COUNCIL CHAMBERS/CITY HALL/ONE CIVIC SQUARE MEETING CALLED TO ORDER Council President Sue Finkam; Council Members: Kevin D. Rider, Ronald E. Carter, Anthony Green, Jeff Worrell, Kevin D. Rider, Laura Campbell, H. Bruce Kimball and Deputy Clerk Jacob Quinn were present. Council President Finkam called the meeting to order at 6:00 p.m. INVOCATION Pastor Kurt Lawson, First Baptist Church, delivered the Invocation. Council President Finkam led the Pledge of Allegiance. RECOGNITION OF CITY EMPLOYEES AND OUTSTANDING CITIZENS Nancy Chance, Good Samaritan Network, presented plaques to the Carmel Police FOP and the Carmel Fire Department for their continued support of the organization. APPROVAL OF MINUTES Councilor Rider moved to approve minutes from the October 2, 2017 Regular Meeting. Councilor Campbell seconded. There was no Council discussion. Council President Finkam called for the vote. Minutes were approved 7-0. RECOGNITION OF PERSONS WHO WISH TO ADDRESS THE COUNCIL There were none. COUNCIL AND MAYORAL COMMENTS/OBSERVATIONS Councilor Worrell announced about the launch of Carmel Tech Connect. Councilor Rider noted that the Carmel Symphony Orchestra is top notch. Councilor Carter announced that the Winter's Farmer Market is opening up the following weekend. Council President Finkam congratulated Mayor Brainard on a successful State of the City address and announced that City Council Meetings for November and December would be taking place at the school board meeting room. Mayor Brainard announced that Carmel was named the most livable city by 24/7 Wall Street. Councilor Rider moved to add Ordinance D-2382-17 to the agenda under 13(a). Councilor Campbell seconded. There was no Council discussion. Council President Finkam called for the vote. The motion to add-on was approved 7-0. ACTION ON MAYORAL VETOES There were none. CLAIMS Councilor Rider moved to approve Payroll in the amount of $2,471,632.40. Councilor Green seconded. There was no Council discussion. Council President Finkam called for the vote. Payroll was approved 7- 0. Councilor Rider moved to approve General Claims in the amount of $4,037,780.69. Councilor Kimball seconded. There was no Council discussion. Council President Finkam called for the vote. Claims were approved 7-0 Councilor Rider moved to approve Retirement in the amount of $94,494.65. Councilor Campbell seconded. There was no Council discussion. Council President Finkam called for the vote. Payroll was approved 7-0. Councilor Rider moved to acknowledge Wire Transfers iri the amount of $1,139,558.96. Councilor Campbell seconded. There was no Council discussion. Council President Finkam called for the vote. Wire Transfers were acknowledged 7-0 COMMITTEE REPORTS Councilor Rider reported that the Finance, Utilities and Rules Committee had not met. Councilor Kimball reported that the Land Use and Special Studies Committee had met and that the report would be given when the item appears on the agenda. OTHER REPORTS Sam Burgess, Carmel Historic Preservation Commission, gave the quarterly report to council. Councilor Finkam passed the gavel to Councilor Rider. OLD BUSINESS Councilor Rider announced the Third Readiniz of Ordinance D-2385-17; An Ordinance of the Common Council of the City of Carmel, Indiana, Amending Chapter 8, Article 5, Section 8-29 of the Carmel City Code; Sponsor: Councilor Kimball. Councilor Kimball announced this item is returning from the Land Use and Special Studies Committee with a positive 3-0 recommendation. Jeremy Kashman, City Engineer, presented to Council. Councillor Finkam regained the gavel. 2 Councilor Rider moved to approve Ordinance D-2385-17. Councilor Carter seconded. There was no Council discussion. Council President Finkam called for the vote. Ordinance D-2385-17 was approved 7- 0. Council President Finkam announced the Third Reading of Ordinance Z-625-17; An Ordinance of the Common Council of the City of Carmel, Indiana, Adopting a Unified Development Ordinance. Adrienne Keeling, Department of Community Services, presented to Council. Councilor Kimball announced that this ordinance is returning from the Land Use and Special Studies Committee with a positive 3-0 recommendation. Councilor Rider moved to amend Ordinance Z-625-17 by making its effective date as January 1, 2018. Councilor Carter seconded. There was no Council discussion. Council President Finkam called for the vote. The motion to amend was approved 7-0. Councilor Rider moved to approve Ordinance Z-625-17 As Amended. Councilor Worrell seconded. Council President Finkam announced the Second Reading of Ordinance D-2386-17; An Ordinance of the Common Council of the City of Carmel, Indiana, Authorizing the Issuance of the City of Carmel, Indiana Taxable Economic Development Revenue Bonds, Series 2017 (Indiana Spine Group II Project) and Authorizing and Approving Other Actions in Respect Thereto. Bruce Donaldson, Barnes and Thornburg, presented to Council. Councilor