7 : 35 P.M. at the Carmel City Council Chambers . The meeting opened with the Pledge of Allegiance . Mr. Davis welcomed Pack 198 , Den 5 of the Boy Scouts to the meeting. The board members present were : Jeff Davis , Alan Potasnik, Max . , Moore, Frank Fleming, Henrietta Lamb, Annabelle Ogle, Sue McMullen, Richard Klar, Henry Blackwell, Ila Badger, Caroline Bainbridge, Ronald Houck, Jim O'Neal and Sharon Clark with Hamilton County Planning Commission The staff members present were : Wes Bucher, David Cunningham, Terry Jones, Wm. Wendling, Jr. , Attorney and Jeff Todd from Campbell Kyle Proffitt and Dorthy Neisler. Mr. Potasnik moved to approve September 18 , 1990 minutes amended as follows : Page 3 , Paragraph 7 , Line 3 should read: In lieu of the pine trees they would use deciduous trees because pines grow over the sidewalk; Page 8 , Paragraph 8 should be deleted completely. Mr. Houck seconded. Approved 13-0 . Mr. Potasnik questioned what is going on behind the post office on Medical Drive and does the storage shed there have to come before the Plan Commission for approval? Mr. Bucher stated that he was aware of some earthwork being at that site but was not aware of any footings being put in. A year ago the staff did see some plans for changes in driveway and some configurations of the post office . To his knowledge the plans were pulled back because of funding situations and the local post office did not get the money to go ahead with those plans . Mr. Bucher stated that the staff would contact the post office . Mr. Wm. Wendling, Jr. stated that the discussion centered around • what authority the mnon�caopaliM� had WendlingfeJrrastatedbodies that hewhat they could or could would go back and review this . Mr. Wm. Wendling,Jr. stated when he left the meeting Jeff Todd from Campbell Kyle Proffitt would be filling in for him. Also, Mr. Wendling, Jr. reported on two questions that were asked by Mrs . McMullen at the last meeting. They are : 1) whether a municipality has the authority to revoke, or require new approval, of an existing commercial sign when the only change made thereon is to copy; and 2) does our ordinance prohibit all illuminated commercial window signs? A letter that was sent to CARMEL PLANNING COMMISSION MINUTES -OCTOBER 16, 1990 2 all board members is attached (which is a part of the official minutes and attached to the Master Co Jr. ave a brief answer which was for #1 : A municipalityy) . Mr. Winmaylnot,revoke, or require new approval, of a commercial sign when the only change made thereon is to copy; #2 : This question, regarding illuminated window signs, poses a problem with interpreting the ordinance. This has been the source of a difficult situation for the Department of Community Development . The answer depends on whether a window sign is temporary or permanent . There was further discussion. Mrs . Sue McMullen reported that she had attended the regional conference in Louisville, Kentucky. G. PUBLIC HEARINGS lg. Commission to consider Docket No. 62-90 PP, a primary plat (replat) application for Kensington Place. The primary plat (replat) consists of 3 lots located of the south side of 136th Street approx. one half mile east of Meridian Street (within the existing Kensington Place subdivision) . Site is zoned R-4 residence district. Petitioner requests approval to relocate an utility easement and two lot lines on three single- family residential lots . Petitioner has also filed the Secondary plat (replat) and is seeking a simultaneous approval of the Primary and Secondary plats - Docket No. for the Secondary plat is 63-90 S .P. Filed by Ken Sebree for Kensington Development Corp. The public hearing was opened at 8 : 05 P.M. Mr. Steve Harlow, Attorney representing Kensington Development Carmel Departmenmade the trof eCommunit a py of which is on file at the Y Development . Mr. Ken Sebree was present. Plats were displayed. The public hearing was closed at 8 : 07P.M. Mr. Klar moved to suspend the rules and act on this at this time. Mrs . McMullen seconded. Approved 13-0. Mr. Klar moved to approve Docket 62-90 PP and 63-90 SP as presented. Mrs . Bainbridge seconded. Approved 13-0. CARMEL PLANNING COMMISSION MINUTES -OCTOBER 16, 1990 3 2g. Commission to consider Docket No. 69-90 Z, a rezone application for Brenwick Development, Inc. Site consists of 385 acres of land located east of Gray Road, south of 126th Street, west of the existing Northwood Hills Farms subdivision and north of 116th Street . Site is currently zoned S-1 (Residential) . Rezone request is to zone this property to S-2 Residential (96 . 96 acres ) , R-2 Residential (141 . 32 . . acres) and the remaining acreage to remain S-i for a residential development project . Filed by James J. Nelson for Brenwick Development, Inc. Mr. Davis, Mr. BlackwellllandsMrs adger themselves from this project due to Mrs . McMullen, Vice president continued on conducted the meeting at this time . The public hearing was opened at 8 : 14 P .M. Mr. Jim Nelson, 3663 Brumley Way, Carmel, made the presentation, a copy of which is on file at the Carmel Department of Community Development . An aerial view, an area zoning map, and a conceptual development plan was presented. Mr. Mike Harmon, V.P. of American Aggregates and Mr. George Sweet, President of Brenwick Development were present . Mr. Jim Steckley, 5829 E. 116th Street, spoke in favor of this project that it would be an improvement to our community, ld bring in more tax base and less noise . Mr. Tom Kendall, 11818 Gray Road, Carmel, spoke in opposition to this project . He stated that he is not against growth and development, but how much can the city cope with at one time . 