Please find enclosed construction plans, plat, etc. revised per your letter of
coin nts dated April 23, 1991. Revisions and/or response comments are as follows:
. Changes from the approved primary plat include a project name change,
formally called Carwinion, and section lines have been relocated. Overall,
the lot count, street layout, drainage and sanitary systems conform to the
approved primary.

As of this date, we are preparing land title surveys for Brenwick and source

around. We have added an access easement between lots 15 and 16 to serve
the station however.
All building lines have been checked and adjusted, if necessary, to a point
where the lot width equals 100'.

A development report describing water, sanitary and storm systems is

The cover sheet of the construction plans currently shows a soils map which
includes the site location and soil types within the site.

and have forwarded him all the necessary plans, data, and applications he
needs to review and process this project. I will forward you a copy of his

Dear Dave:
I have reviewed the submitted construction plans (dated
4/19/91) for Section One and have the following concerns:
1) A set of revised plans are required.
2) Provide a cross section of Shelborne Road for roadside
drainage improvements north and south of entrance.
3) The 12 inch RC pipe from str #110 should be extended east
of the sidewalk and a beehive installed to improve
drainage for Shelborne Road.
4) The end section #120 should be replaced with a manhole
with a beehive and the 12 inch RC pipe extended east of
the sidewalk for a manhole with a beehive to be installed
for roadside drainage.
5) A more detailed print with elevations will be required
for drainage of Shelborne Road and through or under the
sidewalk along Shelborne Road.
6) If mounds are permitted in the landscape easement provide
drainage details and mound locations - since landscape
easement is between the drainage swale and sidewalk in
road right of way.
7) A roadside ditch is to be constructed along the west side
of Shelborne Road as per County Standard.

8) Revise cross section "A-A" on sheet S-9 to indicate a
drainage swale in road right of way and 12 inch of
surface over the 4 inch binder.
9) Trees in the road right of way necessary to install the
sideditch and improve drainage are to be removed.
10) Bosloe Drive is to be extended to the south property line
and a temporary asphalt curb installed to control
drainage.
11) The road improvements required for Shelborne Road shall
consist of improving the west half of the pavement to 12
feet in width with 3 feet of #73 stone to a depth of 6
inches and an overlay of 12 inches the full width of
Shelborne Road.
12) Right of way for the full length (1335. 9 feet) of the
project is to be platted or dedicated for 40 feet of the
right of way for the west half of Shelborne Road prior to
any construction.
13) Other items will be addressed after receiving revised
plans.

Re: Ashbrooke Section 1
I have reviewed the construction plans, the lake plans, and the secondary plat
for the above mentioned project. I wish to note the following comments and
recommendations pursuant to the directions expressed by Kenton C. Ward, Hamilton
County Surveyor, concerning this project and the afore mentioned review.
1. This subdivision will be regulated drain. According to comments made at the
Carmel TAC meeting (5/16/91) this process has already begun.
2. At the present time, Crooked Creek is not in a suitable condition to serve as a
proper outlet for this subdivision. Previous comments for this site, as well as
for other projects have said that Crooked Creek must be improved before any
future development occurs in the area between U.S. 421 and Shelbourne Road
north of 96th Street to the natural drainage break between Crooked Creek and
Long Branch (Brendel Drain) . Included is a copy of a letter from the County
Surveyor to the Drainage Board concerning this matter.
3. According to state law, the easements should be increased to 15' per half.
Indiana Code 36-9-27-33 (e) specifically states:
"(e) This subsection applies to new regulated drains established after. September
1, 1984, and to urban drains. The board may reduce the seventy-five (75) foot
requirement of sub-sections (a) and (b) to any distance of riot less than
twenty-five (25) feet from the top of each bank of an open ditch and fifteen
( 15) feet from the center line of any tiled drain as measured at right angles."
This law applies to both regulated drains and urban drains.
4. For matters of safety, any open ended inlets or outlets should be protected with
a child/animal guard. This measure will serve two main purposes. First, small
children and animals will be prevented from crawling into the pipe. This will
avoid incidents like one that occurred last Summer in a Brenwick development, '
Springmill Ridge, when a 45 pound dog was lodged for 24 hours in a 12" pipe. A
field report about this has been included. This will also serve the purpose of
keeping large debris from entering the pipe.
5. Structure 1Q1 should show a metal end section.
6. SSD laterals should be stubbed above ground for easy identification.

Dear Les:
Pursuant to our conversation this morning, June 26, 1991,
this letter will constitute a summation of the agreements
made between your organization and Brenwick Development
Company, Inc.
We forwarded the inspection agreement and would hope that
would be executed by the County Commissioners on Monday,
July 1, 1991 . We will also appear before the County
Commissioners on Monday July 1, 1991, to request variance
for the following items:
1 . We request not resurfacing Shelborne Road as it was
completely resurfaced by the County one year ago.
2 . We will request variance to your new policy dated
June 5, 1991, whereby we may plant and put a sign in
the entry island.
As to memorializing other agreements we have made, these are
as follows :
1 . We have requested Schneider Engineering to revise
their latest construction plans and move the
drainage swale to the street side of the sidewalk
thereby removing any sidewalk grate crossings. The only
grate crossing to appear will be on the southern end of
Section One where the swale passes under the sidewalk,
immediately adjacent to the southern property line.
The drainage has been revised to allow for similar flow
characteristics to the cross section you are attempting
to use as a model.

2. We will increase the thickness of the accel/decel
lanes to 4 inches of binder and 1i inches of top coat
in accordance with your request.
3 . We will extend the structures at the entry road out
to the relocated side ditch to keep inlets within the
right-of-way and allow your maintenance activities.
This will also allow pipe crossing under the sidewalk
to alleviate any grate drain passageway.
4 . We will maintain the trees along Shelborne Road and
clear all under brush. No further tree removal should
be necessary for any reason.
5 . We will modify the existing road to add a 3 foot
pavement expansion as well as a 3 foot gravel shoulder.
This will utilize a 4 inch binder and 1 inch surface
coat in accordance with your request.
6 . We will modify Bosloe Drive and drainage extension
to connect with the property to the south.
7. We will not grant or dedicate right-of-way outside
of Section One; we will do so as required by the
planning process and commitments made to be executed at
the secondary platting stage.
I applaud your efforts in attempting to get a set of
standards for the County so designers and developers know
under which rules we are playing. We have made these
modifications in an effort to be responsive to your changing
policies.
We do not agree with your policy as to medians in
subdivisions and would request you restudy your policy dated
June 5, 1991. In that regard and in accordance with our
