MEETING MINUTES
MONDAY, JANUARY 8; 2018 - 6:00 P.M.
COUNCIL CHAMBERS/CITY HALL/ONE CIVIC SQUARE
MEETING CALLED TO ORDER
Council President Kevin D. Rider; Council Members: Sue Finkam, Ronald E. Carter, Anthony Green, Jeff
Worrell, Laura Campbell, H. Bruce Kimball and Deputy Clerk Jacob Quinn were present.
Council President Rider called the meeting to order at 6:02 p.m.
INVOCATION
Pastor Stan Killebrew, Northview Church, delivered the Invocation.
Councilor Carter led the Pledge of Allegiance.
RECOGNITION OF CITY EMPLOYEES AND OUTSTANDING CITIZENS
Mayor James Brainard addressed Council to remember and recognize Karl Haas who passed away. Mr.
Haas served as the attorney for the Carmel Redevelopment Commission.
Mayor Brainard and Fire Chief Dave Haboush recognized Captain John F. Moriarty (Sparky) on his
retirement from the Carmel Fire Department.
APPROVAL OF MINUTES
Councilor Campbell moved to approve minutes from the December 18, 2017 Regular Meeting. Councilor
Kimball seconded. There was no Council discussion. Council President Rider called for the vote.
Minutes were approved 7-0
Councilor Finkam moved to approve minutes from the December 22, 2017 Special Meeting. Councilor
Kimball seconded. There was no Council discussion. Council President Rider called for the vote.
Minutes were approved 4-0 (Carter, Campbell and Rider abstained)
RECOGNITION OF PERSONS WHO WISH TO ADDRESS THE COUNCIL
Lynn Abrams spoke in opposition to tree cutting and removal of trees in front of neighborhood along 96th
Street.
Alex Aisen spoke in opposition to tree cutting and removal of trees in front of neighborhood along 96th
Street citing drainage as a concern.
Taft Davis spoke in opposition to proposed BZA docket 17120001 which proposes a special use variance
at 141St Street and Shelbome Road for an Islamic Life Center citing traffic as a concern.
Randy Holtzapple spoke in opposition to proposed BZA docket 17120001 which proposes a special use
variance at 141St Street and Shelborne Road for an Islamic Life Center citing traffic and noise pollution
concerns.
Chris Wickman spoke in opposition to proposed BZA docket 17120001 which proposes a special use
variance at 141" Street and Shelborne Road for an Islamic Life Center citing traffic and noise pollution
concerns.
Tony Kuykendall spoke in opposition to proposed BZA docket 17120001 which proposes a special use
variance at 141St Street and Shelborne Road for an Islamic Life Center citing traffic and noise pollution
concerns.
Nick Armstrong spoke in opposition to proposed BZA docket 17120001 which proposes a special use
variance at 141St Street and Shelborne Road for an Islamic Life Center and encouraged Council to review
the 2009 Carmel Comprehensive Plan.
Jakub Peterson spoke in opposition to proposed BZA docket 17120001 which proposes a special use
variance at 141" Street and Shelborne Road for an Islamic Life Center citing traffic and noise pollution as
well as health issues as concerns.
Khek Dengmanivauh spoke in opposition to proposed BZA docket 17120001 which proposes a special
use variance at 141 st Street and Shelborne Road for an Islamic Life Center citing traffic and noise
pollution concerns.
Sheila Graves spoke in opposition to proposed BZA. docket 17120001 which proposes a special use
variance at 141 st Street and Shelborne Road for an Islamic Life Center citing traffic and noise pollution
concerns.
Deborah Gostomski spoke in opposition to proposed BZA docket 17120001 which proposes a special use
variance at 141 St Street and Shelborne Road for an Islamic Life Center citing traffic and noise pollution
concerns.
Matthew Bohm spoke in opposition to proposed BZA docket 17120001 which proposes a special use

