HomeMy WebLinkAboutFiling Letter VV Ll � Iji:‘POLIS DEC141018COLLABORATIVE December 14, 2018 City of Carmel c/o Angie Conn One Civic Square Carmel, IN 46032 RE: 2430 East 96th Street- Use Variance Request Ladies and Gentlemen of the Staff and Board of Zoning Appeals: This packet presented to you is regarding the property located at 2430 East 96th Street, Indianapolis, IN 46240 (the "Property"). The Property is located in the "96th Street and Westfield Boulevard Sub-Area" corridor,just west of Keystone Avenue (See Zoning Context Map and Existing Conditions Exhibit). Tony Kistner (the "Petitioner") is the proprietor of a locally operated printing and publishing business called PIP Printing located at 11711 North Meridian Street, Suite 107, Carmel, IN 46032. They currently employ ten (10) full-time employees. Rooted here in Carmel, the Petitioner wishes to expand an area of his business involved with sign printing/fabricating.The current space will not accommodate the new equipment required and there is no vacant space adjacent to the existing location in which to expand into. Thus, On November 5th, 2018, the Petitioner entered into a contract to purchase the Property from the current owners, Richard E and Kimberly D Imel. The intention of purchasing this property is to use the existing pole barn, located at the rear of the property (see Existing Conditions Exhibit and Existing Aerial Exhibit), to conduct the desired printing and sign assembly operations. The existing home would remain a residence. The Property was included in the "96th Street and Westfield Boulevard Sub-Area" corridor according to the Carmel Comprehensive Plan and was identified as part of the "Employment Node", whereby the city desires to see such land uses as "professional and business office" and "Office-supporting commercial (e.g. small-scale restaurants, coffee houses, print shops, and office supply stores that directly support office uses)". The proposed Use Variance is consistent with the city's desired land uses for this sub- area. However, in purchasing the Property,the Petitioner is aware that the city has identified the "96th Street and Westfield Boulevard Sub-Area" for higher density growth with enhanced development and architectural standards. The Property was specifically included in the "1 to 2 Story Employment Center" according to the "96th Street and Westfield Boulevard Sub-Area Plan". As a result, city staff has recommended that the use variance, if approved, be valid for only one (1) year, whereby the Petitioner would be required to return to the Board of Zoning Appeals (the "BZA") to request an extension. The Petitioner understands that with the long-term vision for this area, the city desires some additional oversight. However, if the variance is approved, the Petitioner would, at the earliest, close on the Property in March 2019. After making some needed interior improvements to the pole barn, installing required equipment, and finalizing set-up, the one (1) year timeline would not give the Petitioner adequate time to begin operating before they would need to come back before the BZA. Therefore, the Petitioner would humbly request a five (5) year sunset on the use variance, if approved. This would give the Petitioner adequate time to set-up and operate and allow the rest of the area to mature towards the city's vision, whereby the Petitioner would be eager to participate as a property owner.
