Hi Simon,
I am happy to clarify for you. Here is a link to the Minutes from the meeting(your project starts on page 7)where you agreed to
the commitments and here is a link to our Department Report where the commitments were also mentioned. The path
construction has always been a part of the discussion and is a requirement for any new project. We have compromised and are
not making you build the path for the southern parcel yet because that can be taken care of when a new project develops there.
The northern parcel will either need a path built or you can make a cash contribution in lieu thereof to be deposited in the City's
Thoroughfare Fund.
Section 1.07 of the UDO (Unified Development Ordinance) lists the requirement of having to comply with the Transportation
Plan. http://www.carmel.in.gov/home/showdocument?id=10449
And here is a link to the Transportation Plan. You can see on The Bicycle and Pedestrian Plan Map (page 73),that a Multi-Use
Path is necessary along College Ave.
Also, here is a link to the TAC Correspondence where both the Alternative Transportation Coordinator and myself included it in
our review letters. http://cocdocs.carmel.in.gov/weblink/0/doc/1476429/Pagel.aspx
Sincerely,
Alexia

Alexia,
I have no problem with most of it except the one about building 10 foot wide multi-use path or pay to a fund, that was not in the
communication to us. We agree to donate land, and now we have to pay for the sidewalk construction too?
Can you clarify on that?
Thanks
Simon

Hello,
Attached is a draft of the Commitments that were agreed to at the Plan Commission meeting. Simon and John,
could you please take a look at these and make any changes necessary? Once you have reviewed these, Simon,
you will need to sign them and get them notarized so that you can record them with the Rezone Ordinance.
Thanks,
Alexia Lopez
