One more question — do you happen to know the lot coverage percentage? I know these courts are a pervious material —
but say they weren't... what would the coverage percentage be with adding them? Up to 80% is allowed and I'm not
concerned about it —just want to make sure I cover everything.

Dear Mr. Jordan,
Please find attached revisions and responses related to the Construction Plans provided by Civil Site Group. It
should be noted that the proposed volleyball court areas have been reconfigured and reduced to a total of two
(2) courts. These modifications to the volleyball court areas were done in order to avoid the encroachment of
the FEMA Flood Plain, cover over the existing sanitary manhole, removing and replacing an existing
downspout, etc. The following are responses for each of your comments:
Construction Plan Review Comments
1. These items have been added to Sheet C0.0. Please see the cover sheet in the revised construction plans.
2. Email addresses have been provided on the cover sheet. Please see Sheet C0.0 of the revised
construction plans.
3. All of the revised construction plan sheets have been stamped with the appropriate language.
4. The flood plain line type has been added to the legend on Sheet C 1.0. Please see the revised construction
plans.
5. Due to the rearrangement of the proposed volleyball court areas, tree clearing will not be needed. All
proposed clearing has been removed from Sheet C 1.0. Please see the revised construction plans.
6. A Non -Enforcement on Individual Tracts for encroachment into the regulated drain easement is attached
for pending approval.
7. Ryan Hartman at CTRWD has acknowledged that the volleyball court area locations are acceptable as
long as the existing sanitary manhole is not covered. Due to the proposed reconfiguration of the
volleyball courts, CTRWD should not have any problem accessing the sanitary sewer.
8. All necessary technical information required by Section 102.02 of the Stormwater Technical Standards
has been taken into account on the revised construction plan documents.
9. The courts provide a sand infiltration layer for drainage. The retaining wall drainage will outlet at both
ends of the proposed wall and drain via overland flow into the WR Fertig Drain.
10. A foot wash station has been proposed near the gate entry to the courts. Please see Sheet C2.1 of the
revised construction plans.

11. A detail of the proposed fencing around the volleyball court areas has been provided and can be seen on
Sheet C7.0 of the revised construction plans.
12. Construction limits have been provided on Sheets C 1.0, C2.0, and C4.0 of the revised construction plan
documents.
13. Due to the volleyball court areas being reconfigured and reduced to two (2), the proposed roof drain has
been eliminated from the proposed improvements. The existing roof drain is no longer included within
the proposed construction limits. Please see Sheet C3.0 of the revised construction plans.
14. Please see the above response to comment # 13.
15. Due to the volleyball court areas being reconfigured and reduced to two (2), covering the existing
sanitary manhole has been avoided. Please see the revised construction plans for further reference.
16. Noted.
17. The silt fence is now shown with the proposed construction limits. The proposed rock chute will no
longer be needed for this project. Please see Sheet C4.0 of the revised construction plans.
18. The nearest downstream studied B.F.E. is 827' per Flood Insurance Rate Map #18057CO209. The
Floodplain that pertains to the subject site is unstudied. It should be noted that due to the reconfiguration
of the proposed volleyball areas, the courts are now located just north of the FEMA Flood Zone "A"
boundary line. The courts have also been proposed to be elevated in order to avoid such flooding.
19. Both check dams have been removed from the WR Fertig Drain. Please see Sheet C4.0 of the revised
construction plans.
20. We are no longer proposing fill in the floodplain; therefore, no mitigation will need to take place.
21. Noted.
22. A variance will he requested from the Board of Public Works.
23. Both retaining wall choices on Sheet C7.0 are adequate applications for the proposed improvements. It
shall be the owner/contractor's responsibility to choose which retaining wall will be more feasible for
this project.
24. The requested note has been added to Sheets C0.0, C1.0, C2.0, C2.1, and C3.0 of the revised
construction plans.