John Haskel spoke in opposition to proposed BZA docket 17120001 which proposes a special use
variance at 141St Street and Shelborne Road for an Islamic Life Center and asked why Council wasn't
more involved with the issue.
COUNCIL AND MAYORAL COMMENTS/OBSERVATIONS
Councilor Carter thanked City of Carmel employees for all of their hard work during issues that came up
during the extreme cold. Councilor Carter also thanked Clerk -Treasurer Christine Pauley for her help in
getting the financing taken care of for the Council Chambers remodel.
Councilor Kimball thanked the Street Department for their hard work plowing multi -use paths and city
streets. Councilor Kimball thanked Councilor Carter for being instrumental in getting multi -use paths
plowed.
Councilor Finkam thanked Jim Crider for his work in heading the project for the Council Chambers
remodel.
Council President Rider thanked Councilor Worrell and Carter for their hand in the Council Chambers
remodel. The Councilor also addressed concerns about BZA docket 17120001.
ACTION ON MAYORAL VETOES
There were none.
CLAIMS
Councilor Campbell moved to approve Payroll in the amount of $2,055,990.82. Councilor Finkam
seconded. There was no Council discussion. Council President Rider called for the vote. Payroll was
approved 7-0.
Councilor Campbell moved to approve General Claims in the amount of $1,480,223.90. Councilor
Worrell seconded. There was no Council discussion. Council President Rider called for the vote. Claims
were approved 7-0
Councilor Campbell moved to approve Retirement in the amount of $94,494.65. Councilor Kimball
seconded. There was no Council discussion. Council President Rider called for the vote. Retirement was
approved 6-0
COMMITTEE REPORTS
Councilor Finkam reported that the Finance, Utilities and Rules Committee met and discussed Ordinance
D-2397-17 and it remains in Committee. D-2406-17 was also discussed and the report will be given when
it appears on the agenda.
Councilor Kimball reported that the Land Use and Special Studies Committee had not met.

Henry Mestetsky, Executive Director of the Carmel Redevelopment Commission, gave the monthly
report.
Sam Burgess, Carmel Historic Preservation Commission staff, presented the quarterly report.

EMS Chief Tom Small and Chief Haboush gave a report on the Carmel Fire Department's Mobile
Integrated Health Program.
OLD BUSINESS

Fourth Reading of Ordinance Z-627-17; An Ordinance of the Common Council of the City of Carmel,
Indiana, Establishing the Reserve at Cool Creek Planned Unit Development District; Sponsor: Councilor
Kimball. Tabled Until the 1/8/18 Meeting.
Synopsis:
Establishes The Reserve at Cool Creek Planned Unit Development District Ordinance (the "The Reserve
at Cool Creek PUD"). The Ordinance would rezone the real estate from R-1 Residential to a Planned Unit
Development district allowing the development of a residential neighborhood laid out per the
Development Plan included in Exhibit B of this Ordinance which includes single family ranch and villa
homes of the architectural character illustrated in Exhibit E and Exhibit F of this Ordinance.
Councilor President Rider announced the Fourth Reading of Ordinance D-2397-17; An Ordinance of
the Common Council of the City of Carmel, Indiana, Amending Ordinance D-2381-17; Sponsor:
Councilor Kimball. Item remains in the Finance, Utilities and Rules Committee and was not discussed.
Councilor President Rider announced the Second Reading of Ordinance D-2406-17; An Ordinance of
the Common Council of the City of Carmel, Indiana, Amending Chapter 6, Article 5, Division VIII,
Section 6-158(b) of the Carmel City Code. Councilor Finkam announced that the item is returning from
the Finance, Utilities and Rules Committee with a positive 3-0 recommendation. Councilor Finkam
moved to approve Ordinance D-2406-17. Councilor Campbell seconded. There was no Council
discussion. Council President Rider called for the vote. Ordinance D-2406-17 was approved 7-0.
PUBLIC HEARINGS
Councilor President Rider announced the First Reading of Ordinance Z-629-17; An Ordinance of the
Common Council of the City of Carmel, Indiana, Adding Standards For Short Term Residential Rental
Units in the Unified Development Ordinance. Councilor Kimball moved to introduce the item into
business. Councilor Worrell seconded. John Molitor, Counsel for the Carmel Plan Commission, presented
the item to Council. Mayor Brainard addressed Council. Council President Rider opened the public
hearing at 8:14 p.m.
Jill Meisenheimer, Carmel Citizens for Responsible Zoning, addressed Council with concerns about
Ordinance Z-629-17.
Shannon Minnaar spoke in favor of Ordinance Z-629-17
Jim Westbrook spoke in favor of Ordinance Z-629-17
Debbie Mcbroom spoke in opposition to Ordinance Z-629-17 and in favor of short term rentals.
Seeing no one else who wished to address Council, Council President Rider closed the public hearing at
8:23 p.m. Mayor Brainard addressed Council. Councilor Finkam stated she was agreeable to passing the
Ordinance tonight, but would like to take a closer look at changes in committee. Councilor Finkam moved

