MEETING MINUTES
Date: Wednesday, July 18, 2018
Place: Dept. of Community Services Conference Room, 3rd Floor, Carmel City Hall.

9:00 a.m. Docket No. 18060012 DP Amend/ADLS Amend: The Play School at Legacy Sport Court.
The applicant seeks site plan and design approval to add a gym and STEM learning center to the
existing daycare facility. The site is zoned PUD (Legacy, Z-501-07) and is not located within any
overlay zone. It is located at 14454 Community Drive. Filed by Brian Cross of Civil Site Group, Inc. on
behalf of the owner.
Brian Cross with Civil Site Group and Katie Guerra with The Play Schools presented the project. Mr.
Cross said this addition will replace the existing parking lot so the developers will be looking to move
utilities and shift the parking to the west of the current location. Mr. Cross added that this new addition
will be access controlled, therefore the connection of the two buildings will be highly important. Mr.
Cross said architecturally, the new addition will match the existing roof line, with the exception of the
gymnasium, which will need to be taller.
Greg Hoyes – Hamilton County Surveyor’s Office
- Letter sent. Mr. Hoyes said since the project includes adding impervious surfaces and changing
storm sewers, an outlet permit will be required.
Joanie Clark – Vectren Energy
- Ms. Clark said there do not appear to be any conflicts with the existing equipment, but since load
will be added some equipment may need to be moved at the developer’s expense.
Daren Mindham – City of Carmel Urban Forestry
- Review comments sent on Project Dox. Mr. Mindham said most of the comments involved
landscaping around the perimeter and easements. Mr. Mindham asked if the easement along the
west side of the property is a regulated drain. Mr. Cross said it is not a regulated drain, but rather
an easement for the City of Carmel for the storm line that ran through the parking lot.
Dave McCoy – City of Carmel Addressing
- Comments have been issued on Project Dox. Mr. McCoy said as long as the existing address is
being used, there are no comments.
David Littlejohn – City of Carmel Alternative Transportation Coordinator
- Mr. Littlejohn said he just needs to verify that there will be sufficient bike racks, which per the
Ordinance is one rack for every ten employees. Also, there is an ADA ramp which is missing
across from another ADA ramp.

Rachel Keesling – City of Carmel Planning & Zoning
- Ms. Keesling said the biggest comments will involve the architecture of the gym portion. She
added that the front looks good but the back portion will need some more work. Ms. Keesling
asked if the bump-outs serve a functional purpose or if they were just added to meet the ordinance.
Ms. Guerra said these bump-outs were added to meet the code, but also will be used for storage on
the inside of the gym. Ms. Keesling said the scale of the design is off, so she will need to see a
corrected version along with a color rendering and 3-D renderings. Ms. Guerra said the design was
modeled after the Legacy Apartments across the street. Ms. Keesling said she thinks the site plan,
sidewalks and parking will be fine, but the architecture will need work, as it lacks pedestrian scale.
Ms. Guerra said there could possibly be faux windows added to the side of the gym to visually
break up the wall.

9:10 a.m. Docket No. 18060013 SP: The Ridge at the Legacy, Section 5.
The applicant seeks administrative approval of the Secondary Plat & Construction Plans, for 19 lots on
11.2 acres, including a street segment for Cherry Creek Blvd. The site is located south of 14298 Arnett
Dr., south of 146th St. & west of Community Dr. The site is zoned PUD/Planned Unit Development.
Filed by Tim Walter of Platinum Properties Mgmt. Co., LLC.
Brett Huff with Stoeppelwerth and Associates and Ed Fleming with Platinum Properties presented the
project. Mr. Huff said this is the final section for the Ridge at Legacy.

- Comments sent. Mr. Mindham said the main comment is that the tree preservation area needs to
match the plans, as well as fencing for the areas that need it.
Angie Conn – City of Carmel Planning & Zoning
- Comments sent June 25. Department is awaiting an official response. Ms. Conn said the primary
plat shows discrepancies between the width of the street right-of-way versus what the petitioner is
proposing, as well as the width of the tree planting strips.
Dave McCoy – City of Carmel Addressing
- Mr. McCoy said he noticed one of the streets is called “Frostburg”, which is already being used in
another area of the Legacy. This street will need to be renamed.