The following letter represents comments for this project specifically addressing the area of alternative
transportation. I have reviewed the drawings submitted for the February 17, 2016 Technical Advisory Committee
meeting and offer the following comments:
ALTERNATIVE TRANSPORTATION REVIEW COMMENTS
1) The City of Carmel Parking Ordinance requires bicycle parking spaces at a rate of five (5) bicycle parking
spaces per one hundred (100) required automobile parking spaces with a minimum of four (4) spaces
installed within fifty (50) feet of the main entrance the building. Please include bike parking with this
project.
We request that all responses to our comments be provided in writing. Failure to provide written responses may
result in delay of the review process.
It is critical that this office be made aware of all modification made on the plans being re -submitted, particularly if
any such changes are considered "new" or fall outside of our previous reviews. Please provide revised plans
indicating all revisions. Please notify us of any changes and specifically state any changes, including changes
resulting from Plan Commission, Special Studies or other committee meetings.
The Department of Community Services reserves the right to provide additional comments based on subsequent
reviews.

transportation. I have reviewed the drawings submitted for the February 17, 2016 Technical Advisory Committee
meeting and offer the following comments:
ALTERNATIVE TRANSPORTATION REVIEW COMMENTS
1) The City of Carmel Parking Ordinance requires bicycle parking spaces at a rate of five (5) bicycle parking
spaces per one hundred (100) required automobile parking spaces with a minimum of four (4) spaces
installed within fifty (50) feet of the main entrance the building. Please include bike parking with this
project.
We request that all responses to our comments be provided in writing. Failure to provide written responses may
result in delay of the review process.
It is critical that this office be made aware of all modification made on the plans being re -submitted, particularly if
any such changes are considered "new" or fall outside of our previous reviews. Please provide revised plans
indicating all revisions. Please notify us of any changes and specifically state any changes, including changes
resulting from Plan Commission, Special Studies or other committee meetings.

We have had some internal discussions and as thought we can probably work through the encroachments if:
1) CTRWD has ability/access necessary to service the main and manhole on the property
2) Manhole stays exposed and does not get covered over
With that being said the one court will most likely need to be relocated/reoriented so as to get away from the manhole and the
other two courts can stay as shown as long as we can get around them if necessary to service the main/manhole.
I have attached our typical encroachment document for review/comment.

Due to the courts/wall blocking access to our sewer in order to approve location of courts we will either ask
that the sanitary sewer be rerouted (probably no feasible) or the courts be relocated as to not impede access to
the sanitary sewers/manhole. We do have encroachment agreements that we have executed in the past but this
is not a layout that is workable for CTRWD due to the overall improvements that are being place over the
sewer.

Please find attached Construction Plans for Off The Wall Sports Outdoor Volleyball Courts to be located at
1423 Chase Court. The subject site is located at the southeast comer of Chase Court and just north of the WR
Fertig Regulated Drain. The proposed outdoor/sand volleyball courts will be an addition to the existing Off The
Wall Sports building, disturbing approximately 0.45 +/- acres. The proposed improvements will consist of three
(3) new 56.3' x 82.5' outdoor volleyball court areas (total area = 13,935 +/- sf) to be installed over existing
greenspace at the southwest corner of the existing building.

The stormwater review of the construction plans and drainage calculations, dated January 15, 2016, for the
above referenced project has been completed. The submittal is in need of additional information in order to be
in compliance with the City of Carmel Stormwater Technical Standard Manual (the Manual). Please revise the
plans and calculations in accordance with the comments below:
I . Per Section 102.01 of the manual, because the proposed improvements fall within Zone A of the
FIRM, protection must be developed in accordance with the City of Carmel Flood Hazard Areas
Ordinance (http://www.carmel.in.gov/modules/showdocument.aspx?documentid=5335). Please
review and revise accordingly.
2. Per Section 102.02.i of the manual, the title sheet of the construction plans shall include the name of
the operating authority. Please revise accordingly.
3. Reviewing the details for the modular block wall on Plan Sheet C7.0:
a. The "Bury Depth" and "Leveling Pad Depth" are not specified. This information should be
included and the impact this will have on the existing storm pipe that crosses under the west
retaining wall should be reviewed and detailed.
b. The Redi-Rock detail shows a perforated sock underdrain to be specified by the engineer.
The size, material type and outlet of this underdrain should be included in the construction
plans.
Please include with your submittal, one (1) copy of the comments indicating the action taken or a written
explanation for action not taken. Construction plans and drainage calculations are not to be re -submitted
without implementing changes with respect to any and all review comments from the City of Carmel and the
Hamilton County Surveyor's Office.

