HomeMy WebLinkAboutCarmel Fire MOU with Hamilton County Fire Departments for Joint Hiring InitiativeMEMORANDUM OF UNDERSTANDING BETWEEN THE CARMEL FIRE DEPARTMENT OF THE CITY OF CARMEL INDIANA AND THE NOBLESVILLE FIRE DEPARTMENT OF THE CITY OF NOBLESVILLE INDIANA AND THE WESTFIELD FIRE DEPARTMENT OF THE CITY OF WESTFIELD INDIANA AND THE FISHERS FIRE DEPARTMENT OF THE TOWN OF FISHERS INDIANA FOR THE COORDINATION AND IMPLEMENTATION OF A JOINT HIRING INITIATIVE The Carmel Fire Department (CFD), Noblesville Fire Department (NFD), Westfield Fire Department (WFD), and Fishers Fire Department (FFD), hereinafter referred to as the "Parties," desire to enter into this Memorandum of Understanding ("MOU") in order to collaboratively conduct new applicant testing pursuant to the Indiana Merit Statute, I.C. § 36-8-3.5 et seq., as it may be amended and supplemented from time -to -time. ARTICLE I- PURPOSE AND APPLICATION OF MOU The purpose of this MOU is to reduce the duplication of effort and generally reduce the fiscal and administrative impact of conducting the hiring process independently. This MOU specifically recognizes that each Party has particular riles, policies, and other governing articles that may dictate its response to a hiring situation. In those instances, all Parties will strive to resolve those differences to the best of their ability. ARTICLE II- JOINT HIRING LIST Section 1 - NeoGov CFD utilizes NeoGov to automate their hiring and performance evaluation process. The other Parties currently use either a different software product, or rely on paper and pen information submission. Under this MOU, all Parties shall utilize the CFD NeoGov site to automate their hiring and performance evaluation processes. The CFD NeoGov site will serve as the central repository of all candidates who apply to any of the Parties. The current CFD NeoGov site will be updated to include all pertinent hiring information as it relates to all of the Parties, including, but not limited to: relevant job descriptions, benefits and salaries. All current pre -applicants and applicants to FFD, NFD and WFD will be notified of the new NeoGov site and will be directed to that site for all future correspondence Section 2- Testing for Public Safety, LLC (TPS) All Parties currently utilize the services of TPS to conduct new applicant testing. TPS will continue to serve as the testing coordinating entity for the Parties for the duration of this MOU. A representative from each Party should attend all pre -testing meetings with TPS. The Parties shall agree to dates and times of testing, and work collaboratively to provide SLIpport personnel as necessary to facilitate the written testing process. The Parties agree to provide equal numbers of personnel to serve on the various oral interview boards as required by TPS. Charges billed by 'FPS will be shared equally by all Parties. Section 3- Establishment of Joint Hiring List Pursuant to the requirements of IC 36-8-3.5-12, upon completion of all applicant testing components, TPS shall distribute a rank ordered list of new applicants to the Parties (the "Hiring List"). Each Party may then apply any additional or bonus points as dictated by their particular Merit Commission. Section 4- Applicant Selection The Parties recognize that communication is essential to the efficient and effective processing of potential new hires from the Hiring List. Therefore, when a Party initiates new hire processing (i.e. background checks, polygraph, etc.), they will notify the other Parties of which applicants they are processing. This notification does not preclude another Party from starting their own new hire processing with that applicant, but it should be done with fill disclosure to the other Parties. Procedurally, it may be impractical and/or against a Party's Merit Commission Rules for a Party to eliminate a candidate from the Hiring List merely because another Party has begun new hire processing on that applicant. When a Party makes a conditional offer of employment to a candidate from the Hiring List, it will notify the other Parties that it has done so. If a conditional offer is accepted by a candidate, that candidate immediately becomes ineligible for employment by any other Party, unless the candidate is returned to the list because the conditional offer has been revoked. ARTICLE III- TERMS AND CONDITIONS Section 1- Term This MOU shall become effective on October 1, 2018 or upon approval by each Party's governing authority, whichever occurs sooner. This MOU shall remain in fill force and effect until the expiration of the Hiring List, which will be on May 1, 2021. Section 2 — Modification This MOU may only be modified by written amendment executed by all Parties hereto. Section 3- Termination This MOU may be terminated by any Party at any time by providing written notice of termination to each Party's Fire Chief. The termination of this MOU shall not affect the validity or duration of projects under this MOU that were initiated prior to such termination. Section 4 - Dispute Resolution In the event of a problem or disagreement between the Parties, the dispute shall be submitted for resolution to a joint board of the Parties. The joint board will consist of each Party's Fire Chief or the Fire Chief's designee.
