BPW 01-17-18-19 RESOLUTION OF THE CITY OF CARMEL BOARD OF PUBLIC WORKS AND SAFETY ACKNOWLEDGING ARTS GRANT WHEREAS, pursuant to Indiana Code 36-1-4-7, the City of Carmel, Indiana ("City"), is authorized to enter into contracts; and WHEREAS, pursuant to Indiana Code 36-4-5-3, the City's mayor may enter into contracts on behalf of the City; and WHEREAS, pursuant to his authority under Indiana law, the City's mayor, the Honorable James C. Brainard, has caused to be signed the Arts Grant attached hereto as Exhibit A (the "Contract"); and WHEREAS, Mayor Brainard now wishes to present the contract to the City's Board of Public Works and Safety for it to be publicly acknowledged, filed in the Clerk -Treasurer's Office, and made available to the public for review. follows: NOW, THEREFORE, BE IT RESOLVED by the City of Carmel Board of Public Works and Safety as 1. In consideration of those mutual undertakings and covenants, the parties agree as follows: 1. That on behalf of Grantee, a not-for-profit corporation, I, 8 o .y s4e- Wj , an authorized representative of Grantee, have applied for a City of Carmel ("Grantor") Arts Grant, said application attached hereto and made a part hereof as Exhibit "A." 2. Grant Agreement. The City, after review and recommendation by the Mayor and by the City Council, agrees to grant $ 6 , 5 0 0.0 0 to the Grantee for the eligible costs of the project (the "Project") or services as described in Exhibits "A" and `B" of this Agreement. The funds shall be used exclusively in accordance with the provisions contained in this Agreement. 3. Design and Implementation of Project. The Grantee agrees to use any and all grant funds in accordance with the proposal contained within this agreement and any documents attached to this Agreement, which are incorporated by reference. 4. Warranty of non-profit status. Grantee hereby represents and warrants that it is a not-for-profit entity with a determination letter from the Internal Revenue Service declaring that it is exempt from Federal income tax. Payment of Grant Funds by the City. The payment of this Grant by the City to the Grantee shall be made in accordance with the following conditions: A. This Agreement must be fully executed and signed by both Grantee and Grantor. B. Grantee has attached all the following information, which it represents and warrants to be true and accurate, all which have been incorporated fully by reference: 1. An application and description of the proposed use of the grant funds (EXHIBIT A); 2. A budget for the calendar or fiscal year for which the grant is requested (EXHIBIT B); 3. Certified copies of incorporation as a not-for-profit corporation under state law (EXHIBIT C); 4. A not-for-profit application or determination letter from the U.S. Internal Revenue Service identifying that it is a not-for-profit corporation that is exempt from Federal income tax (EXHIBIT D); 5. Any audits, reviews or compilations available describing the financial condition of the Grantee, including most recent available IRS Form 990, and the attached Affidavit (EXHIBIT E); 6. A list of the Grantee's board of directors and officers listed (EXHIBIT F); 7. A Year End Report from the previous year IF Grantee received an Arts Grant from the City of Carmel in the previous calendar year, pursuant to paragraph 8 herein (EXHIBIT G). C. Any other grant conditions that City requires to be met by Grantee, specifically: 6. Grantor's right to request audit or review. Grantee shall submit to an audit or review by an independent Certified Public Accountant of funds at the City's request, and shall make all books, accounting records and other documents available at all reasonable times during the term of this Grant Agreement, and for a period of three (3) years after final payment of funds under this Agreement, for the purpose of an audit by the City of Carmel, the State of Indiana, or their designees. 7. Quarterly financial statements. Grantee agrees to provide the City of Carmel quarterly financial statements within 45 days after each quarter -end for Grant awards in excess of sixty thousand dollars ($60,000). 2 8. Year-end review. Grantee agrees to provide the City of Carmel a year-end report ("Year End Report") for each year, describing how the grant was used and the impact of the dollars received. This Grant award may not exceed one third (1/3) of Grantee's combined contributed income, revenue of sales, and/or ticket revenue from the previous year. If the Grant amount is in excess of sixty thousand dollars ($60,000.00), the Grantee agrees to provide, at Grantee's cost, a review or audit of the grantee. Said review or audit shall be performed by a Certified Public Accountant ("CPA") who is neither an employee of Grantee nor a member of the Grantee's Board of Directors, to be provided to the City of Carmel by March 31 of the following year. 9. Funding Credit. Grantee agrees to credit the City of Carmel in the printed materials associated with a funded program or project. The City of Carmel will supply, upon request, Grantee with the graphics/logos necessary for compliance. 