The City received your submittal on January 15, 2016. We offer the following comments:
CONSTRUCTION PLAN REVIEW COMMENTS
1. Please show the total disturbance of the site, the setback distances, and the calculated building coverage
ratio on the cover sheet.
2. Please provide the email address of the developer, the engineer, and the surveyor.
3. Please stamp the plans as "Approval Pending— Not for Construction".
4. Please show the flood plain line type in the legend on C3.0.
5. We do not allow clearing in the flood plain. There are two locations on C1.0 where this is shown. Please
revise.
6. These improvements are shown within a 75' regulated drain easement. Please work with the County to
determine whether the proposed improvements are allowed or not.
7. These improvements are shown within a 20' sanitary sewer easement. Please work with Clay Township
Regional Waste District to determine whether the proposed Improvements are allowed or not.
8. Please include all technical information required by Section 102.02(xi)(m) of the Storm Water Technical
Standards on the plans.
9. How will the courts drain? Where will the retaining wall drain outlet drain?
10. Will there be a cleaning station installed for the players to wash sand off of them?
11. Please provide a detail for the proposed 10' high fence and screen fabric.
12. Please show the construction limits on all applicable sheets.
13. Why is the proposed roof drain discharging roughly 65' away from the creek? Why is the area west of the
rock chute not being stabilized?
14. An outlet permit will need to be acquired from the County to discharge the roof drain or it will need to be
revised to discharge 25' from the property line.
15. It appears there is a sanitary sewer manhole located in the most eastern court. Please revise.
16. It appears that there would be enough room for the courts to be placed east to west and have them avoid
the flood plain and the sanitary sewer system/easement. Has this been considered?
17. Please show the silt fence and rock chute within the construction limits on C4.0.
18. Please label the elevation of the 300-year flood plain.
19. Please remove the two check dams within the WR Fertig Drain.
20. Mitigation will need to be done for the fill in the flood plain. Where will this mitigation be done?
21, Please provide a SWPPP narrative in City of Carmel format for this project.
22. This project must conform to the Storm Water Technical Standards Manual and is required to have a
minimum of 2 BMPs. What will be the two BMPs for the site? The use of the sand in the courts is not an
acceptable BMP unless combined with stone and fabric to create a type of Infiltration trench.

24. Please include the following note on the plans: "Damage to the existing right-of-way shall be
restored/repaired to the satisfaction of the City at the completion of the project. The Contractor is
encouraged to inspect the right-of-way with the City prior to the start of construction to document the
existing condition of the right-of-way."
GENERAL INFORMATION
• These comments represent the Department of Engineering's first review of the development plan for this
project.
• We request that all responses to our comments be provided in writing and be accompanied by a drawing
reflecting the requested revisions. Failure to provide written responses may result in the delay of the
review process.
• It is critical that this office be made aware of all modifications made on the plans being re -submitted,
particularly if any such changes are considered "new' or fall outside of our previous reviews. Please
provide revised plans including all revisions. Please notify us of any changes and specifically state any
changes, including changes resulting from Plan Commission, BZA or other committee meetings.
• We have engaged Crossroad Engineers, PC to review all drainage plans and drainage calculations
submitted to this office for review. If you have not already done so, please provide a set of drainage plans
and calculations to their office for review. We will share Crossroad's comments as they are received.
• Final drawings will not be approved for construction until:
o All Engineering Department and Utility Department and Hamilton County Surveyor issues have
been resolved.
o All bonds and performance guarantees are posted.
o All Board of Public Works and Safety approvals and any other governing agency approvals (if
required) are obtained.
• All off -site easements necessary to install utilities to serve the development are secured.
o SWPPP is approved.
o All fees are paid.
• The Department reserves the right to provide additional comments based upon subsequent reviews.
• An approved Stormwater Management Permit is required prior to commencing any earth disturbing
activity. Please contact Mr. John Thomas regarding Stormwater quality requirements.
• An approved right-of-way permit is required prior to commencing any work in the public right-of-way and
for construction equipment access from the City's right-of-way.
• If it will be necessary to relocate existing utilities, the costs for such relocation shall be borne solely by the
developer. Any utility poles requiring relocation shall be relocated to within one foot of the outside edge
of the proposed right-of-way.
• The Department requires that the construction drawings be developed in accordance with the City of
Carmel digital submission standards and that all required submittals for primary plat, secondary plat, and
construction drawings be made. The digital files must be submitted to the Department of Engineering
prior to the approval of the construction plans. Please contact the City GIS Department for the
requirements.

