planning tools,worksheets,timelines,and music requests to furnish the Company with the information needed to perform at the event.The Client shall,at all times have complete control as to direction of the manner,means and style of performance notwithstanding the foregoing,the Company will not be required to foUmv the Client's Instructions if they should contravene any applicable laws or rules of the events location. 2.PERFORMER-The Company reserves the right to select and assign a Disc jockey/MC(here-in-after known as"Performer')for the event.If the Client has requested a specific performer to perform at the event,we wul do our best to schedule that performer.Bthat performer is unavailable,the Company will provide a suitable substitute and notify the Client as soon as possible.Our Inability to provide a specific performer shall not entitle the Client to a refund or reduction in our fee.If the performer that was selected for your event has a serious injury,health issues or an emergency in the family;the Company will contact the Client Immediately:The Company shall use Its best efforts to find a replacement performer,or to otherwise perform hereunder.if the Company is unable to loam a replacement performer,and therefore falls to perform hereunder,the Client's Deposit shall be refund immediately.The parties agree that refund of its Deposit shall be the Client's sole and exclusive remedy in either law or in equity for the Company failure to perform hereunder.The Client agrees that the quality of the performance by the performer is not a debatable subject, since this an be very subjective. 3.MUSIC-The Company and performer shall provide music appropriate to the event and the styles requested by the Client.The performer will attempt to play the requests of the Client and guests,but shall not be held liable if certain selections are unavailable or un-played.The Company reserves the right to censor music requests that the performer deems inappropriate for the event and will make every effort to adhere to the clients request list including the"do not play"list The Company will provide at least 80%of your playlist and we will make every effort to have all ofyour formality songs if we are performing at a Wedding Reception.If the Company cannot find a selection on your request list that you feel Is important,the Client can provide the Company with the selection through e-mail one(1)week before the event or provide a Compact Disc one(1)week before the event.if a Compact Disc Is provide the Client is responsible to be sue that the selection on the Disc are finalized and able to play on any Compact Disc player of the performer's choice.Any music requests must be received by the Company at least one(1)week before the­L 4.FACILITIES-The Client shall provide the Company with safe and appropriate working conditions.This includes,but is not limited to,sufficient space next to the dance fin or(If any)for D)s'setup(s);a minimum of one(1)six(6)foot long table;a standard 3-prong 120-volt electric outlet(properly grounded with at least 15 amps available)from a reliable power source near the set-up area,additional electric outlets on SEPARATE circuits for lighting(if contracted for);facilities that completely cover and protectthe performers equipment from adverse weather conditions(direct sunlight thin,excessive winds,etc);and crowd control ifwammed.The Comnapy,has a choice to not setupoutsidelfall equipment is not sufficiently covered from harmful elements.It is totally,the Com pan dtscienon.The Client accepts full responsibility and is liable for my damages,injuries or delays that occur as a result offaflure to comply with these provisions.This agreement guarantees that the Company will he ready to perform at the start of the event however no guarantee Is made to what time the performer may arrive for set-up.We do require at least one(1)hour of set-up time prior to the event start time,and one(1)hour of breakdown time at the end of the event(which is Included in your contract price). 5.SAFEfY/EQUIPMENT-Any damages,injury or theft to equipment that Is a result from the event's attendees will be the responsibility of the Client The Client shall be responsible for supervising the behavior of event attendees.lfguest's behavior becomes Intolerable,the performer will allow the Client ample time,not to exceed 30 minutes,to resolve the threatening situation.If said condition is not corrected,the Company has the right to end the performance without refund.Under no circumstance shall the Company's equipment be set-up within 20 feet of any type ofwater(I e.pools,sprinklers,ice sculptures,fountains,etc).In all cases,the Client will be responsible for payment in full as well as for any resulting damage to the performer or the performers equipment. 6.LIABILITY-if for any reason the Company or performer is unable to perform any condition of this contract,the company's liability shall be exclusively limited to no more than a refund of all monies paid.The agreement is subject to ancellation due to sickness,accidents,acts of God or any other conditions beyond the Companies control.The Company will in every effort find a compatible replacement for the event. 7.PAYMENT-Upon receipt of a signed copy of this Agreement together with full payment of the Deposit,the Company will reserve the dam of the event for Client.The Company will be due payment of the balance two(2)weeks before the event If the Client should fail to pay,when due,the balance owing to the Company,the Company may decide to not perform unless an agreeable term between the Company and the Clientare reached.THE ENTIRE BALANCE SHALL BE PAID BY CMjj,CHECB,MONEY ORDER CREDIT CARD OR PAY PAL Please make all checks payable to:Diamond Productions.If for any reason,a check should he returned or not honored,the Client shall pay the Company and additional$50.00 service charge to cover bank charges/fees. H.OVERTIME/TIPS-Any performance after the stated ending time shall he considered overtime and must be authorized by the Client,the performer and the venue's representative.The fee for any overtime performance shall be paid directly to the performer.The overtime rate is$125.00 per hour.Any gratuity or overtime paid to the performer is the sole property of the performer and the Company makes no claim upon it whatsoever.Payment of over time is due at the end of the event If you feel the event has gone great because of the DI,tips are appropriate and acceptable. 9.CANCELLATION-All cancellations deposits are none refundable.Under some circumstances the Companywill still ester anew date of the postponed event as long as the Company Is not scheduled for another prior event on the Clients perspective date.lf a cancellation has been made after(2Ms prior to the evenF.whatever amount that has been paid including[he deposit is oon•refund.a . t� 10.GENERAL-If any prevision of this agreement should be determined to be unenforceable bylaw,the remainder of the Agreement,continues in full force and effect It is understood that this contract is binding on both parties.It cannot be altered or changed unless agreed to in writing by the Said parties,the Company and the Client By signing this contract,both parties agree to the terms and conditions above.
