HomeMy WebLinkAboutResolution CC-07-16-18-01 Supports Hiring of Real Estate BrokerSPONSOR: Councilor Finkam RESOLUTION CC 07-16-18-01 A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF CARMEL, INDIANA, REGARDING TRANSFER OF REAL PROPERTY TO THIRD PARTY Synopsis: Resolution supports the hiring of a broker for the sale of real property. WHEREAS, the Common Council of the City of Carmel, Indiana (hereinafter, the "Council") approved the sale of certain property commonly known as 3348 Foster Ridge Lane, Carmel, Indiana (the "Property") by Resolution No. CC -11-20-17-02 on December 18, 2017; WHEREAS, the Property was placed up for bid by the Carmel Board of Public Works and Safety (the `BPW") pursuant to Indiana Code 36-11-1-4 and no bids were received; WHEREAS, Indiana Code 36-11-1-4(g) authorizes the BPW to hire a broker provided that the Property has been placed up for bids for at least sixty (60) days before a broker is hired and no bids were received; WHEREAS, such conditions have been satisfied; WHEREAS, the Council has determined, in the exercise of good business judgement, to support the BPW's hiring of a broker to sell the Property. NOW, THEREFORE, BE IT RESOLVED, by the Common Council of the City of Carmel, Indiana as follows: 1. The foregoing Recitals are incorporated herein by this reference. 2. Subject to approval of the BPW of the hiring of a broker to sell the Property, the Common Council hereby supports the BPW's hiring of a broker to sell the Property in accordance with Indiana Code Section 36-1-11-4(g). 3. Pursuant to Indiana Code Section 36-1-11-4(h), (i) the Property may not be sold to a person or any agent of a person who owes delinquent taxes, special assessments, penalties, interest or other costs directly attributable to a prior tax sale on a tract of real property listed under Indiana Code Section 6-1.1-24-1; and (ii) if the Property is sold to a trust (as defined in Indiana Code Section 30-4-1- l(a)) the public record relating to the sale of the Property must include each beneficiary of the trust and each settlor empowered to revoke or modify the trust. 4. The Common Council hereby approves the BPW designation of James R. Crider, Director of the Department of Administration for the City of Carmel, Indiana, as its agent for purposes of completing the disposition of the Property. James R. SPONSOR: Councilor Finkam EXHIBIT A LEGAL DESCRIPTION Land situated in the County of Hamilton, State of Indiana, is described as follows: Lot 31 in Foster Ridge, a Subdivision in Hamilton County, Indiana, as per Plat thereof recorded in Plat Book 14, Pages 105-107, in the Office of the Recorder of Hamilton County, Indiana, excepting therefrom: Beginning at a point on the south line of said Lot 31 South 89 degrees 23 minutes 43 seconds West 80.02 feet from the southeast corner of said lot; thence North 89 degrees 23 minutes 43 seconds West 40.72 feet along said south line; thence along said south line northwesterly 31.15 feet along an arc to the right having a radius of 20.00 feet and subtended by a long chord having a bearing of North 44 degrees 45 minutes 37 seconds West and a length of 28.09 feet to the west line of said lot; thence North 0 degrees 08 minutes 37 seconds West 33.84 feet along said west line; thence South 25 degrees 17 minutes 28 seconds East 48.44; thence South 75 degrees 21 minutes 33 seconds East 41.23 feet to the point of beginning and containing 770 square feet, more or less.
