RESOLUTION NO. 2018-07
A RESOLUTION OF THE CITY OF CARMEL REDEVELOPMENT COMMISSION
REGARDING AN INTERGOVERNMENTAL TRANSFER OF REAL PROPERTY
INTEREST
WHEREAS, the City of Carmel, Indiana (the "City") is an Indiana municipal
corporation; and
WHEREAS, the City of Carmel Redevelopment Commission (the "CRC") is a
governmental entity created and authorized to administer certain redevelopment activities within
the City; and
WHEREAS, the City transferred Tax Parcel Number 16-10-31-01-12-015.000 to the
CRC on July 2, 2018 (the "Mohawk Landing Parcel"); and
WHEREAS, the City owns certain property adjacent to the Mohawk Landing Parcel
known as Tax Parcel Numbers 16-10-31-01-12-002.000, 16-10-31-01-12-005.000 and 16-10-31-
01-12-006.000, located at 41 East City Center Drive, Carmel, Indiana and further described on
Exhibit A attached hereto (the "Property"); and
WHEREAS, the City has determined that it is now in the best interests of the CRC and
the City to transfer the Property depicted on Exhibit A to the CRC under the terms and
conditions set forth herein, as authorized by Indiana Code 36-7-14-12.2 and other applicable law;
and
WHEREAS, the CRC has determined that it is now in the best interests of the CRC to
acquire the Property under the terms and conditions set forth herein, as authorized by Indiana
Code 36-7-14-12.2 and other applicable law; and
WHEREAS, Indiana Code Section 36-1-11-8 authorizes the transfer of property between
governmental entities upon terms and conditions agreed upon by the entities, as evidenced by the
adoption of a substantially identical resolution by each entity.
NOW, THEREFORE, BE IT HEREBY RESOLVED by the City of Carmel
Redevelopment Commission that:
The foregoing Recitals are fully incorporated herein by this reference.
2. The City will transfer the Property to the CRC subject to the following provisions:
a. The transfer of the Property shall be by deed acceptable to the City and
CRC and the City shall execute all other usual and customary conveyance
documents.

3. The parties shall take all steps necessary to effect the transfer of the Property from
the City to the CRC as provided herein. Such transfer shall take place at a time
and date mutually agreed upon by the City and the CRC.
4. The Common Council has designated James R. Crider, Director of Administration
for the City of Carmel, Indiana, as its agent for purposes of completing the
transfer of the Property. James R. Crider is authorized to execute all documents
on behalf of the City required in connection with the transfer of the Property
pursuant to this Resolution and to take all other lawful actions necessary to
complete the transfer of the Property as contemplated herein, including but not
limited to any revisions to the attached legal description necessary to transfer the
City's interest in the Property.

EXHIBIT A
Lot Number Sixty-four (64) in Newark Village, a subdivision of a part of the West Half of the
Northwest Quarter of Section 31, Township 19 North, Range 4 East, in Hamilton county, Indiana, as
shown by plat thereof recorded in Deed Record 129, page 549, of the records in the Recorder's o ff ice
of Hamilton County, Indiana.
EXCEPTING THEREFROM: Seventy-five (75) feet off the South side of Lot Sixty -Cour (64);
AND ALSO, Lots Sixty-five (65) and Sixty-six (66) in Newark, a subdivision in Hamilton County, Indiana,
as shown by the plat thereof recorded in Deed Record 119, pages 7-9 of the records in the Recorder's office
of Hamilton County, Indiana,
EXCEPTING THEREFROM: Seventy-five (75) feet off the entire south side of Lots Numbered 65 and 66
in Newark.
Also excepting from Lots 64 and 65 described above the following two (2) parcels:
Parcel 1:
A part of Lot 64 in Newark Village, a subdivision in the West Half of the
Northwest Quarter of Section 31, Township 19 North, Range 4 East, the plat of whicb
subdivision is recorded in Deed Record 129, page 549, in the Wee of the Recorder of
Hamilton County, Tndiana; amd a part of Lot 65 in Nowark, an addition in Hamilton
Caurtty, Indiana, the plat of which addition is recorded in Deed Record 119, pages 7-9 in
the Office of the Recorder of Hamilton County, Indiana, described as follows:
BEODUNG at a point on the west Brie of said Lot 64 said point being South 0 degrees
13 minutes 54 Seconds East 28.11 feet from the northwest comer of said Lot 64, said
point being on the proposed south tight -of -way line of 12e Street; thence the following
two courses along said proposed south right-of-way line: (1) North 85 deg=; 50 minutes
53 seconds East 122.84 feet; (2) South 89 degrees 57 minutes 01 seconds East 20.00 feet;

parcel plat proceed thence South 85 degrees 46 minutes 07 seconds West 150.36 feet to the west
line of said Lot 64, marked by a point designated "316" on said parcel plat; thence North 00
degrees 13 minutes 49 seconds West along said west line 11.71 feet b the northwest comer of
said Lot 64; thence South 89 degrees 45 minutes 49 seconds East along the north line of said lots
150.00 feet to the POINT OF BEOWNlNG, containing 0.020 acres of land, more or less.
