COUNCIL CHAMBERS/CITY HALL/ONE CIVIC SQUARE MEETING CALLED TO ORDER Council President Sue Finkam; Council Members: Laura D. Campbell, Ronald E. Carter, Anthony Green H. Bruce Kimball, Kevin D. Rider, and Jeff Worrell; Chief Deputy Clerk -Treasurer Linda J. Harvey were present. Council President Finkam called the meeting to order at 6:05 p.m. INVOCATION Pastor Zach Matchett from Northview Church delivered the Invocation. Councilor Campbell led the Pledge of Allegiance. RECOGNITION OF CITY EMPLOYEES AND OUTSTANDING CITIZENS There were none. APPROVAL OF MINUTES Councilor Rider moved to approve minutes from the January 9, 2017 Regular Meeting. Councilor Campbell seconded. There was no Council discussion. Council President Finkam called for the vote. Minutes were approved 7-0. Councilor Rider moved to approve the minutes from the January 26, 2017 Special Meeting. Councilor Kimball seconded. There was no Council discussion. Council President Finkam called for the vote. Minutes were approved 6-0 (Councilor Campbell abstained). RECOGNITION OF PERSONS WHO WISH TO ADDRESS THE COUNCIL Eric Morris spoke on the topic of Home Place annexation's effect on HAWK beacon proposed by County at 106'h Street and the Monon Trail. COUNCIL AND MAYORAL COMMENTS/OBSERVATIONS Councilor Worrell discussed the Monon Community Center indoor rack and that it will remain free. ACTION ON MAYORAL VETOES There were none. CLAIMS Councilor Rider moved to approve General Claims in the amount of $3,479,234.12. Councilor Campbell seconded. There was no Council discussion. Council President Finkam called for the vote. Claims were approved 7-0. Councilor Rider moved to approve Retirement in the amount of $93,886.35. Councilor Kimball seconded. There was no Council discussion. Council President Finkam called for the vote. Retirement was approved 7-0. Councilor Rider moved to add-on a claim in the amount of $25,000 for the Carmel police Department. Councilor Carter seconded. There was no Council discussion. Council President Finkam called for the vote. The motion to add-on was approved 7-0. Councilor Rider moved to approve the add-on claim. Councilor Carter seconded. There was no Council discussion. Council President Finkam called for the vote. The Claim was approved 7-0. COMMITTEE REPORTS Councilor Rider announced that the Finance, Utilities and Rules Committee had met and that he would discuss the items when they appear on the agenda. Councilor Kimball announced that the Land Use and Special Studies Committee had met and that he would discuss the items when they appear on the agenda. OTHER REPORTS Corporate Counsel Doug Haney gave the annual report for the Ethics Board and discussed ways in which the process is being streamlined. Mr. Haney also indicated that the form will be sent out to City Council members and all other Elected Officials in the near future to be completed. Mayor James Brainard indicated that there is a policy for Executive Branch Departments that annual "gifts" cannot be accepted beyond an annual threshold of $100; whereas, City Council had subsequently enacted an ordinance that limits annual threshold to $250. The Mayor indicated that the lower amount would prevail for his Departments. Corrie Meyer gave the monthly report for the Carmel Redevelopment Commission. OLD BUSINESS Fourth Reading of Ordinance D-2338-16: Council President Finkam announced an Ordinance of the Common Council of the City of Carmel, Indiana, Amending Chapter 7, Article 3, Section 7-27 of the Carmel City Code. Councilor Kimball indicated that the Land Use and Special Studies Committee had a favorable vote of 3- 0. Mike Hollibaugh, Director of Community Services, addressed Council. Mark Dollase, Indiana Landmarks, addressed Council. Councilor Rider noted that he had taken Councilor Schleif s spot on the Carmel Historic Preservation Commission. There was extensive Council discussion. Councilor Kimball 2 moved to approve the ordinance, and Councilor Green seconded. There was no further Council discussion. Council President Finkam called for the vote. Ordinance D-2338-16 was approved 7-0. Third Reading of Ordinance D-2343-16: Council President Finkam announced an Ordinance of the Common Council of the City of Carmel, Indiana, Adding Chapter 6, Article 5, Division III, Section 6-100 to the Carmel City Code Councilor Rider indicated that the Finance, Utilities and Rules Committee had amended the ordinance and recommended inserting Version A. Councilor Rider moved to accept the amendment and Councilor Campbell seconded. Councilor Rider made the motion to approve the ordinance with the amended language, and Councilor Campbell seconded. There was no further Council discussion. Council President Finkam called for the vote. Ordinance D-2343-16 was adopted as amended 7-0. Second Reading of Ordinance Z-621-16: Council President Finkam announced an Ordinance of the Common Council of the City of Carmel, Indiana establishing the Clay Corner Planned Unit Development (PUD) District. Speakers on the topic included Mr. Paul Rioux, Platinum Properties, and Mr. Thomas Roller expressed concerns over the public crossing his yard which has a gas pipeline easement along the back of his property and the need for signs or fences to prevent this. Mike Hollibaugh addressed Council. Council discussion included whether or not to amend this ordinance, but it was decided an amendment was not necessary when the PUD representative indicated that the PUD would work cooperatively to put up signs and fencing to the extent possible. Councilor Rider moved to approve the ordinance, and Councilor Kimball seconded. There was no further Council discussion. Council President Finkam called for the vote. Ordinance Z-621-16 was approved 6-1 (Councilor Green opposed). PUBLIC HEARINGS First Reading of Ordinance D-2345-17: Council President Finkam announced an Ordinance of the Common Council of the City of Carmel, Indiana, Reallocating Certain 2017 Appropriations Councilor Carter made the motion to introduce, and Councilor Rider seconded. Councilor Carter introduced the item to Council. Linda Harvey, Chief Deputy Clerk -Treasurer, addressed Council. Mr. Curt Coonrod, Coonrod and Associates, addressed Council. Council President Finkam opened the Public Hearing at 7:16 p.m. With no public comments, Council President Finkam closed the Public Hearing at 7:16:30 p.m. There was extensive Council discussion. Councilor Carter stressed concern over making the appropriation sooner rather than later so that the Mayor's Office would have the funds available to start the fiscal 2016 CAFR. It was moved to suspend rules and act on the item tonight by Councilor Rider, and Councilor Green seconded. Vote to suspend rules was defeated 2-5 (Councilors Rider, Finkam, Green, Campbell and Kimball opposed). The item was held over until the next meeting without being referred to committee. 3 First Reading of Ordinance D-2346-17: Council President Finkam announced an Ordinance of the Common Council of the City of Carmel, Indiana, Vacating the Existing Public Right -of -Way Known as "15" Platted Alley Within the IRA Mendenhall's Addition Councilor Worrell made the motion to introduce, and Councilor Rider seconded. Councilor. Councilor Worrell presented the item to Council. Council President Finkam opened the Public Hearing at 7:21 p.m. With no public comments, Council President Finkam closed the Public Hearing at 7:22 p.m. Councilor Rider moved to suspend the rules and vote on item this evening, and Councilor Kimball seconded. There was no Council discussion. Council President Finkam called for the vote. The motion to suspend was approved 7-0. It was then moved to approve by Councilor Rider, and Councilor Green seconded. There was no Council discussion. Council President Finkam called for the vote. Ordinance D-2346-17 was approved 7-0. NEW BUSINESS First Reading of Ordinance D-2347-17: Council President Finkam announced an Ordinance of the Common Council of the City of Carmel, Indiana, Amending Chapter 2, Article 4, Section 2-114 of the Carmel City Code Councilor Carter made the motion to introduce, and Councilor Rider seconded. Councilor Campbell presented the item to Council and noted that this Petty Cash fund had not been used for approximately over ten (10) years. Councilor Rider moved to suspend rules and vote on it this evening, and Councilor Campbell seconded. There was no Council discussion. Council President Finkam called for the vote. The motion to suspend was approved 7-O.Councilor Rider then made the motion to approve, and Councilor Campbell seconded. There was no Council discussion. Council President Finkam called for the vote. Ordinance D-2347-17 was approved 7-0. OTHER BUSINESS City Council Appointments Carmel Ethics Board - two appointments (Terms Expire 1/1/18 and 1/1/19, two year terms). Item remains tabled.
