To members of the BZA, It is surprising to see this proposal on the docket for the BZA, before the proposal was presented to Crooked Stick Estates, the PUD most impacted by the proposal. There is a clear Amendment to the CCR's for Spring Run/Crooked Stick Estates, expressly forbidding a curb cut onto Crooked Stick Lane for such a development. (see attached) How can the Zoning Board disregard these LEGAL& BINDING documents? As a current resident of Crooked Stick PUD, we must abide by the Covenants and Restrictions&the zoning laws or face penalties. This newly proposed neighborhood disregards the CCR's attached to the land, as well as the S-1 Zoning restriction......Where does it end? There is not a shortage of high end housing in Carmel, especially SW Carmel. This can only be interpreted as a grab for more tax dollars, at the expense of current taxpayers. Residents of SW Carmel are already being adversely affected by neighbors commercializing their estates,thwarting the zoning ordinances in Carmel, while the laws are not enforced. Now, a developer is proposing another insult, disregarding a well documented neighborhood covenant, and asking for an unreasonable number of houses, (exceeding the zoning restriction),to be built on a modest piece of land. Perhaps, a better approach would be to shrink the operating budget of City of Carmel, rather than trying to pack more tax payers onto the land.
