COUNCIL CHAMBERS/CITY HALL/ONE CIVIC SQUARE MEETING CALLED TO ORDER Council President Sue Finkam; Council Members: Kevin D. Rider, Ronald E. Carter, Jeff Worrell, Laura Campbell, H. Bruce Kimball and Deputy Clerk Jacob Quinn were present. Councilor Anthony Green was not present Council President Finkam called the meeting to order at 6:02 p.m. INVOCATION Pastor Keith Trump, Living Truth Church, delivered the Invocation. Councilor Kimball led the Pledge of Allegiance. RECOGNITION OF CITY EMPLOYEES AND OUTSTANDING CITIZENS There were none. APPROVAL OF MINUTES Councilor Campbell moved to approve minutes from the March 20, 2017 Regular Meeting. Councilor Kimball seconded. There was no Council discussion. Council President Finkam called for the vote. Minutes were approved 5-0 (Rider abstained). Councilor Rider moved to approve minutes from the April 6, 2017 Special Meeting. Councilor Kimball seconded. There was no Council discussion. Council President Finkam called for the vote. Minutes were approved 4-0 (Campbell and Finkam abstained). RECOGNITION OF PERSONS WHO WISH TO ADDRESS THE COUNCIL John Davis spoke in opposition to Ordinance D-2356-17 (regulating the use of turn signals in roundabouts). Leo Meyer, ASAP Aquatics, spoke in opposition to Ordinance D-2359-17 with regard to requiring permits (Regulates and provides penalties for parking on City sidewalks, multi -use paths and bicycle lanes). COUNCIL AND MAYORAL COMMENTS/OBSERVATIONS Councilor Rider spoke in support of the Carmel -Clay school referendum. Councilor Worrell announced that there is $7M of new infrastructure by Brookfield Group. Councilor Carter recognized Paul Hargitt who was at the meeting working on his Citizenship and Community Service badge as a member of the Boy Scouts. ACTION ON MAYORAL VETOES There were none. CLAIMS Councilor Campbell moved to approve General Claims in the amount of $784,342.36. Councilor Rider seconded. There was no Council discussion. Council President Finkam called for the vote. Claims were approved 6-0. Councilor Rider moved to acknowledge Wire Transfers in the amount of $2,036,610.97. Councilor Campbell seconded. There was no Council discussion. Council President Finkam called for the vote. Wire Transfers were acknowledged 6-0. COMMITTEE REPORTS Councilor Rider announced that the Finance, Utilities and Rules Committee had met and that the committee reports would be given when those items appear on the agenda. Councilor Kimball announced that the Land Use. and Special Studies Committee had met and that the items remain in committee. OTHER REPORTS Corrie Meyer, Director of the Carmel Redevelopment Commission, gave the monthly report to Council. Sam Burgess, Carmel Historic Preservation Commission staff, gave the quarterly report to Council. Jeremy Kashman, City Engineer, gave a report to Council on the Rangeline Road Streetscape. Councilor Rider made a motion to remove the hold placed on dollars allocated toward the Rangeline Road Streetscape. Councilor Worrell seconded. There was no council discussion. Council President Finkam called for the vote. The motion was approved 6-0. OLD BUSINESS Council President Finkam announced the Second Reading of Ordinance Z-622-17; An Ordinance of the Common Council of the City of Carmel, Indiana, AMeinding a Variety of Procedures for the Carmel Plan Commission and Carmel Board of Zoning Appeals in the Carmel Zoning Ordinance. Item remains in the Land Use and Special Studies Committee and was not discussed. pa Council President Finkam announced the Second Reading of Ordinance Z-623-17; An Ordinance of the Common Council of the City of Carmel, Indiana, Amending the Sign Regulations in the Carmel Zoning Ordinance. Item remains in the Land Use and Special Studies Committee and was not discussed. Council President Finkam announced the Third Reading of Ordinance D-2356-17; An Ordinance of the Common Council of the City of Carmel, Indiana, Adding Section 8-42 to Chapter 8, Article 4 of the Carmel City Code. Councilor Rider reported that this item is coming back from the Finance, Utilities and Rules Committee with a negative 2-1 recommendation; Councilor Rider moved to approve Ordinance D- 2356-17. Councilor Worrell seconded. Councilor Kimball moved to amend Ordinance D-2356-17 by striking on line 30 be fined in an amount not to exceed $100.00. Doug Haney, Corporation Counsel, addressed Council. There was extensive Council discussion. Councilor Carter seconded. Council President Finkam called for the vote. The motion to amend was defeated 2-4 (Kimball