BOARD OF PUBLIC WORKS AND SAFETY
• A schedule for Board of Public Works and Safety meeting dates and agenda deadlines will be sent

• Any submission to the Board requires prior approval by the Carmel Clay Plan Commission and/or the
Board of Zoning Appeals (if applicable) and completion of review by the Technical Advisory Committee.
All written requests to be placed on the Board's agenda must include the appropriate Docket Number
and the date (or dates) of approval by the Plan Commission and/or the Board of Zoning Appeals (if
applicable).
• Commercial Curb Cut Approval. Please provide BY, x 11 exhibits with the request for approval. Provide all
pertinent Information including lane widths, overall width, radii, lane markings, location of opposing
drives or streets, relationship to the location of previous curb cut, etc.
• Temporary Construction Entrance Approval. It appears the construction entrance is planned at the
location of a permanent curb cut. Therefore Board approval is not required.
• The installation of any permanent, privately owned and/or maintained improvement (signs, decorative
street signs, walls, streetlights, etc.) within dedicated right of way or dedicated easements requires the
execution of a Consent to Encroach Agreement between the Owner and the City of Carmel. Such
agreements are executed by the Board of Public Works and Safety. The City Engineer may approve
Irrigation system agreements.
• Secondary Plat approval if applicable. All performance guarantees must be posted prior to submission of
secondary plats for Board of Public Works and Safety approval.
• Dedication of right-of-way if not platted. This is based upon the City of Carmel 20-Year Thoroughfare Plan
requirements. Dedication documents are available upon request. Please be advised that all Right -of -Way
Dedications must be accompanied by a Sales Disclosure Agreement completed by the owner for the
property being dedicated to the City. The dedication document cannot be recorded without a completed
Sales Disclosure. The form is available upon request.
• Any open pavement cuts of City right-of-way will require Carmel Board of Public Works and Safety
approval.
• All existing drives need to be abandoned through the Board of Public Works and Safety.

• The amount of the Performance Guarantee is based upon a certified Engineer's Estimate for 100%of the
cost of labor and materials to construct the individual improvements, to be provided by the design
engineer. Please provide detailed Engineer's Estimates for each improvement including quantities, unit
costs, pipe sizes, and materials, etc.
• Upon completion and release of individual Performance Guarantees, a three-year Maintenance
Guarantee will be required (see Street Sign comments above). The Maintenance Guarantee amount is
based upon 15%of the Performance amount for Streets and Curbs and 10%of the Performance amount
for all other improvements.
• Performance Guarantees may be Performance or Subdivision Bonds or Irrevocable Letters of Credit.
RIGHT OF WAY PERMIT AND BONDING

We have had some internal discussions and as thought we can probably work through the encroachments if:
1) CTRWD has ability/access necessary to service the main and manhole on the property
2) Manhole stays exposed and does not get covered over
With that being said the one court will most likely need to be relocated/reoriented so as to get away from the manhole and the
other two courts can stay as shown as long as we can get around them if necessary to service the main/manhole.

We have reviewed the construction plans submitted to the Hamilton County Surveyor's Office
on January 20, 2016, for this project and have the following comments:
1. The proposed project falls in the incorporated area and MS4 jurisdiction of the City of
Carmel.
2. The proposed project DOES NOT fall in a Carmel Wellhead Protection Zone.
3. The proposed project falls in the WR Fertig Regulated Drain Watershed.
4. Please submit a Non -Enforcement on Individual Tracts for the encroachment into the
WR Fertig Regulated Drain Easement. The application is available at Surveyor's
Form Paee.
The proposed construction plans show a retaining wall and the courts within 5 feet of
the top of the bank, which will not be supported by our office or approved by the
Drainage Board. Maintenance access for the regulated drain must be maintained,
with likely a 25' minimum between the encroachment and the top of bank of the open
ditch.

6. The proposed plans show fill within the delineated FEMA Zone A per FIRM Panel
18057CO209G, which would require a variance of Hamilton County Ordinance 4-26-
99-C #6. Since this is not a detailed study at this location and the estimated
floodplain does not follow the actual contours, it is hard to tell if the fill is in the true
floodplain or how much fill is being proposed. Some detailed fill numbers would
need to be generated before requesting a variance form the Drainage Board, using
methods approved by our office.

