COUNCIL CHAMBERS/CITY HALL/ONE CIVIC SQUARE MEETING CALLED TO ORDER Council President Kevin D. Rider; Council Members: Laura Campbell, Ronald E. Carter, Jeff Worrell, Sue Finkam, H. Bruce Kimball and Deputy Clerk Jacob Quinn were present. Councilor Anthony Green was not present. Council President Rider called the meeting to order at 6:01 p.m. INVOCATION Pastor Zach Matchett, Northview Church, delivered the Invocation. Councilor Carter led the Pledge of Allegiance. RECOGNITION OF CITY EMPLOYEES AND OUTSTANDING CITIZENS There were none. APPROVAL OF MINUTES Councilor Kimball moved to approve minutes from the August 20, 2018 Regular Meeting. Councilor Campbell seconded. There was no Council discussion. Council President Rider called for the vote. Minutes were approved 6-0. Councilor Campbell moved to approve minutes from the August 20, 2018 Executive Session. Councilor Kimball seconded. There was no Council discussion. Council President Rider called for the vote. Minutes were approved 6-0. Councilor Campbell moved to approve minutes from the August 29, 2018 Special Meeting. Councilor Kimball seconded. There was no Council discussion. Council President Rider called for the vote. Minutes were approved 6-0. RECOGNITION OF PERSONS WHO WISH TO ADDRESS THE COUNCIL There were none. COUNCIL AND MAYORAL COMMENTS/OBSERVATIONS 1 Councilor Worrell spoke about events happening around the City to celebrate "Roundabout Week". Councilor Carter recognized the members of the Carmel Mayor's Youth Council who were in attendance. Councilor Finkam noted that Carmel was rated the "No. 1 Best Suburb" and "No. 3 Best Place to Live" in America, according to 2 national surveys. She also thanked Street Department Commissioner Dave Huffman for helping resolve and issue in her district with rusted curbs/sidewalks. ACTION ON MAYORAL VETOES There were none. CLAIMS Councilor Campbell moved to approve Payroll in the amount of $2,598,654.58. Councilor Kimball seconded. There was no Council discussion. Council President Rider called for the vote. Payroll was approved 6-0. Councilor Campbell moved to approve General Claims in the amount of $2,764,465.64. Councilor Kimball seconded. There was no Council discussion. Council President Rider called for the vote. Claims were approved 6-0 Councilor Campbell moved to approve Retirement in the amount of $99,214.33. Councilor Kimball seconded. There was no Council discussion. Council President Rider called for the vote. Retirement was approved 6-0. Councilor Kimball moved to acknowledge Wire Transfers in the amount of $1,782,645.34. Councilor Campbell seconded. There was no Council discussion. Council President Rider called for the vote. Wire Transfers were acknowledged 6-0. COMMITTEE REPORTS Councilor Finkam reported that the Finance, Utilities and Rules Committee had not met. Councilor Campbell reported that the Land Use and Special Studies Committee had met and that reports would be given when the item appears on the agenda. OTHER REPORTS — (at the first meeting of the month specified below): Henry Mestetsky, Executive Director of the Carmel Redevelopment Commission, gave the monthly report. OLD BUSINESS Councilor President Rider announced Resolution CC -03-19-18-03: A Resolution of the Common Council of the City of Carmel, Indiana, Granting a Waiver that Certain Private Streets be Improved to City Standards Before Being Dedicated to the City; Sponsor: Councilor Green. Item Remains in the Finance, Utilities and Rules Committee. 2 Councilor President Rider announced the Fourth Reading of Ordinance D-2430-18; An Ordinance of the Common Council of the City of Carmel, Indiana, Adding Section 6-83 to Chapter 6, Article 4 of the Carmel City Code. Councilor Campbell presented that this item is returning from the Land Use and Special Studies Committee with a positive 2-0 recommendation and proposed changes. Benjamin Legge, Assistant City Attorney, presented to Council on the Ordinance as well as proposed changes. Councilor Finkam moved to amend Ordinance D-2430-18 by inserting Version B in whole. Councilor Worrell seconded. There was no Council discussion. Council President Rider called for the vote. The motion to amend was approved 6-0. Councilor Finkam moved to approve Ordinance D-2430-18 As Amended. Councilor Campbell seconded. There was no Council discussion. Council