EETING CALLED TO ORDER Council President Sue Finkam; Council Members: Kevin D. Rider, Ronald E. Carter, Anthony Green, Jeff Worrell, Kevin D. Rider, Laura Campbell, H. Bruce Kimball and Clerk -Treasurer Christine Pauley were present. Council President Finkam called the meeting to order at 6:01 p.m. INVOCATION Pastor Jason Kandel, Harvest Bible Chapel - North, delivered the Invocation. Council President Finkam led the Pledge of Allegiance. RECOGNITION OF CITY EMPLOYEES AND OUTSTANDING CITIZENS There were none. APPROVAL OF MINUTES Councilor Rider moved to approve minutes from the October 16, 2017 Regular Meeting. Councilor Campbell seconded. There was no Council discussion. Council President Finkam called for the vote. Minutes were approved 7-0. RECOGNITION OF PERSONS WHO WISH TO ADDRESS THE COUNCIL Brett Henk, Autumn Lake HOA President, spoke in opposition to the proposed Duke Energy project for the transmission lines along Rohrer Road. Amanda Cross, Autumn Lake HOA Secretary, spoke in opposition to the proposed Duke Energy project for the transmission lines along Rohrer Road. Sue Dillon spoke in opposition to the proposed Duke Energy project for the transmission lines along Rohrer Road. Eric Morris addressed Council regarding Resolution CC -06-17-02-01 and Ordinance D-1632-03 inquiring if the Board of Public Works is allowed to enter into Interlocal Agreements. COUNCIL AND MAYORAL COMMENTS/OBSERVATIONS Councilor Rider agreed with the comments from the public regarding the Duke Energy project and encouraged them to contact state legislators. Councilor Kimball also encouraged citizens to contact state legislators. Councilor Carter commented that they may bring to Council at the next meeting an ordinance that would give them a little more control over Duke Energy. Councilor Worrell echoed what other Councilors had stated. Council President Finkam announced that the city is having a Veteran's Day service. She added that Holiday on the Square would be on the 18th of November. Councilor Finkam moved to add ordinance D-2395-17, D-2396-17 and Resolution CC -11-06-17-02 to Section 14 Other Business. Without objection from Council, the items were added. ACTION ON MAYORAL VETOES There were none. CLAIMS Councilor Campbell moved to approve Payroll in the amount of $2,477,355.13 and $2,452,254.87. Councilor Kimball seconded. There was no Council discussion. Council President Finkam called for the vote. Payroll was approved 7-0. Councilor Rider moved to approve General Claims in the amount of $2,942,473.20. Councilor Campbell seconded. There was no Council discussion. Council President Finkam called for the vote. Claims were approved 7-0 Councilor Rider moved to approve Retirement in the amount of $94,494.65. Councilor Campbell seconded. There was no Council discussion. Council President Finkam called for the vote. Payroll was approved 7-0. COMMITTEE REPORTS Councilor Rider reported that the Finance, Utilities and Rules Committee had not met. Councilor Kimball reported that the Land Use and Special Studies Committee had met and that Z-626-17 was returning with a 2-1 negative recommendation. OTHER REPORTS — (at the first meeting of the month specified belmv): Michael Frischkorn, Deputy Director of the Carmel Redevelopment Commission, gave the monthly report. Jim Longstreth gave the quarterly report for the Economic Development Commission. Arnie Hanish presented the quarterly report for the City of Carmel Audit Committee. Winston Long presented the bi-annual report for the Carmel Cable and Telecommunications Commission. 0 OLD BUSINESS Councilor President Finkam announced the Second Reading of Ordinance Z-626-17; An Ordinance of the Common Council of the City of Carmel, Indiana, Establishing the College & 116 Planned Unit Development District. Councilor Kimball announced that this item is returning from the Land Use and Special Studies Committee with a negative 2-1 recommendation. Councilor Kimball addressed Council. Alexia Lopez, Department of Community Services, presented to Council. Jim Shinaver, Nelson and Frankenburger, addressed Council. Ashley Ulbricht, City Attorney, addressed Council. Councilor Green moved to amend Ordinance Z-626-17 by adding in an extension of a 10 foot fence, adding in a restrictive covenant that no homes can be rented for the first 12 months of ownership, and adding in a credit for blinds for the third window. There was no second. The motion was withdrawn. Councilor Rider moved to approve Ordinance Z-626-17. Councilor Carter seconded. There was brief Council discussion. Council President Finkam called for the vote. Ordinance Z-626-17 was approved 6-1 (Green opposed). PUBLIC HEARINGS Councilor President Finkam announced the First Reading of Ordinance D-2392-17; An Ordinance of the Common Council of the City of Carmel, Indiana, Authorizing and Approving an Additional Appropriation of Funds From the General Fund #101 to the Building Operations Fund #1208. Councilor Worrell moved to introduce the item into business. Councilor Rider seconded. Jim Crider, Director of the Department of Administration, presented the item to Council. Council President Finkam opened the public hearing at 7:53 p.m. Seeing no one who wished to address Council, Council President Finkam closed the public hearing at 7:53:30. Councilor Rider moved to suspend the rules and act on the item this evening. Councilor Carter seconded. There was no Council discussion. Council President Finkam called for the vote. The motion was approved 7-0. Councilor Carter moved to approve Ordinance D-2392-17. Councilor Kimball seconded. There was no Council discussion. Council President Finkam called for the vote. Ordinance D- 2392-17 was approved 7-0. Councilor Finkam recessed the meeting at 7:54 p.m. Councilor Finkam reconvened the meeting at 8:01 p.m. NEW BUSINESS Councilor President Finkam announced Resolution CC -11-06-17-01; A Resolution of the Common Council of the City of Carmel, Indiana, Approving a Transfer of Funds From the 2017 Carmel Administration Budget to the 2017 Carmel Building Operations Budget. Councilor Rider moved to introduce the item into business. Councilor Carter seconded. Jim Crider presented the item to Council. Councilor Carter moved to approve Resolution CC -I 1-06-17-01. Councilor Kimball seconded. There was no Council discussion. Council President Finkam called for the vote. Resolution CC -11-06-17-01 was approved 7-0. Councilor President Finkam announced the First Reading of Ordinance D-2393-17; An Ordinance of the Common Council of the City of Carmel, Indiana, To Reallocate 2017 Rate Cap Credits Among Funds. Councilor Carter moved to introduce the item into business. Councilor Kimball seconded. Council President Finkam presented the item to Council. Councilor Rider moved to suspend the rules and act on 3 the item this evening. Councilor Carter seconded. There was no Council discussion. Council President Finkam called for the vote. Councilor Rider moved to introduce the item into business. Councilor Carter seconded. Jim Crider presented the item to Council. Councilor Rider moved to hold the item over until the next meeting. The motion was approved 7-0 Councilor President Finkam announced the First Reading of Ordinance D-2395-17; An Ordinance of the Common Council of The City of Carmel, Indiana Adding Chapter 6, Article 9, Section 6-245 to the Carmel City Code. Councilor Rider moved to introduce the item into business. Councilor Carter seconded. Jon Oberlander, Assistant City Attorney, presented the item to Council. Ashley Ulbricht addressed Council.
