Thomas A.Whitsitt,and submit to the Court the following Agreed Judgment of Forfeiture
and Order on Disbursement of Assets:
1. Plaintiff filed its Complaint for Forfeiture on the 20 July 2016,seeking forfeiture of
$7,274 in U.S.Currency under Ind. Code§34-24-1-1,et seg.
2. Whereas,the Defendant,while not admitting to any of the material facts alleged in
Plaintiffs'Complaint,is desirous to resolve all civil disputes and enter into an Agreed
Judgment of Forfeiture under these terms.
3. Whereas,Thomas A.Whitsitt is Defendant's counsel and is authorized to enter into this
Agreed judgment of Forfeiture and Order on Disbursement of Assets on behalf of
Defendant,Kurtis Woods,and J.Kent Minnette is counsel of record for Plaintiff and has
full authority to enter into this Agreed Judgment of Forfeiture.
4. Whereas,under the contract entered into with the Boone County Prosecutor's Office,
attorney,J.Kent Minnette,is entitled to one-third attorney's fees of all property seized
and forfeited in Hamilton County,Indiana.
5. Whereas,in order to resolve the issues in this cause to each party's mutual satisfaction,in
return for an Agreed Judgment of Forfeiture for the remaining property seized herein,
Plaintiffs agree to return to Woods through ids designated'agent or appointee,$3,000 of
the original monies seized herein from the Defendant in Boone County,Indiana. The
remaining monies seized in the amount of$4,274 in U.S. Currency,by agreement,shall
be forfeited to Plaintiff
6. The Hamilton/Boone County Drug Task Force incurred law enforcement costs that
exceed the amount of the Agreed Judgment in this matter.See Affidavit-of Law
Enforcement Costs attached as$xbib#A.
The Court therefore orders,adjudges and decrees:
I., That as agreed judgment be granted and forfeiture of the sum of$4,274 is declared,the
sum of$4,274 is forfeited of which,$2,850 will be paid to Hamilton/Boone County.
Drug Task Force as reimbursement for costs of law enforcement incurred herein and
the remaining sum of$1,424 shall be paid to J.Kent Minnette as attorney's fees.
2. The sum of$3,000 in U.S.Currency seized herein shall be paid to the Defendant,Kurds
Woods,through his designated agent or appointee in satisfaction of this Agreed
Judgment of Forfeiture.
3. The Hamilton Boone County Drug Task Force and/or Hamilton County Sheriff's
Dep is o odejed to release and disburse said funds.