1) • , additional 500 or more new homes on the east side making an additional 3-500 more children; 2) 1000 more vehicles daily; 3) economic times does not warrant for more development . Mr. Kendall requested that the Plan Commission consider the following things; adopt a resolution and recommend that the City Council pass an ordinance requiring as a prerequisite for all rezoning request within your jurisdiction where 100 or more homes could be potentially built that a four part study be performed. It could be conducted by an independent third party organization and overseen by the City of Carmel with any and all expensespaid by the petitioner. The study should cover the following four points : 1) the impact on the proposed development on the Carmel/Clay School System and its ability to maintain its high CARMEL PLANNING COMMISSION MINUTES -OCTOBER 16, 1990 4 standards of education; 2) the proposed developments impact on traffic and the ability of local roads , streets, intersections to accommodate the increase without a significant decrease in service to the existing community; 3 ) community; 4) the environmental impact tof destroyinghe economicmtracees, the additional pollution through exhaust emissions, waste removal, etc. . Mr. Kendall feels the commission should consider requirin • ' at least two new trees of 10 ' or greater height be planted for g every mature tree that must be destroyed. He also proposes that the zoning ordinances be reviewed to include the maximum provisions for lakes and other common areas in the computation of lot size . In conclusion, Mr. Kendall recommends that the Plan Commission take an active roll along with the City Council, Mayor and other city officials to prevent any future reoccurrences or rezoning by variance through the Board of Zoning Appeals . Mr. Ralph Zimmerman, 11921 Forest Lane, Northwood Hills spoke in opposition to this project. His concerns was having a thoroughfare plan to get the people from Linwood Farms and this project out to the main roads and the drainage . Ms . Gayle Bardock, 4714 Buckingham Court in Brookshire speaking as Brookshires representative to Mayor Hancock' s 116th Street Task Force . A letter from John Schuler, Chairman of Mayors 116th Street Task Force, a copy of letter is attached (which of the official minutes and attached to the Master Copis ahart same letter was sent to the Board of ZoningAppeals . y) •The TThe ask Force is requesting time to complete a stuy this particular project . Mr. Roy Allifon, 11932 Westwood Drive, Northwood Hills, spoke in concern of water runoff, traffic, schools and congestion . Not one piece of property in Northwood Hills is higher than the elevation of American Aggregates . Ms . Bonnie Liggett, 11610 Bradford Place, Chairman of the Community Affairs Committee of the Woodbrook Schools PTO, spoke in opposition to this project . Their concern is the amount of space in classrooms and the quality of the education for the number of children that will come from the additional homes in this development. Mr. Greg Binder, 11861 Roster Rd. , President of Northwood Hills Association, spoke in opposition of this ro . Their are the traffic and the roads, the schools, thetdrainage, concerns density and overall impact of this project . Mr. Nelson spoke in rebuttal to the concerns of the remonstrators . Mr. Nelson cannot speak for the Carmel School System, however, that their continuous and consistent position is that they do not take any stand with respect to zoning request . With respect to traffic, th • development will occur over an extended period of time, iwill occur over an approximate 10 year period. The first home to be constructed will not be available for occupancy until probably the fall of 1991. The task force has plenty of time to study their traffic concerns . The petitioner has sstudied the area thoroughfare plan and believes that the plan as zoned today, will grow and the plan determined what roadway improvements needed to be made totaccommodate rdthat at growth. With respect to the exact location of estin proposing the exact location of the ithethedDepartment, we are uof g h where it might be, after having met w Community Development and where it would uldebest are be4loc1 ated sorthat it would line up with Hazeldell gross acre, that is a very conservative residential odeveloplent . If we took out all the lakes of 65 acres, and took o outu t we are at a acres for the undeveloped area, even taking those density of 1 . 