Rider moved to amend Ordinance D-2386-17 by inserting on line 58, Section 2 after "approved", on the condition that the taxpayer at the site of the Projects agrees not to appeal its assessed value below an amount that will provide two hundred percent (200%) coverage of tax increment over annual debt service on the Bonds. Councilor Worrell seconded. There was no Council discussion. Council President Finkam called for the vote. The motion to amend was approved 7- 0. Council President Finkam announced the Second Reading of Ordinance D-2379-17; An Ordinance of the Common Council of the City of Carmel, Indiana, Fixing Salaries of Appointed Officers and Employees of the Clerk -Treasurer, City of Carmel, Indiana, for the year 2018. Councilor Rider moved to approve ordinance D-2379-17. Councilor Campbell seconded. There was no Council discussion. Council President Finkam called for the vote. Ordinance D-2379-17 was approved 7-0. Council President Finkam announced the Second Reading of Ordinance D-2380-17; An Ordinance of the Common Council of the City of Carmel, Indiana, Fixing Salaries of Appointed Officers and Employees of the Carmel City Court for the year 2018. Councilor Rider moved to approve ordinance D- 2380-17. Councilor Campbell seconded. There was no Council discussion. Council President Finkam called for the vote. Ordinance D-2380-17 was approved 7-0. Council President Finkam announced the Second Reading of Ordinance D-2381-17; An Ordinance of the Common Council of the City of Carmel, Indiana, Fixing Salaries of Appointed Officers and Employees of the City of Carmel, Indiana, for the year 2018. Councilor Rider moved to amend Ordinance D-2381-17 on page 3 by adding in Community Liaison Officer on line 131 with a bi-weekly salary of $2120.62. Councilor Worrell seconded. There was no Council discussion. Council President Finkam called for the vote. The motion to amend was approved 7-0. Councilor Rider moved to approve Ordinance D-2381-17 As Amended. Mayor Brainard presented the item to Council.; There was extensive Council discussion. Clerk - Treasurer Christine Pauley addressed Council.. Councilor Rider moved to approve Ordinance D-2383-17. PUBLIC HEARINGS Council President Finkam announced the First Reading of Ordinance Z-626-17; An Ordinance of the Common Council of the City of Carmel, Indiana, Establishing the College & 116th Planned Unit Development District. Councilor Ride moved to introduce the item into business. Councilor Carter seconded. Councilor Kimball addressed Council. Jim Shinaver, Nelson and Frankenberger, presented the item to Council. Alexia Lopez, Department of Community Services, presented to Council. Council President Finkam opened the public hearing at 6:52 p.m. Tom Born spoke in opposition to the proposed ordinance. Catherine Born spoke in opposition to the proposed ordinance. Ed Evans spoke in opposition to the proposed ordinance. Tom Brandenburg spoke in opposition to the proposed ordinance. NEW BUSINESS Council President Finkam announced the First Reading of Ordinance D-2382-17; An Ordinance of the Common Council of the City of Carmel, Indiana, Fixing Salaries of Elected Officials of the City of Carmel, Indiana, for the Year 2018. Councilor Rider moved to introduce the item into business. Councilor Campbell seconded. Councilor Rider presented the item to Council. Councilor Carter addressed Council stating that he wished he could have gotten a higher salary for the Mayor. Mayor Brainard thanked Council for the proposal as presented. Councilor Rider moved to suspend the rules and act on the item this evening. Councilor Kimball seconded. There was no Council discussion. Council President Finkam called for the vote. Council President Finkam announced the First Reading of Ordinance D-2389-17; An Ordinance of the Common Council of the City of Carmel, Indiana, Authorizing the Issuance of Bonds by the Hamilton 4 County Redevelopment Commission Pursuant to IC 36-7-14-3.5, Councilor Rider moved to introduce the item into business. Councilor Rider moved to approve Resolution CC -10-16-17-01. Councilor Campbell seconded. There was no Council discussion. Council President Finkam called for the vote. Council President Finkam announced Resolution CC -10-16-17-02; A Resolution of the Common Council of the City of Carmel, Indiana, to Petition the Indiana Department of Local Government Finance to Adjust the Levy Limit of the City for the Year 2018. Councilor Rider moved to approve Resolution CC -10-16-17-02. Councilor Campbell seconded. There was no Council discussion. Council President Finkam called for the vote. Council President Finkam announced the First Readinii of Ordinance D-2390-17; An Ordinance of the Common Council of the City of Carmel, Indiana, Amending Chapter 3, Article 1, Division 2, Section 3- 30 of the Carmel City Code. Councilor Rider moved to introduce the item into business. Councilor Carter seconded. Councilor Carter presented the item to Council.
