Pickett stated he has the authority not to issue a building permit if some- thing does not comply with the regulations and sewage is part of the regulations. Hinshawb motion died for lack of a second. Wheeler made an amendment to the motion that he recommends the Building Commissioner issue no building permits until such time as Hamilton Western Utilities has completed to the satisfaction of the Carmel Town Board the finished stage of the on line sewage system. Commission to consider Preliminary Plat Application for Cool Creek North 7th Section, located east of Keystone Avenue on SR 234. Referred to Subdivision Committee for report in September. Filed by Joe Dawson. Earl Ligon read the Subdivision Committee report. This sectionconsists of 25 lots on 11.71 acres. This section was left until last due to the poor drainage in this area. A low area centered around lot 207 has since been filled to eliminate this problem. To further help the drainage, it was recommended by T. Shellenberger that a drainage swail be cut through the Foster property paralleling'an existing 18" tile starting at lot 207 and extending through the Foster property 1,800 feet. Ironwood Court is a 26 foot street so a variance must be obtained. There is to be a perforated drain tile installed along Ironwood Court, fronting lots 190 to 197 to allow for easement and subsurface drainage. Dawson stated there was a meeting with Tom Shellenberger, himself, Mrs. Foster and her Farm Manager and they had walked this area. He is proposing to run the swail or ditch through to the drainage ditch above this area. The estimated contracted cost would be l :8,000.00. He hasnt heard back from Mrs. Foster on this plan. Litzsinger stated he was concerned that an agreement had not been reached on this drainage problem. Wheeler stated the Committee felt the petitioner was on the right track and is working out the details. The Committee has reports and plans from T. Shellenberger. Litzsinger asked Mr. Dawson if he (Dawson) would need to negotiate with adjoining land owners in order for him to go ahead with the plan. Dawson replied, yes. Litzsinger asked if there was any opposition in tabling this item for 30 days in order for petitioner to work out a solution with the adjoining land owners. Petitioner did not object to this tabling. Unanimous approval to table 30 days. 3A. Commission to consider Final Plat Application for Brookshire North, Section 2, located north of 126th Street off of Andover Drive. Commission to send to . Subdivision Committee. Filed by Lumbermart, Inc. Wheeler read the Subdivision Committee report. There are only 5 lots involved in this section. The petitioner has changed the depth of Andover Circle to meet the require- ments for set back line so the houses would not be built on flood plain land. Wheeler moved that Section 2 be approved as submitted. Swift seconded the motion. Motion unanimously approved, 15-0. 4A. 8:00 P.M., Public Hearing, Commission to consider Preliminary Plat Application for Cool Creek North Section 9-16, located north of Smokey Row Road and east of Carey Road. Referred to Subdivision Committee for report at September meeting. Filed by Joe Dawson. CARMF 1 PLAN C0?4MISSIOPI August-19, 1975 The regular meeting of the Carmel Plan Commission was called to order at 7:30 P.M. .on August 19, 1975 by the President, Jim Litzsinger. All members were present except F. Alderson, Jones, Solomon and R. Stephens. Al Pickett, Dave Fletcher, Sam Voland, Tom Shellenberger and Lee Klotz also were in attendance. The minutes of the July 1975 meeting stand approved as submitted. Jim Litzsinger read a copy of a letter to Mr. SerVaas from the Nora Community Council re- garding the City County deliberation on Case 75-Z-25. Litzsinger also read a letter from Robert D. Orr, Lt. Governor, to the Plan Commission, announcing approval of the 701 local assistance planning grant. The amount of money we will receive has not been determined as of this date. OLD BUSLTESS 1A. Commission to consider Final Plat Application for Village of Mt. Carmel, 7th Section, located south of 146th Street and west of Mt. Carmel. Referred to Subdivision Committee for report at September meeting. Filed by Doug Church for Village Farms. Wheeler gave the Subdivision Committee report. Section 7 includes 152 lots on 79 acres. The areas the Committee felt needed to be changed have been changed on the plans and were given to Dave Fletcher on August 11, 1975 and have been changed as requested. The Committee has asked for a letter from Mr. Wilfong and the Highway County Engineer regarding reconstruction of 146th Street. We have received a letter from Wilfong but not from the County Engineer. Doug Church, attorney for petitioner, stated the County Engineer did dictate a letter over the phone to his office and Wheeler read a copy of this letter. The County Engineer also talked to D. Fletcher stating he did dictate such letter to Mr. Church. Wheeler stated that with the Plan Commission's approval he would like to _ pass this on to the Subdivision Committee so they may determine the exact width of the road or if the Plan Commission wants to wait until the next meeting, they can approve the reconstruction of this road then. Spencer asked Wheeler if the letter from Mr. Wilfong was satisfactory. Wheeler stated the letter just stated that discussion has been had on this matter but no agreements have been made. Wheeler stated he would like time to talk to Hufford, County Engineer. Wheeler moved that we approve the final plat application for Village of Mt. Carmel, 7th Section, contingent upon acceptance of the Subdivision Committee of the agreement between the developer and Highway County Engineer with maintenance and reconstruction of 146th Street and the plat will be signed after the Subdivision Committee approved such an arrangement. Brockman seconded the motion. Hinshaw moved to table any further action on this section until the next meeting due to the fact that Mr. Wilfong is not on line with the north sewage plant. York askedif the Subdivision Committee had included this material in their report. Wheeler stated yes, but they felt this is a problem between the Town Board and Hamilton Western Utilities. The capacity for these homes is there. Hinshaw stated that the State Board of Health stated that no more building could be addedto the north sewer plant unless additional facilities were added. Mr. Wilfong is authorized to add on up to 250,000 gals/day. The Plan Commission should not approve any more building in this area until Mr. Wilfong can guarantee this can be taken care of. Litzsinger asked if there was a bond on Mr. Wilfong's proposed sewer completion agreement. The answer was, no. Swfit asked Doug Church what he had to offer on this matter. Church stated that it was his understanding that it was not on line yet but he understood the plant is completed. Swift stated that his concern was that if Mr. Wilfong built the homes and the sewage came down the pipe, whether the plant is done or not, without the new addition being completed it is going to overload.