10. Statutory Authority of Grantee. The Grantee expressly represents and warrants to the State that it is statutorily eligible to receive these monies and it expressly agrees to repay all monies paid to it under this Grant, should a legal determination of its ineligibility be made by any Court of competent jurisdiction. 11. Use of Grant Funds by Grantee. The funds received by the Grantee pursuant to this Agreement shall be used only to implement the Project or provide the services in conformance with the Budget and for no other purpose. If it is determined by the City that misappropriation of funds have occurred, the Grantee must return all funds received by Grantor and individuals who misuse Grant funds may also be subject to civil and/or criminal liability under Indiana or Federal law. 12. Employment Eligibility Verification. The Grantee affirms under the penalties of perjury that he/she/it does not knowingly employ an unauthorized alien. The Grantee affirms under the penalties of perjury that he/she/it has enrolled and is participating in the E -Verify program as defined in IC 22-5-1.7. The Grantee agrees to provide documentation to the City that he/she/it has enrolled and is participating in the E -Verify program. The City may terminate for default if the Grantee fails to cure a breach of this provision no later than thirty (30) days after being notified by the State. 13. Governing Law; Lawsuits. This Agreement is to be construed in accordance with and governed by the laws of the State of Indiana, except for its conflict of laws provisions. The parties agree that, in the event a lawsuit is filed hereunder, they waive their right to a jury trial, agree to file any such lawsuit in an appropriate court in Hamilton County, Indiana only, and agree that such court is the appropriate venue for and has jurisdiction over same. 3 14. Relationship of Parties. The relationship of the parties hereto shall be as provided for in this Agreement, and neither Grantee nor any of its compensated officers, employees, contractors, subcontractors and/or agents are employees of City. The Grant amount set forth herein shall be the full and maximum compensation and monies required of City to be paid to Grantee under or pursuant to his Agreement. 15. Severability. If any term of this Agreement is invalid or unenforceable under any statute, regulation, ordinance, executive order or other rule of law, such term shall be deemed reformed or deleted, but only to the extent necessary to comply with same, and the remaining provision of this Agreement shall remain in full force and effect. 16. Entire Agreement. This Agreement, together with any exhibits attached hereto or referenced herein, constitutes the entire agreement between Grantee and City with respect to the subject matter hereof, and supersedes all prior oral or written representations and agreements regarding same. Notwithstanding any other term or condition set forth herein, but subject to paragraph 15 hereof, to the extent any term or condition contained in any exhibit attached to this Agreement or in any document referenced herein conflicts with any term or condition contained in this Agreement, the term or condition contained in this Agreement shall govern and prevail. This Agreement may only be modified by written amendment executed by both parties hereto, or their successors in interest. By Pri Tit Date: (Additional pages may be added to Exhibit "A") 5 INDIANAPOLIS CHILDREN'S CHOIR 2018 CITY OF CARMEL ARTS GRANT PROGRAM APPLICATION SUPPLEMENTARY NARRATIVE December 1, 2017 REQUEST The Indianapolis Children's Choir (ICC) and the City of Carmel have a shared vision for the importance of the arts and its positive impact on our community. The ICC respectfully requests a $7,500 grant from the City of Carmel 2018 Arts Grants program in support of the vital music education programs provided by the ICC in the City of Carmel, in Hamilton County, and for the children, youth, and families who reside in Carmel and in Hamilton County. The ICC is grateful for the funding received for 2017, 2016, 2015, and 2014 and appreciates the City of Carmel's consideration of our 2018 application. This supplementary narrative is presented in support of that application. ABOUT THE INDIANAPOLIS CHILDREN'S CHOIR The Indianapolis Children's Choir believes that the pursuit of artistic excellence is a vehicle for the growth of happier, healthier, and more successful young people. The singers in the ICC are at an age when they are discovering who they are and what they can be — and as they see the positive impact of their music, they learn the value of discipline, forge lasting friendships, and develop a sense of civic pride and a desire to contribute to the community. The mission of the Indianapolis Children's Choir is to nurture and inspire student achievement through quality music education and the