Our notes do not reflect that there was a condition to approval recommended. Based on our discussion yesterday my understanding is that no change to the commitments is required. • Addressing the homeowners in writing of the BMPs(for maintenance of the retention areas) The Commitments state that they (the commitments)will be made an exhibit to the CCR's. The BMP's are an obligation of the owner who will ultimately be the HOA which will be managed by the 12 owners. Based on our discussion yesterday my understanding is that no change to the commitments is required. • Connecting a multi-use path along Hoover Road for pedestrian connectivity to the north and south. ❖ Have a conversation with the home owner directly to the north (Mr. Hayes) about acquiring the ROW for a path Our understanding form the Committee meeting was that Josh Kirsh asked that Platinum meet with the owner to the north "off line" and Tim Walter is meeting with Hayes next week. Our notes reflect the Committee asked for no condition related to the construction of an off-site path segment. Our understanding is that no change to the commitments is required ❖ Possibly also committing to build the path segment in front of the two Irsay sisters parcels (12085 and 12095 Hoover Rd.), if they were only required to dedicate ROW. (We are still verifying with the Engineering Dept. what was required of them.) The question of Platinum constructing a path segment across the Irsay Hoover Road Frontage was not discussed at the Committee meeting. There was discussion from committee members asking what is required by ordinance in front of these parcels but never the suggestion that the applicant consider or agree to construct the trail regardless if right-of-way is available. Our understanding is that you will let us know what the obligation is for that owner after speaking with engineering and NELSON & FRANKENBERGER, LLC ATTORNEYS AT LAW CHARLES D.FRANKENBERGER 550 Congressional Blvd, Suite 210 JANE B.MERRILL JAMES E.SHINAVER Of Counsel LAWRENCE J.KEMPER* Cannel, Indiana 46032 JOHN B.FLATF Phone: 317-844-0106 JON C.DOBOSIEWICZ FREDRIC LAWRENCE Facsimile: 317-846-8782 MATT PLEASANT,AICP BRIAN K.TEKULVE Land Use Professionals VALERIE L.MATHEIS" 'Licensed in Kentucky **Licensed in Illinois Via Hand Delivery February 8,2019 y City of Carmel Attn:Angie Conn FEB E 8 2019 [1" Re: Platinum Properties Management Co.,LLC Camferdam Subdivison(Hampstead Garden) -- - a Dear Alexia: Enclosed please find ten (10) copies of the Plan Commission packets for distribution to the Plan Commission members for the February 19th meeting,as well as a flash drive that contains a digital copy of the packets.
