I just spoke to Pam and she was going to pass along a message that I called. We had originally communicated about building a deck into the D&U easement on our property back in May. (Email below) We have since revised our plans to stay out of the easement (Attached). I am working with Adam Schriner (CC) on getting a permit with Carmel to build our proposed deck. We were wanting to know if you had the exact measurements for this easement to know for sure that we are out. For the attached plan I took my plot plan survey and inserted the deck. Hoyes [mailto:Greg.Hoyes@hamiltoncounty.in.gov] Sent: Monday, May 21, 2018 3:22 PM To: mattm@icefriday.com Subject: RE: Non-Enforcement of Drainage Easement   Matt    2 I reviewed this and got back with Jarrod this morning.  A deck is a permanent structure and is not allowed in a regulated  drain easement per Indiana Code 36‐9‐27‐33 without permission of the Hamilton County Drainage Board.  I have never  seen them approve a deck with post and stairs in the easement and the only other similar case was they allowed a deck  to cantilever over the easement about 3 feet.  The storm sewer pipe we have in that easement is a 30” pipe and is about  6 feet deep, so if we need to work on it, we are going to need to use large equipment, so we cannot have anything in the  way.    While you can submit a non‐enforcement requesting approval as designed, my experience is the Drainage Board will  deny it as presented.  I would look at what you can do to redesign it and try to keep it out of the easement or only  hanging over the easement line a couple feet.  If you have any questions, please let me know.    Greg Hoyes, AC, CFM, CPESC  Plan Reviewer  Hamilton County Surveyor's Office   From: Surveyor   Sent: Monday, May 21, 2018 1:59 PM  To: Greg R. Hoyes <Greg.Hoyes@hamiltoncounty.in.gov>  Subject: FW: Non‐Enforcement of Drainage Easement        From: Matt Moorhead [mailto:mattm@icefriday.com]   Sent: Monday, May 21, 2018 1:21 PM  To: Surveyor <surveyor@hamiltoncounty.in.gov>  Subject: Non‐Enforcement of Drainage Easement    ATTN: Greg Hoyes Greg, Good afternoon sir!
