NOTE: LEGAL NOTICE shall be published in the newspaper according to the Chart on page 5 a MANDATORY
ten (10) days prior to the public hearing date. The certified "Proof of Publication" affidavit for the newspaper must
be available for inspection the night of the hearing.
LEGAL NOTICE to all adjoining and abutting property owners is also MANDATORY, two methods of notice
are recommended:
1) FIRST CLASS MAIL WITH CERTIFICATE OF MAILING sent to adjoining property owners. (The white
receipt should be stamped by the Post Office at least 10 (ten) days prior to the public hearing date.)
2) HAND DELIVERED to adjoining and abutting property owners (A receipt signed by the adjoining and
abutting property owner acknowledging the ten (10) day notice should be kept for verification that the notice
was completed.)
REALIZE THE BURDEN OF PROOF FOR ALL NOTICES IS THE RESPONSIBILITY OF THE APPLICANT.

OWNER CONSENT TO AND JOINDER IN APPLICATIONS
The undersigned, KLC Realty, LLC is the owner (the "Owner") of the parcels of real estate that are
identified per the records of the Hamilton County, Indiana Auditor's Office as tax parcel numbers 17-13-07-04-
02-026.000 and 17-13-07-04-02-025.000 (collectively the "Real Estate"). The Owner hereby consents to and
joins in the filing by ICT, LLC (the "Applicant") of a variance application with the City of Carmel to allow for
the construction and operation of a restaurant on the Real Estate owned by the Owner (the "Application"). In
addition to the Owner consenting to and joining in the Application, pursuant to this "Owner Consent To And
Joinder In Applications", if the Applicant determines that other approvals may be required or deemed necessary
by the Applicant to develop the Real Estate for its intended use (collectively the "Other Applications"), the

Freddy’s Frozen Custard & Steakburgers Development Standards Variance Project
Description
ICT, LLC (“ICT”) is the operator of Freddy’s Frozen Custard & Steakburger restaurants
and is seeking development standards variances in order to operate a restaurant and drive-thru on
real estate that is located at the northeast corner of Michigan Road and 97th Street, having a
common address of 9701-9703 N. Michigan Road, Carmel, IN 46032 and is identified as parcel
numbers 17-13-07-04-02-025.000 and 17-13-07-04-02-026.000 (collectively, the “Real Estate”).
In order to allow for the proposed layout of the restaurant on the Real Estate, ICT is
seeking the following development standards variances from the City of Carmel’s Unified
Development Ordinance (“UDO”):
1. UDO Section 3.91.A.1 – Greenbelt Width – From 30 feet to 19 feet
2. UDO Section 3.95.F – Drive-thru lanes – To allow lines for drive-thru facilities
along the side of the structure

FINDINGS OF FACT - DEVELOPMENT STANDARDS VARIANCE
1. The approval of this variance will not be injurious to the public health, safety, morals and general
welfare of the community because:
The requested variances are necessary in order to develop the real estate for a restaurant with a drive-
thru window, consistent with other business and commercial uses in the general vicinity. As a result,
approval of the variances will not be injurious to the public health, safety, morals and general welfare of
the community.
2. The use and value of the area adjacent to the property included in the variance will not be affected in a
substantially adverse manner because:
The requested variances are necessary in order to develop the real estate for a restaurant with a drive-
thru window. The uses along the Michigan Road corridor and are business and commercial in nature
and proposed new use is consistent with those business and commercial uses, including restaurant uses
with drive-thru windows. As a result, approval of the variances will not impact the areas adjacent to the
property in a substantially adverse manner.
3. The strict application of the terms of the Zoning Ordinance to the property will result in practical
difficulties in the use of the property because:
