Public Hearings: 1h. Hazel Dell Pond Subdivision (57-00 PP) Petitioner requests approval to Vat 31 lots on 23.945± acres. The site is located northwest of the intersection of East 116 Street and Hazel Dell Parkway. The site is zoned R- 2/residential. The petitioner also seeks approval of the following Subdivision Waivers: 57-OOa SW SCO 6.3.7 to plat a cul-de-sac in excess of 600 feet in length 57-00b SW SCO 6.3.19(1)to taper the required landscape easement to under 50 feet in width 57-OOc SW SCO 6.5.7 to orient dwellings fronting on a thoroughfare towards the street of lower functional classification 57-OOd SW SCO 6.3.6 to plat local streets with 45-foot rights-of-way The public hearing on this petition was postponed from the March 21, 2000, Plan Commission agenda to the April 18, 2000, Plan Commission agenda due to faulty notice and again to the May 16th meeting for the same reason. Since the March meeting an additional waiver petition has been filed for reduced right-of-way width. The Department recommends that this item be forwarded to the Subdivision Committee for further review. 2h. John A. Phelps' Addition, Lots 12 & 13 (68-00 PP Amend) Petitioner seeks approval to replat Lots 12 and 13 of the John A. Phelps'Addition on 0.573± acre. The site is located on the northeast corner of 5th Street Southeast and 1st Avenue Southeast. The site is zoned R-3/residence. The petitioner also seeks approval of the following Subdivision Waiver: 68-OOa SW SCO 6.3.6 to reduce the 25' half right-of-way on 1s` Street SE to 20' in width The Department recommends that this item be forwarded to the June 6, 2000, Subdivision Committee meeting for further review. West Carmel Center, Block D (73-00 DP/ADLS) Petitioner seeks approval to construct three buildings on 24.848± acres for a Target department store. The site is located at 10401 North Michigan Road. The site is zoned B- 3/business and is located within the US 421 Overlay Zone. The Department recommends that this item be heard with Item lj. (Docket No. 97-99 SP) under New Business. This project will go before the Board of Zoning Appeals May 22nd for public hearing on two Special Use petitions and twelve Developmental Standards Variance petitions. The petitioner understands that the Board of Zoning Appeals must make its approvals before final action can be taken by the Commission. The Department recommends that these petitions be forwarded to the Special Study Committee for further review. 4h. Old Meridian District Ordinance (77-00 OA) Petitioner seeks a favorable recommendation to amend the Carmel/Clay Zoning Ordinance to adopt the OM/Old Meridian District Ordinance. This item is paired with Item 5h. (Docket No. 78-00 Z) under Public Hearings. The Department recommends that the public hearings on these items be held together. The Department further recommends that the Commission suspend the Rules in order to vote on these petitions at this meeting. The Department recommends that a favorable recommendation of both petitions be made to the City Council. 5h. Old Meridian District Rezone (78-00 Z) Petitioner seeks a favorable recommendation of a rezone from S-2; R-1; R-3; R-5; B-1; B- 2; B-3; B-5; B-7; I-1; M-3; and PUD to OM on 370.35± acres. The site is zoned S-2/residence; R-1/residence; R-3/residence; R-5/residence; B-1/business; B-2/business; B-3/business; B- 5/business; B-7/business; I-1/industrial; M-3/manufacturing; and PUD/planned unit development. This item is paired with Item 4h. (Docket No. 77-00 OA) under Public Hearings. The Department recommends that the .ublic hearin_s on these items be held to•ether. The Department further recommends that the Commission suspend the Rules in order to vote on these petitions at this meeting. Carmel Oaks Retirement Facility (79-00 Z) Petitioner seeks a favorable recommendation of a rezone from R-1 to B-6 on 5.00± acres in order to build a 72-room, 99,000-square-foot retirement facility. The site is located at 1011 South Guilford Road. The site is zoned R-1/residence. The Department recommends that this item be forwarded to the June 6, 2000, meeting of the Special Study Committee for further review. Hazel Dell Corner Subdivision (80-00 PP) Petitioner seeks approval to plat a 6-lot commercial subdivision on 14.738± acres. The site is located on the northwest corner of East 131St Street and Hazel Dell Parkway. The site is zoned B-3/business. The petitioner also seeks approval of the following Subdivision Waiver: 80-OOa SW SCO 6.5.1 to plat Lot 4 with 0' of frontage on a right-of-way This property was zoned B-3/business April 17, 1995 (Z-301), and carries Commitments - copies of which the Department will make available at the meeting. The Department recommends that this item be forwarded to the June 6, 2000, Subdivision Committee meeting for further review. 8h. Subdivision Control Ordinance Amendment (82-00 OA) Petitioner seeks a favorable recommendation to amend Chapter 7: Open Space Standards for Major Subdivisions of the Carmel/Clay Subdivision Control Ordinance. The Department recommends that the Commission suspend the Rules in order to vote on this item at this meeting. The Department further recommends that this item be forwarded to the City Council with a favorable recommendation. 9h. North American Park,Lot 3 (83-00 PP Amend) Petitioner seeks approval to replat one lot on 3.##± acres. The site is located at 4102 West 96th Street. The site is zoned B-2/business and is located within the US 421 Overlay Zone. This item is paired with Item 10h. (Docket No. 84-00 DP/ADLS) under Public Hearings. The Department recommends that the public hearing on these items be held together. There are a number of outstanding issues from the Technical Advisory Committee resulting is a sub-standard submittal. The Department recommends that this item be tabled to the June 20, 2000, meeting in order to give the petitioner an opportunity to address the deficiencies. 10h. North American Park,Lot 3 (84-00 DP/ADLS) Petitioner seeks approval to establish an automobile dealership at North American Park, Lot 3. The site is located at 4102 West 96th Street. The site is zoned B-2/business and is located within the US 421 Overlay Zone. This item is paired with Item 9h. _Docket No. 83-00 PP Amend) under Public Hearings. The Department recommends that the public hearing on these items be held together. Merchants' Pointe (105-99 Z) Petitioner seeks a favorable recommendation for a rezone from R-1 to B-8 in order to construct between five and eight retail buildings not to exceed a total of 95,000 square feet on 14.378± acres. The site is located on the southwest corner of East 116th Street and North Keystone Avenue. The site is zoned R-1/residence within the SR 431 Overlay Zone. On May 9, 2000, the Special Study Committee voted to return this item to the Plan Commission without recommendation but with Commitments attached. The Comprehensive Plan Land Use Map anticipates that this area would be developed for a High Intensity Residential Community. Furthermore, the Map establishes East 116th Street in this area as the southern demarcation line between Residential Community uses and Community/Regional Employment Areas. For these reasons the Department holds that this petition does not meet the goals of the Comprehensive Plan. 2i. Wingate Inn (109-99 DP/ADLS) Petitioner seeks approval to construct a 57,500-square-foot hotel on 4.066± acres. The site is located at 1460 West Main Street (northeast corner of East 1318' Street and North Meridian Street). The site is zoned S-2/residential within the US 31 Overlay Zone. The Special Study Committee will make a report at the meeting. All issues with respect to the Development Plan and ADLS petitions have been resolved to the Committee's satisfaction. 3i. West Carmel Center, Block A(71-00 ADLS Amend) Petitioner seeks to establish sign criteria for the retail development commonly known as West Carmel Shoppes. The Development Plan and ADLS petitions for this project were approved as Docket No. 47-99 DP/ADLS. The site is located on the southeast corner of West 106th Street and North Michigan Road. The site is zoned B-3/business and is located within the US 421 Overlay Zone. On May 9, 2000, the Special Study Committee voted to forward this item to the Plan Commission with a favorable recommendation on the condition that the petitioner: 1) Provide a color palette for the signage with samples for consideration; 2) Address concerns about light intensity levels for the internal illumination. The Department recommends favorable consideration contingent upon satisfactory resolution of the Committee's concerns. The Fountains Banquet Facility(76-00 ADLS Amend) The petitioner seeks approval to remodel the façade of the old Marsh Supermarket building located in the Marsh Plaza for a banquet facility. The site is located at 502 East Carmel Drive. The site is zoned B-8/business. On May 9, 2000, the Special Study Committee voted to return this item to the Plan Commission with a favorable recommendation on the condition that the petitioner: 1) Submit a Landscape Plan to the Department of Community Services for Administrative approval:, 2) Bring samples of the aluminum; paint chips of the proposed colors:, and cut sheets of the fountains to the May 16th Plan Commission meeting:, 3) Submit a Sign Plan for review. The Department withholds recommendation until such time as all materials and documentation has been submitted for review. J. New Business: 1j. West Carmel Center,Block D (Target,Inc.)(97-99 SP) The petitioner seeks approval to plat one lot on 26.060± acres. The site is located southeast of 106th Street and U.S. 421. The site is zoned B-3/business and is located within the US 421/Michigan Road Overlay Zone. This petition is paired with Item 3h. (Docket No. 73-00 DP/ADLS). This item has been carried over from the December 21, 1999 and January 18, 2000, Plan Commission agendas at the petitioner's request. At the petitioner's request and with the Plan Commission's approval, this item was continued a third time from the February 15, 2000 agenda to the April 18, 2000, Plan Commission meeting. This item was further tabled to the May 16th meeting in order for the public hearing on Docket No. 73-00 DP/ADLS to be held at the same meeting. The Department recommends that this item be heard with Item 3h. (Docket No. 73-00 SPthe Board of Zoning Appeals May 22nd for public hearing on two Special Use petitions and twelve Developmental Standards Variance petitions.