President Rider called for the vote. Councilor President Rider announced the Third Reading of Ordinance D-2432-18; An Ordinance of the Common Council of the City of Carmel, Indiana, Amending Chapter 6, Article 5, Division VIII, Section 6-158 of the Carmel City Code. Councilor Campbell presented that this item is returning from the Land Use and Special Studies Committee with a positive 2-0 recommendation and proposed changes. Ashley Ulbricht, City Attorney, presented the item and proposed changes to Council. There was discussion on the impact this ordinance would have on kennels. The ordinance as presented did not change anything with kennels. Councilor Finkam moved to amend Ordinance D-2432-18 by inserting Version C in whole. Councilor Campbell seconded. There was no Council discussion. Council President Rider called for the vote. The motion to amend was approved 6-0. Councilor Finkam moved to amend the amended Ordinance D-2432-18 by inserting on line 91 after "time ", Music is not considered a valid construction noise. Councilor Campbell seconded. There was no Council discussion. Council President Rider called for the vote. The motion to amend was approved 6-0. Councilor Finkam moved to approve Ordinance D- 2432-18 As Amended. Councilor President Rider announced the Second Reading of Ordinance Z-634-18; An Ordinance of the Common Council of the City of Carmel, Indiana, Amending Owners' Association Standards and a Variety of Definitions in the Unified Development Ordinance; Sponsor(s): Councilor(s) Campbell & Rider. Councilor Campbell presented that this item is returning from the Land Use and Special Studies Committee with a positive 2-0 recommendation. Jon Oberlander, Assistant City Attorney, presented to Council. Councilor Finkam moved to approve Ordinance Z-634-18. Councilor Campbell seconded. There was no Council discussion. Council President Rider called for the vote. Ordinance Z-634-18 was approved 6-0. PUBLIC HEARINGS Councilor President Rider announced the First Reading of Ordinance D-2429-18; An Ordinance of the Common Council of the City of Carmel, Indiana, Authorizing and Approving an Appropriation of Funds From the Operating Balance of the General Fund to the 2018 Carmel Department of Community Services Budget. Councilor Worrell moved to introduce the item into business. Councilor Carter seconded. Jon Oberlander presented the item to Council. Council President Rider opened the public hearing at 6:48:08 p.m. Seeing no one who wished to address Council, Council President Rider closed the public hearing at 6:48:30 p.m. Jon Oberlander stated that this revenue generated from weed mowing liens. Councilor Finkam moved to suspend the rules and act on this tonight. Councilor Carter seconded. There was no Council discussion. Council President Rider called for the vote. The motion was approved 6-0. Councilor Finkam moved to approve Ordinance D-2429-18. Councilor Carter seconded. There was no Council discussion. Council President Rider called for the vote. Ordinance D-2429-18 was approved 6-0. Councilor President Rider announced the First Readiniz of Ordinance D-2439-18; An Ordinance of the Common Council of the City of Carmel, Indiana, Authorizing and Approving an Additional Appropriation of Funds From the Operating Balance of the General Fund to the 2018 Carmel Fire Department Budget. Councilor Carter moved to introduce the item into business. Councilor Worrell seconded. Mark Gugel, Deputy Chief of Administration for the Carmel Fire Department, presented to Council. Council President Rider opened the public hearing at 6:52:13 p.m. Seeing no one who wished to address Council, Council President Rider closed the public hearing at 6:52:30 p.m. Councilor Finkam moved to suspend the rules and act on this tonight. NEW BUSINESS Councilor President Rider announced Resolution CC -09-17-18-01: A Resolution of the Common Council of the City of Carmel, Indiana, Approving a Transfer of Funds Within the 2018 Carmel Street Department Budget. Councilor Finkam moved to introduce the item into business. Councilor Worrell seconded. Council President Rider passed the gavel to Councilor Worrell. Council President Rider presented the item to Council. There was brief Council discussion. Councilor Finkam moved to approve Resolution CC -09-17-18-01. Councilor Campbell seconded.