to suspend the rules and act on the item this evening. Councilor Worrell seconded. There was no Council
discussion. Council President Rider called for the vote. The motion was approved 7-0. Councilor Finkam
moved to approve Ordinance Z-629-17. Councilor Kimball seconded. There was no Council discussion.
Council President Rider called for the vote. Ordinance Z-629-17 was approved 7-0.
NEW BUSINESS
Councilor President Rider announced the First Reading of Ordinance D-2407-18; An Ordinance of the
Common Council of the City of Carmel, Indiana, Adding Chapter 2, Article 4, Section 2-149 to the
Carmel City Code. Councilor Worrell moved to introduce the item into business. Councilor Carter
seconded. Council President Rider passed the Gavel to,Councilor Worrell. Council President Rider
presented the item to Council. Council President Rider moved to suspend the rules and act on the item this
evening. Councilor Campbell seconded. There was no Council discussion. Councilor Worrell called for
the vote. The motion was approved 6-0 (Councilor Finkam absent). Council President Rider moved to
approve Ordinance D-2407-18. Councilor Campbell seconded. There was no Council discussion.
Councilor Worrell called for the vote. Ordinance D-2407-18 was approved 6-0 (Councilor Finkam
absent).
Council President Rider regained the gavel.

City Council Appointments
Carmel Ethics Board (Term Expires 1/1/18, two year term); One appointment. TABLED
Carmel Economic Development Commission (Term Expires 1/31/17, two year term); One appointment.

Carmel City Center Community Development Corporation (4CDC) (Term Expires 12/31/18, one year
term); One appointment. Councilor Carter nominated Debra Schmitz to serve on the 4CDC. Councilor
Worrell seconded. Councilor Finkam moved to close the nominations. Councilor Campbell seconded.
There was no Council discussion. Debra Schmitz was appointed by acclamation.
Carmel Redevelopment Commission (Terms Expire 12/31/18, one year term); Two appointments.
Councilor Campbell nominated Jeff Worrell and Dave Bowers to serve on the Commission. Councilor
Finkam seconded. Councilor Finkam made a motion to'close the nominations. Councilor Green seconded.
There was no Council discussion. Dave Bowers, and Jeff Worrell were appointed by acclamation.
Carmel Plan Commission, (term expires 12/31/2019, two year term); One Appointment. Councilor Green
nominated Laura Campbell to serve on the Commission. Councilor Kimball seconded. Councilor Finkam
made a motion to close the nominations. Councilor Kimball seconded. There was no Council discussion.
Laura Campbell appointed by acclamation.
ANNOUNCEMENTS
Council President Rider thanked Councilor Kimball for his service on the Plan Commission and presented
Councilor Finkam with a ceremonial gavel thanking her for serving as Council President during the prior
calendar year.
