03-06-17 CC Meeting' COMMON COUNCIL MEETING MINUTES MONDAY, MARCH 6, 2017 - 6:00 P.M. COUNCIL CHAMBERS/CITY HALL/ONE CIVIC SQUARE MEETING CALLED TO ORDER Council President Sue Finkam; Council Members: Anthony Green, Kevin D. Rider, Jeff Worrell, Laura Campbell and Deputy Clerk Jacob Quinn were present. Councilors Ronald E. Carter and H. Bruce Kimball were not present Council President Finkam called the meeting to order at 6:01 p.m. INVOCATION Pastor Stuart Lawrence, Fellowship in Christ Church, delivered the Invocation. Councilor Rider led the Pledge of Allegiance. RECOGNITION OF CITY EMPLOYEES AND OUTSTANDING CITIZENS There were none. APPROVAL OF MINUTES Councilor Rider moved to approve minutes from the February 20, 2017 Regular Meeting. Councilor Green seconded. There was no Council discussion. Council President Finkam called for the vote. Minutes were approved 4-0 (Campbell abstained). RECOGNITION OF PERSONS WHO WISH TO ADDRESS THE COUNCIL Ron Ogle spoke in favor of D-2356-17, but perhaps the $100 fine might be too high. He also stated the need for a campaign to educate residents on roundabouts. Eric Morris spoke in opposition to the annexation of Home Place. Bianca Zaklikowski, Mobilitie LLC, spoke about concerns with the height standards and the separation distance outlined in D-2355-17. COUNCIL AND MAYORAL COMMENTS/OBSERVATIONS Councilor Worrell commented that Carmel has multiple students in the State Finals Spelling Bee. Council President Finkam wished Amber Seaman from Carmel good luck at the Olympic Trials for Volleyball. ACTION ON MAYORAL VETOES There were none. CLAIMS Councilor Rider moved to approve Payroll in the amount of $1,610,226.68. Councilor Green seconded. There was no Council discussion. Council President Finkam called for the vote. Payroll was approved 5- 0. Councilor Rider moved to approve General Claims in the amount of $2,980,163.72. Councilor Campbell seconded. There was no Council discussion. Council President Finkam called for the vote. Claims were approved 6-0. COMMITTEE REPORTS Councilor Rider announced that the Finance, Utilities and Rules Committee had met and the reports would be given when the items appear on the agenda. Councilor Green announced that the Land Use and Special Studies Committee had not met. OTHER REPORTS Corrie Meyer, Director of the Carmel Redevelopment Commission, gave the monthly report to Council. OLD BUSINESS Council President Finkam announced the Second Reading of Ordinance D-2348-17; An Ordinance of the Common Council of the City of Carmel, Indiana, Authorizing the Issuance of One or More Series of City of Carmel, Indiana Taxable Economic Development Lease Rental Revenue Bonds (Midtown West Project), Lending the Proceeds Thereof to the Borrower Thereof, Approving a Lease Between the City of Carmel Midtown Building Corporation, As Lessor, and the City of Carmel Redevelopment Commission and Midtown Capital Partners, LLC or an Affiliate Thereof, As Co -Lessees, and Authorizing and Approving Other Actions Related Thereto. Councilor Rider reported that this item is coming back from the Finance, Utilities and Rules Committee with a positive 2-0 recommendation. Councilor Rider moved to approve Ordinance D-2348-17. Councilor Worrell seconded. Councilor Green asked Corrie Meyer a series of questions related to the project. Corrie Meyer presented to Council. Council President Finkam called for the vote. Ordinance D-2348-17 was approved 5-0. Council President Finkam announced the Second Reading of Ordinance D-2349-17; An Ordinance of the Common Council of the City of Carmel, Indiana, Authorizing the Issuance of the City of Carmel, Indiana Economic Development Revenue Bonds, Series 2017 (Monon apartment L.L.C. Project), and Authorizing and Approving Other Actions in Respect Thereto. Councilor Rider reported that this item is coming back from the Finance, Utilities and Rules Committee with a positive 2-0 recommendation. Councilor Rider moved to approve Ordinance D-2349-17. Councilor Worrell seconded. There was brief Council discussion. Council President Finkam called for the vote. Ordinance D-2349-17 was approved 5-0. 2 Council President Finkam announced the Second Reading of Ordinance D-2350-17; An Ordinance of the Common Council of the City of Carmel, Indiana, Authorizing and Approving an Additional Appropriation of Funds from the Operating Balance of the General Fund to the Clerk -Treasurer's Budget. Council Rider presented the item to Council. Councilor Rider moved to approve Ordinance D-2350-17. Councilor Green seconded. There was brief council discussion. Linda Harvey, Chief Deputy Clerk - Treasurer, addressed the need for the money to Council. Council President Finkam called for the vote. Ordinance D-2350-17 was approved 5-0. Council President Finkam announced the Second Reading of Ordinance D-2352-17; An Ordinance of the Common Council of the City of Carmel, Indiana, Amending Chapter 2, Article 4, Section 2-102 of the Carmel City Code. Councilor Rider reported that this item is coming back from the Finance, Utilities and Rules Committee with a positive 2-0 recommendation and proposed amendments. Councilor Rider moved to amend Ordinance D-2352-17 by inserting Version A in whole. Councilor Campbell seconded. There was no council discussion. Council President Finkam called for the vote. NEW BUSINESS Council President Finkam announced Resolution CC -03-06-17-01; A Resolution of the Common Council of the City of Carmel, Indiana Approving CRC Installment Purchase Contract. Council President Finkam referred the item to the Finance, Utilities and Rules Committee Council President Finkam announced the First Reading of Ordinance D-2355-17; An Ordinance of the Common Council of the City of Carmel, Indiana Adding Section 6-162 of Chapter 6, Article 5, Division VIII to the Carmel City Code. Councilor Rider moved to introduce. Councilor Worrell seconded. Ashley Ulbricht, City Attorney, presented the item to Council. There was extensive Council discussion.