pursuit of artistic excellence in choral music performance. The ICC pursues its mission through the following core values: • Personal and Social Growth — Foster leadership, accomplishment, self-worth, teamwork, pride, and appreciation of music among singers, parents/guardians, and audience members • Diversity, Accessibility, and Safety — Enrich the lives of children from all religious, racial, cultural, and economic backgrounds. Never compromise the safety and security of our singers • Creativity and Excellence — Strive to lead locally, nationally, and internationally and to pursue excellence in quality music education for singers and for teachers Indianapolis Children's Choir 2018 City of Carmel Arts Program Request Supplementary Narrative — page 2 of 6 The Indianapolis Children's Choir is recognized internationally for the artistic accomplishments of its singers and celebrated locally as an integral part of the cultural fabric of central Indiana. The ICC is one of the most established, comprehensive, and respected children's choral programs in the world; encompassing children from 18 months to 18 years of age, and bringing singers together from a wide range of cultural and socioeconomic backgrounds, and from more than 20 counties in Indiana. ICC performance choirs create a beautiful musical experience that moves and inspires audiences. In addition, children and youth who participate in the ICC's programs gain increased cultural awareness through opportunities to tour and perform state-wide, nationally, and globally. In these choirs, repertoire includes dozens of languages, styles of music, and formats to expose singers to a plethora of musical genres and pieces. The Indianapolis Children's Choir offers a full season of concert performances that feature inspiring musical experiences while providing choir members with the satisfaction of achieving their artistic goals and the thrill of performing before a live audience. The annual Season Concert Series includes public performances attended by more than 10,000 people each year. The impact of the ICC extends beyond its choirs — the organization serves more than 5,000 young people each year through a range of music education offerings. Through the Everyone COUNTS (Community Outreach Uniting and Nurturing Through Song) initiative, the ICC serves those who might otherwise not have access to music education and ICC programs. Everyone COUNTS outreach impacts approximately 4,000 children each year with initiatives that include Tuition Assistance, which provides need -based direct financial aid to qualifying families; Early Childhood Music Education, which serves children age 18 months through kindergarten; Regional Choirs, which make participation in ICC choirs more accessible to families residing in the metropolitan and rural communities outside of Indianapolis; Neighborhood Choir Academy, which offers eight-week after school choral singing experiences, that culminate with participation in an ICC Concert Series performance; Special Needs Programs, which engage children of all abilities; and Innovations, which offers complimentary services and resources for music teachers and schools through free workshops, choir clinics, guest conducting, and other requested professional development activities. Indianapolis Children's Choir 2018 City of Carmel Arts Program Request Supplementary Narrative — page 3 of 6 MUSIC EDUCATION BENEFITS The exceptional artistic product of ICC singers is only one dimension of the organization's impact; the benefits of music education extend beyond the development of artistic skills. A growing and compelling body of research indicates that participation in music education programs is essential for the growth and development of children and has a profoundly positive impact on school attendance, academic achievement, graduation rates, interpersonal relationships, and communication skills. The National Association for Music Education reports that "students in strong music programs have better school attendance and higher graduation rates" and that "students who were significantly involved in music during middle and high school showed higher levels of math proficiency by their senior year regardless of socioeconomic status". In addition, findings from the National School Readiness Indicators Initiative demonstrate that: • Music helps children expand vocabulary, acquire an understanding of symbols and sequence, and improve memory and auditory function. • Early childhood curricula that integrate a structured music program can help children to develop and understand verbal and musical language, express feelings and emotions in a creative manner, and work well with others • Quality music programs help children develop their gross and fine motor skills, which are important to emotional expression, particularly in children with limited verbal/oral ability Through the arts, children discover how to participate in their own way, to tell their own stories and find