7 units per acre . That is also a very conservative density. Mr. Houck asked if there were any provisions for road improvements . Mr. Nelson stated that they should probably wait until the new thoroughfare plan was passed as part of the update . That would be a subject matter more appropriate for a primary pl at .petitioner is proposing the right-of-way and they have ideas on what they might do, like an additional lane on 126th Street, like a mirror along their propeo yalines those improvements that CP Morgan made with respect Mr. Houck asked how many lakes are there and what is the amount of water that will be generaonsible this maintenancemofttheseiwaterll there be a provision for the resp areas and if so how will that be done? Mr. Nelson stated that he assumed it would be the requirement of the homeowners association. Mr. Houck asked what the level of service isata 6thons andtGray and what impact this would have from trip g 11 roads adjoining the property? Ms . Sharon Clark asked if there are wet lands involved? Is there any sort of precedent for moratoriums in our history? Mr. Richard Henderson, Schneider Engineering stated that on the western portion of the existing mining operation is classified as wet lands . Mr. Houck asked if there will be a lot of modification of surface and moving of earth to accommodate the drainage plan to what are proposing? you Mr. Nelson stated that they had filed with the Department of • • Community Development a conceptual drainage plan which is the type of plan you usually file with a rezone request . Mr. Henderson stated that they had more than supplied the required amount of acreage that would be used for detention numbers as far as meeting the Hamilton County ordinances as far as the release of storm water runoff . The west portion of the site will drain to Cool Creek and will be detained through the existing lakes, there will be very little runoff after the detention is done through 60 acres of lakes . There are other existing lakes in the other portions that will handle that runoff . Mr. Richard pointed out the existing lakes and the ones that will be lakes . Mr. Frank Fleming asked about the number of curb cuts . Mr. Nelson stated that they have provided two curb cuts, there are two at C.P. Morgan, and one at the flowing well . The public hearing was closed at 9: 30 P.M. This item will go to the Land Use Committee on Novembe at the Carmel City Council Chambers at 7 : 30 P.Mr 13, 1990 3g. Commission to consider Docket No. 72-90 DP (Amend) , a Development Plan amendment for Meridian at 465 Development park. Site is located on the northwest corner of I-465 and US 31 (Meridian Street) and consists of 75 . 8 acres of land . Site is zoned B-i, B- 3, and B-6 business zones . Petitioner seeks approval to amend the previously approved Development plan (Docket No. 32-89 DP/ADLS) for a mixed use development, this amendment deals specifically with infrastructure development . Filed by Jim Nelson for Meridian 465 Associates, Limited Partnership. This item was tabled until the November 20, 1990 meeting. 4g. Commission to consider Docket No. 73-90 DP/ADLS, a Development Plan and an Architectural Design, Lighting, Landscaping and Signage application for Thomson Consumer Electronics . Petitioner seeks approval to construct a four-story, 350, 000 square foot building on 30 acres of land located on the west side of Meridian Street just south of 106th Street, within the Meridian at 465 Development park. The proposed building is to CARMEL PLANNING COMMISSION MINUTES -OCTOBER 16 , 1990 house the executive offices and research laboratories for Thomson Consumer Electronics . Site is zoned B-6 Entrance Corridor District . Filed by James J. Nelson for Thomson Consumer . , Electronics , Inc. This item was tabled until the November 20, 1990 meeting. H. OLD BUSINESS 1h. Commission to consider Docket No. 51-90 OA, an ordinance amendment to repeal Title and Ordinance Z-211 of the Carmel/Clay Zoning Ordinance regulating the placement of satellite receiving antennas as accessory uses within the City of Carmel . In addition add definitions pertaining to satellite dishes . Filed by the Carmel/Clay Plan Commission . This item was tabled at the committee level. 2h. Commission to consider Docket No . 61-90 Z, a rezone application for 8 . 1 acres of land bounded on the east by Guilford Ave . and on the west by Old Meridian Street . The property is currently zoned R-1 (Residential) . Petitioner forrtheesting to developmentzofeathe property to B5 business office for general office use . Filed by James J. Nelson for St . Petitioner will be appearing before the Carmel/Clay Board of Zoning Appeals for a developmental standards variance for the location of these antennae . Filed by James J. Commission to consider Docket Nos . 66-90 DP and 67-90 ADLS, a Development Plan and an Architectural Design, Lighting, Landscaping and Signage application for Dukemill Limited Partnership. Petitioner seeks approval to construct a two-story, 75, 000 square foot building on 5 . 16 acres of land located on the northwest corner of 126th Street and Meridian Street . Site is zoned B-2 business district . Filed by Robert Falk for Dukemill Limited Partnership. Mrs . Badger removed herself from this project . Mr. Potasnik moved to approve Docket No. 66-90 and Docket No. 67- 90 as presented with the contingency that the county surveyor has approved the plans as submitted and SCS has received the erosion control plans as requested and staff would approve the landscaping plans and IDOT ' s decision on the transportation easement. There was a report from Mr. Blackwell on the first meeting and the second meeting will be held November 13 , 1990 , at 4 : 30 P .M. .