and Carter in favor). Councilor Carter presented to Council the benefits of passing this ordinance. There was extensive Council discussion. Council President Finkam passed the gavel to Councilor Campbell and addressed Council. Councilor Campbell called for the vote. Ordinance D-2356-17 was defeated 1-5 (Councilor Carter voted in favor). Councilor Campbell passed the gavel to Council President Finkam. Council President Finkam announced the Second Reading of Ordinance D-2358-17; An Ordinance of the Common Council of the City of Carmel, Indiana, Adding Section 6-109 to Chapter 6, Article 5, Division IV of the Carmel City Code. Item remains in the Finance, Utilities and Rules Committee and was not discussed. Council President Finkam announced the Second Reading of Ordinance D-2359-17; An Ordinance of the Common Council of the City of Carmel, Indiana, Amending Chapter 6, Article 4, Section 6-63 of the Carmel City Code. Councilor Rider announced that this item is returning from the Finance, Utilities and Rules Committee with a positive 3-0 recommendation and proposed amendments. There was extensive Council discussion. Doug Haney addressed council. Councilor Rider moved to amend Ordinance D-2359- 17 in whole by inserting Version A. Councilor Carter seconded. There was no Council discussion. Council president Finkam called for the vote. The motion to amend was approved 6-0. Council President Finkam passed the gavel to Councilor Campbell and addressed Council. Councilor Rider moved to approve Ordinance D-2359-17 As Amended. Councilor Carter seconded. There was no Council discussion. Councilor Campbell called for the vote. Ordinance D-2359-17 As Amended was approved 4- 2 (Finkam and Campbell opposed) Councilor Campbell passed the gavel to Council President Finkam. PUBLIC HEARINGS There were none. NEW BUSINESS Council President Finkam announced the First Reading of Ordinance D-2360-17; An Ordinance of the Common Council of the City of Carmel, Indiana, Enacting and Adopting a Supplement to the Code of Ordinances of the City of Carmel, Indiana. Councilor Worrell moved to introduce the item into business. Councilor Campbell seconded. Councilor Rider moved to suspend the rules and act on this tonight. Councilor Carter seconded. There was no Council discussion. Council President Finkam called for the vote. The motion was approved 6-0. Councilor Rider moved to approve Ordinance D-2360-17. Councilor Carter seconded. There was no Council discussion. Council President Finkam called for the vote. Ordinance D-2360-17 was approved 6-0. Council President Finkam announced Resolution CC -04-17-17-01; A Resolution of the Common Council of the City of Carmel, Indiana, Expressing Interest in the Purchase of Certain Properties Valued at Over $25,000 and Associated with the City's Road Improvement Projects. Councilor Worrell moved to introduce the item into business. Councilor Carter seconded. Councilor Worrell introduced the item to Council. Jeremy Kashman addressed Council. There was brief Council discussion. Doug Haney addressed Council. Councilor Worrell moved to approve Resohttion CC -04-17-17-01. Councilor Carter seconded. There was no Council discussion. Council President Finkam called for the vote. Resolution CC -04-17- 17-01 was approved 6-0. Council President Finkam announced Resolution CC -04-17-17-02; A Resolution of the Common Council of the City of Carmel, Indiana, in Support of the Carmel -Clay Schools Finance Referendum. Councilor Carter moved to introduce the item into business. Councilor Rider seconded. There was brief Council discussion. Councilor Carter moved to approve Resolution CC -04-17-17-02. Councilor Rider seconded. There was no Council discussion. Council President Finkam called for the vote. Resolution CC -04-17-17-02 was approved 6-0. Council President Finkam announced Resolution CC -04-17-17-03; A Resolution of the Common Council of the City of Carmel, Indiana, Approving a Transfer of Funds Within the 2017 Carmel Redevelopment Commission Budget. Councilor Rider moved to introduce the item into business. Councilor Campbell seconded. Councilor Worrell presented the item to Council. Councilor Rider moved to approve Resolution CC -04-17-17-03. Councilor Campbell seconded. There was no Council discussion. Council President Finkam called for the vote. Resolution CC -04-17-17-03 was approved 5-1 (Carter opposed). OTHER BUSINESS Carmel Ethics Board (Terms Expire 1/1/18 and 1/1/19, two year terms); Two appointments. Item Remains Tabled. ANNOUNCEMENTS There were none.