- Letter sent. No further comments. Mr. Huff asked if it is understood that the path being asked for
will be part of the City of Carmel’s project. Mr. Littlejohn said he wasn’t aware that the City was
taking on this project, but he said if this is going to be built, he is sure the City will be responsible
for the path. Mr. Huff said this project will extend to the right-of-way on Cherry Creek so anything
inside the right-of-way would be the City’s responsibility. Mr. Huff added that he will clean up any
discrepancies and make the plans more clear.

located at 525 W Main St. and is zoned R-2/Residential. Filed by Gary McNutt with Wedgewood Real
Estate Partners, owner.

- Ms. Lopez said the front yard setback is 25 feet, but the current zoning requires 35 feet.
9:25 a.m. Docket No. 18060015 PP: The Parks at Town Meadow Subdivision.
The applicant seeks primary plat approval with variances for a new 48 lot subdivision. The site is
located south of 116th Street and west of Towne Road and is zoned S-1/Residential. Filed by Steve
Pittman with Pittman Real Estate Services, owner.
Jim Shinaver with Nelson & Frankenberger, and Paige Drury and D.J. O’Toole with Williams Creek
presented the project. Mr. Shinaver said this parcel of land was owned by University High School but
was sold.

- Comments submitted on Project Dox. Mr. Littlejohn said University High School was required to
build a path along 116th Street as part of their approval process and since this is subdividing part of
this parcel, the City would like to see this path constructed.

- Comments will be submitted on Project Dox. Ms. Lopez asked if there is an existing easement on
the south side of the parcel. Mr. Shinaver said he is not aware of an easement but he will go back
and look at the previous site plans. Ms. Lopez asked who owns the large parcel adjacent to the
property. Mr. Shinaver said he believes this parcel is still owned by University High School but he
will need to confirm. Ms. Lopez said she believes it would be a good idea to put a stub street to the
north that would connect to the University High School campus. She added that this could provide
benefits for both the school and the subdivision. Mr. Shinaver said he would need to discuss with
his client. Ms. Lopez asked who is responsible for maintaining the detention and whether it is shared
with someone else. Mr. Shinaver said he’s sure there is some sort of easement spelling out what the
obligation will be.

9:40 a.m. Docket No. 18070001 Z: 201 W. 106th Street Rezone – S-2 to B-1.
The applicant seeks approval to rezone approximately 5.73 acres from S-2/Residential to the B-
1/Business zoning district classification. The site is currently zoned S-2/Single Family Residential, low
density and is not located within any overlay zone. It is located at the southwest corner of 106th Street
and Illinois Street. Filed by Joseph D. Calderon of Barnes & Thornburg LLP on behalf of the owner, PL
Properties LLC.
Joe Calderon with Barnes & Thornburg Law, John Levinsohn with Levi Realty, Adam Campagna with
Shiel Sexton, and Jim Goggan with Woolpert presented the project. Mr. Calderon said the developers
feel an office building would be a good transitional use between a residential area and the US-31
corridor. Mr. Calderon said since this area was previously developed, he believes the utilities should all
be available.

Rachel Keesling – City of Carmel Planning & Zoning
- Ms. Keesling said one of the comments is concerning the petitioners limiting the uses of the
building within the B-1 zoning, for the comfort of the neighbors. Ms. Keesling said the building
design at this point sets the stage for what to expect later on. Mr. Calderon said he has not received
any negative feedback from neighbors, and added that the developer has promised an eight foot
screening wall. There will also be use restrictions added to the Plan Commission packets. Mr.
Calderon said there will be a neighbor meeting at the Clay Township Government Center on
August 8. Mr. Goggan said the neighborhood most affected would be Rosado Hill to the west. He
added that the developers have met with the Rosado Hill residents on site to try to come up with an
agreement.
