A request was again made by Mr. John Kyle-Attorney for Brookshire
Subdivision and Mr. Gary Kern-Engineer for Weihe Eng. Co., with .ems r, 4 d

proposed revised plans for the drainage in the Brookshire Subdivision,
to vacate a portion of the Wm Mustard Drain. Mr. Robert E. Clements
restated that he is opposed to vacating any ditch, unless an al-
ternate properly design means of drainage is provided. The Board
agrees to the partial vacation, if the Board is satisfied that
the drainage will be adequate for the Subdivided area and that
the Town of Carmel will maintain the proposed new drain including
the non-vacated portion of the legal drain. The Board further a
agrees that it the revised plans are presented to the County Surveyor
and meets the requirements, the Board will hold a special hearing
_may 6, 1974, for the "Wm Mustard Drain. This proposal was agreeable
to Mr. Kyle and Mr. Kern.

MINUTES OF .THE SPECIAL SESSION OF THE HAMILTON COUNTY DRAINAGE BOARD
1 APRIL 1974
Members present for this Special Session of the Drainage Board were
Mr. Roy Davis—Chairman, Mr. Gerald Landes and Mr. John Hartley.
Also present were Mr. Robert Clements--County Surveyor, Mr. Gary
Kern—Engineer for Weihe Eng. and Mr. John Kyle—Attorney for the
_rooshire Subdivision. ..
This meeting was to discuss the relocation of the William Mustard
Legal Drain-Brookshire Subdivision-Sec 29, Twp 18N, R 4E by the
Lumbermart, Inc. as the Developer.
Preliminary plans were approved by the Drainage Board; subject
to the condition that the Town of Carmel will agree to maintain
the new portion of the Wm Mustard Drain and that the runoff from
the 54 inch reinforced concrete pip4nd sections, is controlled
to the point that no damage will occur to the surrounding land.
Also that the original section of the ditch is vacated. The Board
approved the special hearing set for 6 May, 1974. Notices will
be sent out the weeek of 1 April 1974 concerning the vacating/maintaining
of said ditch.
It was noted that the County Highway Assessments concerning the
highway right—of—way will be discusatilith Attorney Joseph Roberts
at the next scheduled Drainage Board meeting.

a) that the designs are of Good Engineering Standards
and Practice,
b) that the design is in the best interest of the
public and land,
c) and that it was designed with respect to the
health safty and welfare of the public and
d) that is to be of a public ulitity and dedicated
as such.
e) the owner/developer to sign oath giving approval
of above mentioned
III Easement sufficient to allow maintenance to the
drain
a) open ditch 15' from top of bank out-both side
b) tile drain,the easement start at the outer edge
of tile) 5 ' both side
IV In the covenent the drain be
a) dedicated to the City of Carmel
b) as a drain to be of public ulitity
c) classified as an Urban Drain
d) and adhearing to the rules and regulation of
the 1965 Drainage Code Act as adlended, excep-
tion being to easement width, this will be
set out in the plans and by the desision of
the City Engineer based on the need of R/W for
Maintenance and Repair of said drain, and
drainage way.
e) that the land owner within the drainage shed
of this drain be made aware that they are under
obligation to follow the rules of the Drainage
