The undersigned, NORTHWEST ASSOCIATES, an Indiana Limited Partnership, and NORTHVIEST DEVELOPMENT CORPORATION, an Indiana Corporation owners of the real estate
shown and described herein and subdivided and do hereby lay off, plat and subdivide said real estate in accordance with the within plat.
This subdivision shall be known and designated as PARK NORTHWESTERN, an addition to Hamilton County, Indiana.
In order to afford adequate protection to F:il present and future owners of lots in this subdivision,, the undersigned owners hereby adopt and establish
the following protective covenants, each and all enuring to the benefit of each and every owter of any lot or hts in said subdivision, their heirs and/or
assigns, binding all the same each grantor and their heirs and/or assigns.
A. Sci_eet Dedication_ All streets shown and not heretofore dedicated are hereby dedicated to the public for its use.
B. Easements: There are strips of ground as shown on the within plat marked "Dr;jinage LdseiienLs" (D.E.), "Sewer Easements" (S.t.) and "Utility Easements"
;U.E.either seperately or in any combination of the three, which are reserved for the use of public utility companies and governmental agencies
as follojr,,s: "Drainage Easements" (D.E.) are created' to provide paths and courses for area and local storm drainage, either overland or in adequate
underground conduit, to serve the needs of this and adjoining ground and/or the public drainage system. No structure, including fences, shall be
built upon said easement, which will obstruct flow from the area being served. "Sewer Easements" (S.E.) are created for the use of the local
governmental agency or private "Association of Owners" bearing jurisdiction over the storm and sanitary wa5.te disposal system of ary city, private
sewer district, and/or county for thr purpose of installation and maintenanc,- of sewers that are a part of said system. "Utility Easements" (U.E.)
are created for the use of all public utility companies, not including transportation companies, for the installation and maintenance of mains, ducts,
poles, lines, wires, and also all rights and uses specified for sewer easements above desiytiated. The owners of all lots in this additior
shall take title subject to the rights of the public utilities, governmental agencies, and Lhe rights of the other lot owners in this addition, to
said easement herein yranted for ingress and egress in, along and through the striNs of ground for the purposes herein stated.

D. Restrict ions: There are recorded in the Office of the Recorder of Hamilton County by Instrument #13186 dated September 14, 1979, "Declaration or
Develonment Standards, Covenants and Restrictions for Park Northwestern --Section One", which shall as a condition precedent to ownership be made a
part hereof, but which may be amended from time to time.
E. Lot Size:Lots shown on the within plat may be conveyed, subdivided and developed into two or more building sites or portions of lots may be added
-to other lots with the approval of the "Planning Committee", provided for in the said "Declaration of Development Standard;, Covenants and Restrictions
for "ark Northwestern --Section One", provided, however, that unless an off-site sanitary sewer is available to service such site, no site shall consist
of l_,ss +'-pan one (1) acre. in the event that sanitary sewers become available, no more than 12.5 acres of the total 50.1 acres herein platted shall
be subdivided into separate sites of less than one acre.
Additional Public Right of Way: Addtional right of way may be dedicated to the public for its use by North;:jest Associates, its successors and
assigns, on property in which it holds title within this plat, to service this and adjoining real estate.
G. Landscape Easements (L.E.): Landscape Easements (L.E.) are reserved for the possible erection of an entry fence, entry signs and related landscaping.
The maintenance of said improv-:ments small he as provided in the said "Declaration of Development Standards, Covenants, and Restrictions for Park
Northwestern --Section One".
H. Enforcement: The right to enforce the within provisions, restrictions and covenants, including said "Declaration of Development Standards, Covenants
and Restrictions for Park Northwestern --Section One", by injunction together with the right to cause the removal by due process of law of structures
erected or maintained in violation therein is hereby dedicated and reserved to the owners of 4he several lots in this subdivision, their heirs or
assigns, and the City of Carmel, their successors or assigns, wit si;all be entitled to such relief without beirg required to show any damage of any
kind to an., sr;ch owner or owners, by or through any such violation or -,ttempted violations. Said provision shall be in full fore- and effect until
July 1, 2005, at which time said covenants shall be automatically extended for successive periods of ten (10) years, unless by a vote of the majority
of the then owners of the lots, it is agreed to change the covenants in whole or in part. Invalidation of arry one of the covenants by judgement or
court order shall in ne wise affect any of the other provisions which shall remain in full force and effect.
T. Yard Lights: At time buildings are constructed on their lots, the respective lot owners shall install and maintain yard lights which shall operate from dusk
to dawn each night. The lights shall be for purposes of building identification, security, and aesthetics. The number, type and location of said lights shall
be subject to the review and approval of the Planning Committee.