a voice, and to learn about themselves; as a result, they find that their stories matter, that their artistic product contributes to the greater community — and they develop confidence and a sense of purpose. In addition, the arts fulfill a fundamental human need for beauty, and they are a pathway to express and process emotions. Children who participate in the arts have a means to release stress in a productive way, and they have greater happiness and mental health. Indianapolis Children's Choir 2018 City of Carmel Arts Program Supplementary Narrative — page 4 of 6 THE ICC IN THE CITY OF CARMEL AND IN HAMILTON COUNTY Based on the campus of Butler University, the Indianapolis Children's Choir, the ICC has a strong — and growing — presence in Carmel and throughout Hamilton County. Beginning with an Early Childhood music education program available to children as young as 18 months and culminating with the ICC's internationally acclaimed high school choirs, opportunities are available for young people of all ages and abilities. ICC Early Childhood Program The ICC offers its Early Childhood Program to children ages 18 months through kindergarten. This music education program utilizes the First Steps in Music curriculum to develop singing, vocabulary, and movement skills, while, at the same time, nurturing a love of music and singing. Children learn informally by playing with music through a series of carefully designed games and activities. The program offers unique introductory music experiences to children earlier in life than formal education is available, and multiple studies affirm the importance of introducing musical concepts at a very young age. The ICC offers its Early Childhood Program at the Carmel Campus of Cornerstone Lutheran Church as well as on the campus of Butler University and at other locations throughout central Indiana. ICC Preparatory Choir Program The ICC's Preparatory Choir Program is a non -auditioned experience for children in grades one through three. Participants are introduced to choral music and singing techniques such as music reading, breathing, posture, and movement in an atmosphere that combines learning with fun. The program is provided in a rehearsal setting to help prepare the singers for a formal choir experiences. In addition, Preparatory Choir members participate in select ICC Concert Series performances and at local and regional community events. In Carmel, the ICC offers its Preparatory Choir Program at the Carmel Campus of Cornerstone Lutheran Church. There is an additional Hamilton County Preparatory Choir Program at the Fishers Campus of Cornerstone Lutheran Church, and the program is also available on the campus of Butler University and at other locations throughout central Indiana. Indianapolis Children's Choir 2018 City of Carmel Arts Program Supplementary Narrative — nage 5 of 6 Carmel Children's Choir and Fishers Children's Choir In order to make participation in the Indianapolis Children's Choir more conveniently accessible to families residing communities surrounding Indianapolis, including Carmel, the ICC has established affiliate regional choirs. The Carmel Children's Choir is one of the organization's strongest and most rapidly growing regional choirs. Children in grades four through seven benefit from the ICC choral experience through weekly rehearsals, participation in select ICC Concert Series performances, and singing at local and regional community events. The choir rehearses at the Carmel Campus of Cornerstone Lutheran Church under the leadership of ICC Director of Outreach and Choir Programs Lauren Southard. In addition to the Carmel Children's Choir, the ICC also offers the Fishers Children's Choir, which rehearses at the Fishers Campus of Cornerstone Lutheran Church and is also directed by Lauren Southard. ICC Campus Choirs Carmel children and youth in grades four through nine may also choose to join choirs that rehearse on the campus of Butler University. Each student is placed in a choir based on ability and experience. Beginning level choirs rehearse weekly and include students who exhibit a strong desire to sing and have demonstrated an intermediate proficiency in vocal technique. The more advanced choirs rehearse twice weekly and include students who have demonstrated a high degree of vocal and sight-reading ability. The ICC also has two high school choirs that include students who have successfully auditioned. Performance HiMights Members of the Carmel Children's Choir, Fishers Children's Choir, Carmel and Fishers Preparatory Choirs, and other ICC performance choirs have multiple opportunities to perform in Carmel, Indianapolis, throughout Indiana, across the country, and, for singers in advanced choirs, throughout the world. These concerts provide quality musical artistry to the audience and, give singers the affirmation that comes with achieving the highest level of excellence and expression, as well as introducing them to a variety of cultures.