I'm sorry for the delay in sending you this initial feedback. I have run this by my colleagues and have some comments for
you:
1) In researching the previous approvals for the site, we found that the wooded area on the south was actually a
Tree Preservation Area. (Please see the attached Erosion Control Plan which shows this as a TPA, the PC
minutes, and Committee minutes PDFs.) There was also a condition placed on Docket No. 8-97 DP Amend/ADLS
Amend for the trees along the east and south property lines to be preserved. (Please see the Tree Preservation
Area conditions PDF.) Lastly, the Tree Preservation Area was also listed as a reason why additional parking
spaces could not be obtained in Docket No. V-1-97. (Please see the Variance findings of fact PDF.)
2) From John Thomas (Carmel Engineering Dept.): The proposed sand volleyball courts on the south side of the
creek are in the mapped floodplain of the creek. It also appears this area could be a wetland and would need to
be studied before we would support the southern court. The creek crossing/culvert would have to be able to
convey the 100 year flood route. This would have to be designed by an engineer and federal, state, county, and
local water permits may be required.
3) From Daren Mindham (Carmel Forestry Dept.): I have attached the original landscape plan for the building. Any
dead or dying trees/plants will need to be replaced and brought back up to meet the plan. You would also still
need to meet the perimeter bufferyard of at least 10' and we would like as few trees as possible removed for
this new addition.
4) From Angie Conn and I: Due to the findings that this is a tree preservation area, we cannot support the removal
of any trees on the south side of the creek. Is there any way to have both courts on the north side of the creek?

2) From John Thomas (Carmel Engineering Dept.): The proposed sand volleyball courts on the south side of the
creek are in the mapped floodplain of the creek. It also appears this area could be a wetland and would need to
be studied before we would support the southern court. The creek crossing/culvert would have to be able to
convey the 100 year flood route. This would have to be designed by an engineer and federal, state, county, and
local water permits may be required.
3) From Daren Mindham (Carmel Forestry Dept.): I have attached the original landscape plan for the building. Any
dead or dying trees/plants will need to be replaced and brought back up to meet the plan. You would also still
need to meet the perimeter bufferyard of at least 10' and we would like as few trees as possible removed for
this new addition.
4) From Angie Conn and I: Due to the findings that this is a tree preservation area, we cannot support the removal
of any trees on the south side of the creek. Is there any way to have both courts on the north side of the creek?
Could some parking spaces be removed to accommodate one of the new courts? Can you provide a schedule of
the volleyball games? Will they be going on at the same time as other events inside? Will more parking spaces
be needed or could a reciprocal parking agreement be reached with surrounding properties to accommodate
any extra parking? It appears that this is in the Regulated Drain Easement. Will additional approvals from the
County Surveyors Office be required to build in this easement? Also, as we talked about on the phone, please
provide lighting information for the new courts, prevention measures for keeping the sand in the court (will
there be foot showers/rinse off stations?), and safety information for emergency response teams to access the
courts.
So I'm sorry, but a DP Amendment will be needed, which will require Plan Commission approval, as well as public notice.
We cannot administratively approve these additions. Here is a link to the 2016 PC calendar for your reference. Please let

Dan Peeples and Dale Moulton appeared before the Commission on behalf of the applicant.
Also in attendance were Gary Murray and Sam Stover of Paul I. Cripe, Inc. and Sam Yau
from the Ross Group. Off The Wall Sports will be an indoor facility for youth and adult
Soccer and possibly roller hockey.
Off The Wall Sports will be staffed by professional management, and they are hoping to draw
from surrounding communities. It is hoped that the overall economic impact on the Carmel
community will be favorable.
It is anticipated that no more than 50 vehicles would be on the grounds at any one rime. The
hours of operation for the facility are during non -prime time hours and traffic will not be a
problem
At present, there are two stands of trees on the property which will be preserved; one on the
east side, the other along the southern border. There is a regulated drainage easement on the

Creek, the petitioner is very receptive to the idea and would like to keep the area as natural

The sign will be 72 inches wide and about 44 inches tall, it will not be lit. The colors will
be the same as the building, the materials will be of sandblasted redwood with cedar posts.
The building will have highlights of a Forest Green color.
The petitioner has proposed 144 parking spaces which exceeds the requirement. The parking
lot contains berms of flowers and trees and vegetation. At the entry will be mounded
plantings and bushes.
The petitioner will be installing sidewalks and rolled curbing in the parking tot area. There
will also be handicap parking available. The petitioner will be using split -face block and
smooth, scored block on the building. All lighting will be retained in the parking areas which
will consist of two fixtures.
There will be a drainage swail around the property which will drain to the Creek.

Terry Jones gave a brief history of the proposed amendment and explained that it was
generated largely by discussions/complaints from pool builders in situations where
subdivisions back up to arterial thoroughfares such as Spnngmill, Gray Road, etc. There
were 11 variances granted last year by the Board of Zoning Appeals to this section of the
